CITY OF YAKIMA, WASHINGTON
JANUARY 26, 1993
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m. in
the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members
Henry Beauchamp, Bill Brado, Lynn Buchanan, Skip Semon and
Bernard Sims present on roll call. Council Member
Clarence Barnett absent and excused. City Manager Zais,
City Attorney Vanek, City Clerk Roberts, and Deputy City
Clerk Skovald also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Karen Roberts, City
Clerk.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Glenn Valenzuela was introduced as the new Director of
Community and Economic Development. He will officially
start his duties on February 16, 1993.
Mayor Berndt reported that she and Assistant City
Manager Rice will travel to Olympia and testify before the
Legislatures on three issues (hotel /motel tax, public
facilities, and definition of port districts) which will
impact Yakima.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
It was the general consensus to remove Item No. 11 from the
Consent Agenda. The City Clerk then read the Consent Agenda
items, including resolutions and ordinances by title. It
was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE
CONSENT AGENDA, AS AMENDED, BE ADOPTED. The motion
carried by unanimous roll call vote; Barnett absent.

*5. APPROVAL OF THE MINUTES OF THE NOVEMBER 26, 1991 AND
DECEMBER 8, 1992 ADJOURNED MEETINGS (Continued from 1/19/93)
AND JANUARY 12, 1993 ADJOURNED AND BUSINESS MEETINGS
1/ The minutes of the November 26, 1991 and December 8, 1992
Adjourned meetings- and January 12, 1993 Adjourned and
Business meetings were approved, having been duly certified
accurate by two Council Members and no one present wishing
to have said minutes read publicly.
6. AUDIENCE PARTICIPATION
Leona Hiner, 109 South 10th Street, requested Council
members consider enacting a cat control ordinance. She
explained the cats are causing damage to personal property
and commented on the large number of the animals running
loose. City Attorney Vanek commented on the progress of the
animal control ordinance which is being redrafted.
Mayor Berndt explained the effort to find solutions to this
ongoing problem will continue.
Richard Berglund, P.O. Box 8223, Yakima, requested Council's
consideration of an apprenticeship and training program for
construction projects over $100,000. Mr. Berglund submitted
a resolution for Council's consideration and explained that
the apprenticeship method is a time - honored, successful
system where trades and crafts can be learned from
experienced workers. City Manager Zais recognized that the
apprenticeship program can be of value and benefit and
indicated there is a strong interest in this area. He
suggested this request be referred to the Legal Department
for review and explained any formal consideration would come
at a later date. Responding to a question from Council
Member Sims, Mr. Berglund explained how the apprenticeship
program works and described his work experience when he was
an apprentice. He further explained that as the need
develops, each apprenticeship program takes in more members.
Council Member Beauchamp commented about the possibility of
utilizing this program, particularly in the construction
trades, as part of the workforce development within the
Yakima community. Phil Pleasant, a Yakima citizen, spoke in
1/ support of this issue and urged Council members adopt the
resolution. He commented that apprenticeship programs work
and would provide the skills people need to become a
craftsman and get a good job. Mr. Pleasant further
commented that the apprenticeship program would help build
economic stability in the community.

*7. SET DATE OF JOINT CITY /COUNTY PUBLIC MEETING FOR
FEBRUARY 23, 1993 REGARDING URBAN AREA ZONING ORDINANCE TEXT
AMENDMENTS
February 23, 1993 was set as the date of joint public
meeting with the Yakima County Commissioners on Urban Area
Zoning Ordinance text amendments.
*8. RESET DATE OF PUBLIC MEETING FROM FEBRUARY 9, 1993 TO
FEBRUARY 2, 1993 FOR REZONE OF PROPERTY AT THE NORTHEAST
CORNER OF 40TH AVENUE AND ENGLEWOOD, REQUESTED BY
SMITH /LUKEHART PARTNERSHIP
February 2, 1993 was reset as the date of public meeting for
the rezone of property at the northeast corner of 40th
Avenue and Englewood, requested by Smith /Lukehart
Partnership.
*9. RESET DATE OF PUBLIC MEETING FROM FEBRUARY 9, 1993 TO
FEBRUARY 2, 1993 FOR CONSIDERATION OF STREET VACATION IN THE
VICINITY OF CHERRY AVENUE, BETWEEN NORTH 1ST AVENUE AND 3RD
AVENUE REQUESTED BY WASHINGTON FRUIT
February 9, 1993 was reset as the date of public meeting on
the street vacation in the vicinity of Cherry Avenue,
between North 1st Avenue and 3rd Avenue, requested by
Washington Fruit.
*10. FIRST READING OF ORDINANCE AMENDING THE 1993 BUDGET AND
APPROPRIATING FUNDS FOR FIRE INSPECTION STAFF /CAPITAL OUTLAY
EXPENDITURES (No formal action required this meeting)
An Ordinance amending the 1993 budget and appropriating
funds for fire inspection staff and capital outlay
expenditures, having been read by title only, was laid on
the table for one week, until February 2, 1993.
11. SECOND READING OF ORDINANCE AMENDING THE 1993 BUDGET AND
APPROPRIATING FUNDS FOR ARCHITECTURAL SERVICES RELATED TO
THE POLICE STATION /LEGAL CENTER
An Ordinance amending the 1993 budget and appropriating
funds for architectural services related to the Police
Station /Legal Center, having been read by title only at the
previous meeting was brought before the Council for a second
reading.
Ordinance No. 93 -3 having been read by title, it was MOVED
BY BUCHANAN, SECONDED BY SIMS, THAT THE ORDINANCE BE
PASSED. Council Member Brado stated that the Council has a
responsibility to review the final RFP and provide

