CITY OF YAKIMA, WASHINGTON
JUNE 8, 1993
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m. in
the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members Clarence Barnett,
Henry Beauchamp, Bill Brado, and Bernard Sims present on roll
call. Council Members Lynn Buchanan and Skip Semon absent and
excused. City Manager Zais, City Attorney Vanek, and City
Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE -
The Invocation was given by Council Member Beauchamp.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS
• Mayor Berndt read the proclamation declaring
June 11, 12 & 13, 1993 as Tiinowit International Pow -Wow Days
commemorating the signing of the Treaty of 1855. The
celebration, which will represent people from various tribes
throughout Canada and the United States, will be held in the
Sundome. Over 1,000 Native American dancers, singers, and
drummers will compete, and 200 arts and crafts vendors will
participate in the three -day event. Mayor Berndt was presented
with a key chain in recognition of the event.
4. PRESENTATION BY THE FOURTH OF JULY COMMITTEE
Events of the 4th of July celebration were announced and will
be free to the public. Proceeds from the sale of buttons and
local businesses are sponsoring the celebration. Buttons were
sold to the Council members and County Commissioners Ingham and
Lewis.
5. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present. It
was the general consensus to add Items Nos. 9 and 14 to the
Consent Agenda. The City Clerk then read the Consent Agenda
items, including resolutions and ordinances by title. It was
MOVED BY SIMS, SECONDED BY BARNETT, THAT THE CONSENT
AGENDA, AS AMENDED, BE ADOPTED. The motion carried by
unanimous roll call vote; Buchanan and Semon absent.

*6. APPROVAL OF THE MINUTES OF THE MARCH 23 AND MAY 25, 1993
BUSINESS MEETINGS
The minutes of the March 23 and May 25, 1993 Business Meetings,
were approved, having been duly certified - accurate by two
Council Members and no one present wishing to have said minutes
read publicly.
7. PUBLIC HEARING TO CONSIDER THE COMMUTE TRIP REDUCTION PLAN AND
ORDINANCES
This being the time set for the public hearing, John Elsden,
Senior Project Planner, introduced Doug Schneider from the
Department of Ecology in Olympia. Mr. Schneider presented
information related to air quality in Yakima, specifically
related to carbon monoxide air quality attainment issues. He
explained that the U.S. Environmental Protection Agency can
redesignate an area from nonattainment to attainment status
when specific standards are met. Among those requirements is
that the monitoring and the evaluation of the monitoring
network must show the air actually attained the standard.
Another requirement includes a federally approved maintenance
plan that demonstrates the standard will be maintained for a
12 -year period. Although Yakima violated the national health
standard for carbon monoxide in the 1970s and 1980s, it did not
violate the carbon monoxide standard during the 1989 -1990
classification period specified by the federal Clean Air Act
Amendments of 1991. Currently, Yakima is meeting the carbon
monoxide standard. There was further discussion among Council
members and Mr. Schneider pertaining to the improvement of air
quality and how the implementation of the Commute Trip
Reduction Program relates to that issue.
John Elsden presented a brief summary of the proposed Commute
Trip Reduction (CTR) program. He explained that each Major
Employer (as defined by the Act) must develop and implement a
CTR Program that will encourage its employees to achieve
reductions in vehicle miles traveled and single occupancy
vehicle rates. In order to address comments and answer
questions from Council members, Mr. Elsden also explained some
of the definitions found in the plan, including "Major
employer" and "Major worksite." The legislation only takes
into consideration the arrival time between 6 and 9 a.m. and
the number of employees that work full time, year around. In
addition, he commented about the City of Yakima's CTR plan
currently being developed which contains two affected
worksites, City Hall and the City Shops Complex. Mr. Elsden
further commented about some concerns expressed to him by some

