CITY OF YAKIMA, WASHINGTON
MAY 18, 1993
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m. in
the Council Chambers of City Hall, Yakima, Washington. Mayor
Pat Berndt, presiding, Council Members Clarence Barnett,
Henry Beauchamp, Bill Brado, Lynn Buchanan, Skip Semon and
Bernard Sims present on roll call. City Manager Zais, City
Attorney Vanek, and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Barnett.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Miriam Brown presented background information about the
educational exchange program with the Russian Sister City of
Derbent. Describing the high school students as part of the
future generation of "new Russia," Ms. Brown introduced
Uriyat Alekberova, President of Derbent Sister City
Organization; Perikhanum Davoudova, Teacher; Anna Shakhbazova,
Teacher; Zinaida Suleimanova, 10th grade student;
Konstantine Sladkov, 11th grade student (Russian students
graduate after 11th grade); Elmira Shabanova, 10th grade
student; and Murad Alidjanov, 11th grade student.
Uriyat Alekberova presented Mayor Berndt with gifts from the
City of Derbent that included a little carpet made especially
for this occasion by the fifth grade children from an
orphanage.
A. PROCLAMATIONS
Mayor Berndt proclaimed May 21 -May 31, 1993 as "Poppy Days" in
the City of Yakima whereby she officially recognized the
American Legion's worthy fund raising campaign.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
Mayor Berndt announced that Item No. 12 was removed from the
Agenda and was tabled for one week. The City Clerk then read
the Consent Agenda items, including resolutions and ordinances
by title. It was MOVED BY .SIMS, SECONDED BY BUCHANAN,
THAT THE CONSENT AGENDA, AS AMENDED, BE ADOPTED. The
motion carried by unanimous roll call vote. (Subsequent
paragraphs preceded by as asterisk ( *) indicate items on the
Consent Agenda handled under one motion without further
discussion.)

*5 APPROVAL OF THE MINUTES OF THE FEBRUARY 23, 1993 BUSINESS
MEETING
The minutes of the February 23, 1993 Business meeting, was
approved, having been duly certified accurate by two Council
Members and no one present wishing to have said minutes read
publicly.
6. PRESENTATION BY CHAMBER OF COMMERCE REGARDING ALL AMERICAN
CITY COMPETITION
The All American City Group, Curtis King, Cec Vogt, Ester Huey
and Greg Stewart, gave their ten - minute presentation which
will be presented to the panel of judges in Tampa, Florida.
Wendy Warren, Cable Communications Manager, Mark LeCuyer, from
Marq's Packaging, and Marketa Oliver, Administrative Assistant
to the City Manager, were recognized for their participation
in producing the video that will be used in the competition.
Mayor Berndt read a letter from Governor Mike Lowry who
congratulated the Chamber of Commerce and the City on this
well deserved recognition as one of thirty finalists in the
All American City competition.
7. REPORT FROM TRADEC ON AG SHOWCASE
Scott Jackson, President of Tradec, presented a status report
on the plans for the 1993 Washington State Agricultural
Showcase. He emphasized some of the developments surrounding
the 2nd Annual Showcase and recognized the Steering
Committee's participation, which includes representation from
the various elements of agriculture throughout the _state. He
indicated -there is a lot of visibility in terms of people who
will be attending, both from the public and private sector and
further indicated the continued exhibitor recruitment
activities taking place. He thanked the Council for their
participation and invited them to participate in the ribbon
cutting ceremony on opening day. ,
8. PUBLIC MEETING TO CONSIDER THE HEARING EXAMINER'S
RECOMMENDATION REGARDING REZONE REQUEST OF THE HOUSING
FOUNDATION
This being the time set for a public meeting, Joan Davenport,
Supervising Associate Planner, described the location of
property pertaining to the Housing Foundation's application to
rezone one parcel from M -1, Light Industrial to R -3, Multi -
Family Residential. Although there is no project tied to this

rezone application, which needs Council approval,
Ms. Davenport explained the Housing Foundation's proposed use
of the property. She recommended the rezone be approved even
though they would not normally encourage single family homes
to be located next to an industrial area. It is compatible
with the area since the location is near a park and existing
residential uses, and as Council Member Barnett added, it
would create a more logical boundary for the two zoning
districts.
Mayor Berndt asked for anyone present wishing to comment on
this rezone. There being no one wishing to speak, the public
meeting was closed. Ordinance No. 93 -24 having been read by
title, it was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP,
TO ADOPT THE ORDINANCE. For public disclosure purposes, all
Council members declared no exparte contact. The motion
carried by unanimous roll call vote. It was MOVED BY BRADO,
SECONDED BY SEMON, THAT AS PART OF THE REZONE, THE
PURCHASERS BE NOTIFIED IN WRITING THAT THE PROPERTY IS
LOCATED ADJACENT TO AN M -1, LIGHT INDUSTRIAL USE ZONE
AND IT COULD BE A HINDRANCE TO THEM. The motion carried
by unanimous voice vote.
ORDINANCE NO. 93 - 24, AN ORDINANCE relating to zoning;
rezoning a .58 acre parcel of land located at 802 Hathaway,
Yakima, Washington from Light Industrial (M -1) to Multi - Family
Residential (R -3); and amending the zoning map of the City of
Yakima.
9. AUDIENCE PARTICIPATION
Judy Ayon presented Council with a petition for rezone of the
property in the vicinity north of Pacific and east of Fair.
City Manager Zais explained that it would be appropriate to
refer this petition to staff for further study and examination
of the proposal and then return with a presentation to
consider the request in public session. There was a consensus
among Council members to refer the petition to staff for
further study and examination.
David Hawkins, 215 North 2nd Avenue, spoke about violent crime
in Yakima County and acts of vandalism occurring within the
-City limits. He described his program and stated that the
statistics could be improved by using it.

