ADJOURNED MEETING
The City Council met in session on this date ,at 7:00 a. m. in Room
A at the Yakima Center, Yakima, Washington. Council Members
present were Mayor Pat Berndt, Lynn Buchanan, Skip Semon and
Bernard Sims. Council Members Clarence Barnett, Henry Beauchamp,
and Bill Brado absent. Staff members present were City Manager
Zais, Assistant City Manager Rice, Administrative Assistant to the
City Manager Oliver, and City Clerk Roberts.
INFORMAL DISCUSSION AMONG COUNCIL MEMBERS
Discussion ensued regarding the Schumacher bequest which is on the
agenda for today's Council meeting. City Manager Zais stated that
a decision does not need to be made today.
Mayor Berndt requested Council direction on an issue involving the
Greenway Board, the Arboretum, and a proposed picnic shelter in
Sherman Park sponsored by the Kiwanis Club in honor of Fred
Westberg. The City has an agreement with the Arboretum that no
fences would be built, yet the Arboretum is requesting a fence be
erected if the picnic shelter is built. Following discussion, it
was the general consensus of the Council that no fence should be
erected.
Council members discussed the State Options for Revenues which was
provided in their Council packets. City Manager Zais commented
that it is interesting to know how many options the State has
versus the City's options; approximately 90% for the State versus
10% for cities. He reviewed a few new bills introduced to the
Legislature. One bill would require all cities and towns to ramp
down utility taxes to 6% over a ten year period. Another bill
would allow termination of annexation elections if a simple
majority of voters or homeowners file declarations of objection
to the annexation. A third bill of concern involves LEOFF II
change of retirement age from 58 to 50. An actuarial indicated it
could cost the City a little over $4 million.
Council members discussed the Terrace Heights water service issue.
Council Member Buchanan stated that well service would not provide
fire service or a water reservoir, nor would they be connected to
I/ the sewer. He suggested that the City do nothing at this time;
suspecting they will soon turn to the City for service.
Council talked about the County's perception of the City and the
City's projects. A retreat date with the County is tentatively
scheduled for March 13th. The facilitator is paid by the State and
only wants actual expenses paid.

Council returned to the discussion of proposed bills before the
Legislature. City Zais reviewed three bills addressing
criminal justice funding. Another set of bills introduced are

called "taking" bills, pertaining to land use regulations of the
cities. If any takings are found, the government entity would
have to pay for that value. He stated he is not sure if this is
a big deal to Yakima. AWC does not like these "taking" bills at
all. Council will want to read the bills and go from there.
Assistant City Manager Rice gave a brief report on the industrial
park status.
Council Member Semon requested information on the residency
requirements of citizens wishing to serve on City boards and
commissions. City Manager Zais stated he would ask the City
Attorney to provide that information to the Council.
Council members discussed various projects, including the police
station /legal center, 1-82 project and Transit Transfer
facility /temporary location.
City Manager Zais stated staff is waiting for the official
proposal from West Valley. What Council's seen in the newspaper
is all that staff knows.
Council Member Sims absent after 8:30 a.m. There being no quorum
present, the meeting adjourned at 8:30 a.m.