affected employers. They have suggested other major employers,
who are not affected by the legislation, be encouraged to
participate in the program on a voluntary basis. This
suggestion will be further considered as the program is
developed.
Although he is not against the objectives and the goals of the
state law, Council Member Barnett commented that there seems to
be a lot of minutiae. Mr.. Elsden explained a checklist will
probably be developed which will standardize the reporting
process. Council Member Sims recognized the coordination
efforts of Mr.Elsden and commented that a group of employers
are working on a standard objective and mission statement. It
will make the reporting easier to understand and to work with.
Referring to the proposed ordinances, Mr. Elsden explained a
penalty section has been added allowing the Director of
Community Development to be the enforcer of the Commute Trip
Reduction Plan.
Mayor Berndt opened the Public Hearing for comments about the
proposed Commute Trip Reduction Plan.
Barry LaDuke, representing Northwest Windows and Patio Doors,
1705 Parsons Loop, commented his opposition to the criteria
regarding the 6 -9 a.m. time frame contained in the "Major
worksite" and "Affected employee" definition. He expressed
concern because several very large employers will not be
required to participate in the program. He suggested the
criteria be reevaluated to include employers who have shift
workers. Mr. LaDuke requested consideration be given to the
development of an incentive program to help employers attract
employee participation in the CTR program. Council Member
Barnett suggested that perhaps staff can develop ideas to
overcome Mr. LaDuke's objections. In answer to a question from
Council Member Beauchamp, Mr. LaDuke commented about the
numerous opportunities provided him to contribute his ideas
into this draft legislation during the past several months. He
also commented about the tremendous effort Mr. Elsden has put
forth keeping the affected employers in Yakima informed of all
the current events regarding the draft plan.
Council Member Brado referred to the additional elements,
listed on page 6 of the draft ordinance, suggested for
inclusion in the major employer's CTR program. These elements
are included to encourage employee participation. There was
further discussion among Council members and Mr. Elsden
regarding the percentage of the work force affected by the
proposed CTR program and the possibility of change in criteria
contained in the legislation to possibly add particular groups.
Council Member Brado suggested that this draft plan be

implemented to see how it works and what happens before
anything more restrictive is added. In answer to a question
from Council Member Beauchamp, Mr. Elsden commented about
I/ discussion with the Department of Ecology and the Energy Office
about their concern over our SOV and VMT goal reduction of 5%.
Council Member Brado commented about the increase in the amount
of traffic and the possibility that the CTR program will help
relieve that problem. Mayor Berndt commented about the high
percentage of people in other areas of the country who are
choosing alternative ways to get to work, such as taking the
bus or riding a bicycle.
Tom Silva, with the Yakima Clean Air Authority, voiced his
support of the adoption of the CTR program. The associated
benefit from having less cars driving around town is less
carbon monoxide. He commented about the maintenance plan to be
submitted that will be a step toward reaching attainment of the
carbon monoxide problem.
There being no one else wishing to comment, Mayor Berndt closed
the Public Hearing.
A. AN ORDINANCE ADOPTING A COMMUTE TRIP REDUCTION PLAN
Ordinance No. 93 -28, having been read by title, it was MOVED
BY BEAUCHAMP, SECONDED BY SIMS, THAT THE ORDINANCE BE
PASSED. The motion carried by unanimous roll call vote;
Buchanan and Semon absent.
ORDINANCE NO. 93 - 28, AN ORDINANCE relating to licenses and
business regulations, adopting a Commute Trip Reduction Plan
and implementing measures as required by RCW 70.94.527; and
enacting Chapter 5.90 "Commute Trip Reduction Plan" and
Sections 5.90.010, 5.90.020, 5.90.030, 5.90.040, 5.90.050,
5.90.060, 5.90.070, 5.90.080, 5.90.090, and 5.90.100 thereof as
a new chapter, new sections, and new subsections of the City of
Yakima Municipal Code.
B. AN ORDINANCE RELATING TO ENFORCEMENT OF THE COMMUTE TRIP
REDUCTION PLAN
Ordinance No. 93 -29, having been read by title, it was MOVED
BY BEAUCHAMP, SECONDED BY BARNETT, THAT THE ORDINANCE
BE PASSED. The motion carried by unanimous roll call vote;
Buchanan and Semon absent.
ORDINANCE NO. 93 - 29, AN ORDINANCE relating to licenses and
business regulations; clarifying application of violation
provisions, creating new enforcement duties, and amending
Sections. 5.01.010 and 5.01.030, both of the City of Yakima
Municipal Code.