opportunity for public review before it is sent out for bid.
Mayor Berndt commented this ordinance is just for the
authorization for the funding appropriation. City Manager
I/ Zais explained the procedure for the RFP. The question
was called for a vote on the motion. The motion failed
by a 4 -2 roll call vote; Brado and Beauchamp voting nay;
Barnett absent. After further discussion among Council
members regarding whether or not to develop the RFP and
coming to a consensus to allow for formal review of the
final RFP, it was MOVED BY BEAUCHAMP, SECONDED BY SIMS,
TO RECONSIDER THE VOTE ON THE APPROPRIATION. The
motion carried by unanimous voice vote; Barnett absent. It
was MOVED BY BEAUCHAMP, SECONDED BY BUCHANAN, THAT
PRIOR TO THE ISSUANCE OF THE RFP, THAT IT BE BROUGHT
BACK TO COUNCIL FOR REVIEW. The motion passed by 5 -
voice vote; Berndt voting nay; Barnett absent. After
continued discussion about the details of the RFP review,
and Ordinance No. 93 -3, having been read by title, it was
MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADOPT THE
ORDINANCE. The motion carried by unanimous roll call vote;
Barnett absent.
ORDINANCE NO. 93 - 3, AN ORDINANCE amending the 1993
budget for the City of Yakima; and making an appropriation
of $37,265 in the General Fund for expenditure during 1993
for architectural services related to the Police
Station /legal Center.
12. OTHER BUSINESS
City Clerk Roberts asked Council members to consider
changing the delivery of Council books on Saturday morning
rather than Friday evenings due to safety concerns of those
delivering the books. Mrs. Roberts requested Council
members advise her of individual delivery preference, and
she indicated any concerns would be addressed and special
requests would be accommodated.
David Hussell, Streets & Traffic Operations Manager,
reported on pothole repair indicating there are a number in
the streets and probably more will appear due to the severe
I/ weather conditions. He outlined the current work schedule
which will continue until the situation is under control.
Answering Council Member Beauchamp's question regarding the
preparation for the cold patch repair process, Mr. Hussell
described the procedure and explained it is used to
temporarily repair the potholes until permanent repairs can
be done in the spring and summer. He announced the
telephone number for citizens to report potholes. Answering

an inquiry from Council Member Sims regarding ice removal,
Mr. Hussell explained the graders are out working on this
problem. Mayor Berndt passed on a compliment from a citizen
who noticed the excellent job the snow removal crew has
done. Council Member Buchanan commented on the long, hard
hours the crew has put in to keep the streets clear.
Bob Shampine, Code Administration Manager, gave a report on
abandoned signs. Some time ago, the question was raised by
a concerned citizen to remove the signs. According to
Council direction last October, Mr. Shampine explained,
since there was a conflict in the Sign Code and zoning
Ordinance, he was to wait six months. Council Member Brado
commented on the possibility of a new sign ordinance coming
in the near future. Mayor Berndt indicated a letter should
be drafted to the concerned citizen on behalf of the Council
explaining this situation.
Mr. Shampine also reported that there are 27 Adult Family
Homes in the City with the number of persons ranging from
one to six, averaging 3 1/2 persons per residence.
Mr. Shampine explained the City does not have any
jurisdiction in these homes whatsoever. After discussion
among Council members regarding the safety of these people
in the Adult Family Homes, it was decided to speak to area
Legislators regarding State law that permits adult family
homes in R -1 zone without any review by the City or
neighbors. Staff was directed to research the possibility
of requiring a business license for Adult Family Homes.
Another issue discussed by Council members was enforcing
refuse cleanups which is presently being done by the City,
the County, and the Health District. There was a consensus
to discuss it further with the County and the Health
District.
Mayor Berndt reported on the status of the preparations for
the upcoming joint City /County workshop. Council Member
Sims suggested the list of joint issues created
approximately a year and half ago should be looked at during
this workshop even though some of the issues have been
accomplished. He requested that this list be available
for review by Council members in order to determine whether

there are any changes to be made. Mayor Berndt suggested
March 30th as the date of the workshop.

13. ADJOURNMENT
It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO
ADJOURN THE MEETING. The motion carried by unanimous
voice vote; Barnett absent. The meeting was adjourned at
2:55 p.m.