*10. NOTICE OF INTENT TO COMMENCE ANNEXATION OF PROPERTY IN THE
VICINITY OF LINCOLN AND 16TH AVENUE (STANDARD MOTIONS A & B)
May 18, 1993 was set as the time of a meeting with the
initiating parties who have signed a Notice of Intent to
Commence Annexation Proceedings, the initiating parties being:
Jake P. Leingang, Richard E. & Cicely Walker, Gaylord B. &
Valda Newby, Gerald E. & Sherry Wilson, Royce D. Pierson,
William C. Clement, Jack Cahoon, Alvin R. Cleaver, Ronald &
Doug Pendelton, Herbert Ritter, James F. & Linda J. Siegel, E.
K. Reishcl, and Alene E. Warren..
The annexation proposed by the above listed parties was
accepted by the City of Yakima, and the area proposed to be
annexed was required to assume its share of the City's
existing indebtedness, and staff was directed to file a Notice
of Intent to Annex with the Yakima County Boundary Review
Board.
*11. CONSIDERATION OF RESOLUTION ADOPTING THE 1993 BIOSOLIDS
MANAGEMENT PLAN (STATE MANDATED)
RESOLUTION NO. R- 93 -45, A RESOLUTION adopting the 1993
Biosolids Management Plan for the City of Yakima, Washington.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF LICENSE
AGREEMENT WITH YAKIMA COUNTY FOR THE GREENWAY SOUTH PROJECT
Removed from Agenda and tabled for one week.
*13. APPROVAL OF APRIL 1993 BUDGET REPORT
The April 1993 Budget Report was accepted.
14. OTHER BUSINESS
Mayor Berndt requested Council think about appointing voting
delegates to the Association of Washington "Cities (AWC)
Conference to be held in Yakima on June 23 -25, 1993.
A list of the respondents to the City's request to serve on
the Capital Improvement Committee was presented, and it was
MOVED BY BUCHANAN, SECONDED BY, TO ACCEPT THOSE ON THE
LIST AS THE CITIZEN CAPITAL IMPROVEMENT COMMITTEE. The
motion carried by unanimous voice vote. The names on the list
include Bob Alexander, Mulugeta Beyene, Bob Brown,
Anne Caffery, Lynn Carmichael, Ellis Cummins, Daniel Enriques,
Abe Gonzales, Jay Grandy, Lupita Gutierrez - Parker, Don Hinman,

Phil Hoge, Dale Johnson, Deborah Krautwurm, Greg Luring,
W.K. Moore, Gary Myhre, Oliver Nelson, Mike Nixon,
Bruce Patterson, Virginia Santillanes, Maud Scott,
Dennis Sertz, Guy Shinn, Dick Smith, Janet Snodgrass, and
Jerry Sturgill. City Manager Zais requested a meeting with
the City Liaison Committee, Mayor Pat Berndt and Council
Members Lynn Buchanan and Clarence Barnett.
Council Member Brado stated he was informed that business
people on North 1st Street are experiencing similar problems
as those voiced by the Westside Merchants (vandalism and
break -ins).
Council Member Beauchamp commented that because Management was
excluded from increased compensation last year and since 1992
was a better year than anticipated, it was MOVED BY
BEAUCHAMP, SECONDED BY BUCHANAN, TO DIRECT STAFF TO
BRING BACK A 1993 MANAGEMENT COMPENSATION PROPOSAL
(FOR THOSE INDIVIDUALS WHO WERE PREVIOUSLY EXCLUDED).
The motion carried by 5 -2 voice vote; Barnett and Brado voting
nay.
Council Member Semon requested a meeting of the Council's
Economic Development Committee be called to discuss the
inclusion of temporary non - Council members.
Council Member Sims reported the Westside Merchants group met
and heard a presentation from the Police Department and from
the Street Division regarding lighting.

It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO
MOVE INTO EXECUTIVE SESSION FOR THE PURPOSE OF
DISCUSSING PENDING LITIGATION, WITH IMMEDIATE
ADJOURNMENT THEREAFTER TO MAY 25, 1993 AT 7:30 AM, AT
THE YAKIMA SCHOOL DISTRICT LIBRARY FOR CITY /COUNTY
RETREAT; THEN TO MAY 25, 1993 AT 1:30 PM FOR EXECUTIVE
SESSION REGARDING PENDING LITIGATION. The. motion carried
by unanimous voice vote.
16. ADJOURNMENT TO MAY 25, 1993 AT 7 :30 A.M., YAKIMA SCHOOL
DISTRICT LIBRARY FOR CITY /COUNTY RETREAT; THEN TO MAY 25, 1993
AT 1:30 P.M. FOR EXECUTIVE SESSION REGARDING PENDING
LITIGATION
Following the conclusion of the Executive Session, the meeting