8. AUDIENCE PARTICIPATION
Premetra Williams, 104 North 8th Street, spoke about the
problems which are occurring from living next to the Yakima
Center. Staff was directed to contact Mrs. Williams in the
next week about the possibility of installing a fence.
Bill Schultz, Transit Manager, invited Council to the
groundbreaking ceremony on June 15th for the Transit Center.
Council Member Beauchamp inquired about the cleaning schedule
of the buses. Staff will research the issue.
*9. REPORT FROM DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT ON
CABLE TV SURVEY
The Cable TV Survey report was accepted.
10. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND
DEBRIS ABATEMENT PROGRAM
Robert Shampine, Code Administration Manager, reported no
changes to the report. There was no citizen present wishing to
speak to the issue. Resolution No. R- 93 -54, having been read
by title, it was MOVED BY SIMS, SECONDED BY BEAUCHAMP, TO
ADOPT THE RESOLUTION. The motion carried by unanimous roll
call vote; Buchanan and Semon absent.
RESOLUTION NO. R 93 - 54, A RESOLUTION authorizing the Code
Administration Manager to clear certain weedy lots.
*11. CONSIDERATION OF RESOLUTIONS AUTHORIZING AGREEMENTS FOR PARKS
AND RECREATION PROGRAMS WITH:
A. ALLIED ARTS COUNCIL FOR SUMMER ARTSVAN PROGRAM
RESOLUTION NO. R 93 - 55, A RESOLUTION authorizing
execution of an Agreement with the Allied Arts Council of
Yakima Valley for the "ArtsVan Program."
B. YAKIMA Y.M.C.A. FOR SUMMER PLAYGROUND PROGRAMS
RESOLUTION NO. R 93 - 56, A RESOLUTION authorizing
execution of an Agreement with the Young Men's Christian
Association of Yakima for a summer playground program.
C. SALVATION ARMY OF YAKIMA FOR SUMMER PLAYGROUND PROGRAM AT
MILROY PARK
RESOLUTION NO. R 93 - 57, A RESOLUTION authorizing an
Agreement between the City of Yakima and the Salvation Army of
Yakima to provide a Summer Playground Program at Milroy Park.

*12. CONSIDERATION OF RESOLUTION GRANTING AN EASEMENT OVER THE PP &L
CANAL IN THE VICINITY OF NO. 40TH AVENUE, SOUTH OF SR12
RESOLUTION NO. R 93 - 58, A RESOLUTION authorizing the
execution of an agreement and grant of easement.
*13. CONSIDERATION OF RESOLUTION AUTHORIZING FREE BUS SHUTTLE
SERVICE ON JULY 4, 1993 FOR FOURTH OF JULY CELEBRATION
RESOLUTION NO. R 93 - 59, A RESOLUTION providing for free
shuttle bus service to the Yakima County Fairgrounds on July 4,
1993.
*14. CONSIDERATION OF ORDINANCE AMENDING THE MUNICIPAL CODE
REGARDING SNOW REMOVAL
ORDINANCE NO. 93 - 30, AN ORDINANCE relating to streets and
sidewalks; creating an obligation to remove snow from public
sidewalks by the adjacent property owner or occupant; creating
a civil infraction with monetary penalties for violations;
authorizing exemptions; amending Sections 8.88.010 and
8.88.020, and enacting Section 8.88.030 all of the City of
Yakima Municipal Code.
15. OTHER BUSINESS
It was MOVED BY SIMS, SECONDED BY BARNETT, TO MOVE INTO
EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PENDING
LITIGATION, WITH IMMEDIATE ADJOURNMENT THEREAFTER TO
JUNE 15, 1993 AT 7:00 AM FOR INFORMAL DISCUSSION WITH
PUBLIC WORKS DEPARTMENT; THEN TO 1:00 PM TO CONTINUE
RETREAT WITH THE YAKIMA COUNTY COMMISSIONERS AT 104 NO.
4TH STREET. The motion carried by unanimous voice vote;
