ROLL CALL The City Council met in session on this date at 2:00 p.m. in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council Members Clarence Barnett, Henry Beauchamp (present after 2:05 p.m.), Bill Brado, Lynn Buchanan, and Skip Semon (present after 2:13 p.m.) present on roll call. Council Member Bernard Sims absent and excused. City Manager Zais, City Attorney Vanek, City Clerk Roberts, and Deputy City Clerk Skovald also present. 2. INVOCATION /PLEDGE OF. ALLEGIANCE The Pledge of Allegiance was led by City Attorney Vanek. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER None 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY BUCHANAN, SECONDED BY BARNETT, THAT THE CONSENT AGENDA BE ADOPTED. The motion carried by unanimous roll call vote; Beauchamp, Semon, and Sims absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF THE MINUTES OF THE AUGUST 18 ADJOURNED AND BUSINESS MEETINGS, AUGUST 25 BUSINESS MEETING, SEPTEMBER 2 ADJOURNED MEETING, 8, 15, AND 22 BUSINESS MEETINGS, OCTOBER 21 ADJOURNED MEETING AND NOVEMBER 3 BUSINESS MEETING (Continued from November 17, 1992) AND AUGUST 13 ADJOURNED MEETING, SEPTEMBER 1 ADJOURNED AND BUSINESS MEETINGS, OCTOBER 6 SPECIAL MEETING, OCTOBER 13 BUSINESS MEETING, NOVEMBER 10 SPECIAL MEETING, AND NOVEMBER 17, 1992 BUSINESS MEETING The Council minutes of the August 18 Adjourned and Business Meetings, August 25 Business Meeting, September 2 Adjourned Meeting, September 8, 15, and 22 Business Meetings, October 21 Adjourned Meeting, November 3 Business Meeting, August 13 Adjourned Meeting, September 1 Adjourned and Business 33 NOVEMBER 24, 1992 Meetings, October 6 Special Meeting, October 13 Business I/ Meeting, November 10 Special Meeting, and November 17, 1992 Business Meeting were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION Louise Worden, 10121 Highway 410, Naches, requested street lights be installed in the vicinity of her apartment complex on North 8th Street / "D" Street. Ms. Worden also requested the alley adjacent to her property be closed to public traffic. She also complained of the crime in the area. Ralph Huck, 215 South 57th Avenue, suggested Council attempt to amend RCW 84.52.065, which would create an avenue for a property tax equalization program for additional revenue. Mr. Huck suggested this method rather than increase the City's In- Lieu -Of Tax. 7. PUBLIC HEARING ON RELEASE OF UTILITY EASEMENT REQUESTED BY TOM BERNDT Mayor Berndt clarified for the record that Mr. Tom Berndt is not related to her and she has never met him. This being the time set for public hearing, Bruce Benson, Associate Planner, explained a water line easement, issued to the City of Yakima in 1948, was no longer needed. Associate Planner Benson was also available to answer questions. Council Member Brado expressed concern about easements on adjacent property being utilized in the future. Mr. Benson explained this type of easement is specifically utilized for water only by the City, and there is no reason for any adjoining parcel to utilize this easement. Mayor Berndt opened the public hearing and asked . for anyone wishing to speak to this issue. Tom Berndt explained the purpose of this request is to eliminate any future lender or buyer concern. Because this portion of the easement is not needed and already built over, its release is requested. There being no one else wishing to speak to this issue, Mayor Berndt closed the public hearing. 2 34 NOVEMBER 24, 1992 Resolution No. D -6210 having been read by title, it was MOVED BY BUCHANAN, SECONDED BY SEMON, THAT THE RESOLUTION BE ADOPTED. The motion carried by unanimous roll call vote; Sims absent. RESOLUTION NO. D -6210, A RESOLUTION authorizing the City I/ Manager and the City Clerk of Yakima to execute a Quit Claim Deed to release an easement across property owned by Mr. & Mrs. Thomas J. Berndt. 8. PUBLIC HEARING ON PROPOSED 1993 BUDGET This being the time set for public hearing, Mayor Berndt explained the Council is still debating the Budget. There have been no decisions made and no items will be voted on until December 8, 1992. She asked if there were any questions. Mayor Berndt opened the public hearing and asked for anyone wishing to speak to this issue. Allen Schmid, President of the Greater Yakima Chamber of Commerce, was thankful for the opportunity to comment on the 1993 . Budget. He explained they have had, and will continue to have, meetings with Division and Department Heads in order to gain insight into the budgets of each sector of City government. The meetings have been informative, challenging, and open. Mr. Schmid expressed concern over today's meeting being the final date for public input on the proposed 1993 Budget. Since all divisions and departments have not presented their proposed budget overviews, he explained, it is difficult to comment when all the sources have not been submitted. Mr. Schmid urged Council to schedule another meeting for public comment before approving the final budget. Council Member Brado agreed and stated another opportunity for public input should be scheduled. City Manager Zais explained state law requires at least one hearing on the City Budget be held six weeks prior to the end of the year; however, additional public hearings can be held. It was the consensus of Council members to schedule an hour for public input on December 8, 1992, at 8 a.m. I/ Bill Mach, 1815 Ekelman Road, explained he was representing several "pumpers" in the area and commented on the proposed wastewater septage dumping rate increases. Increasing the rates would create hardships for many people. Council Member Beauchamp asked Mr. Mach if he had an estimated number of low income families served by the pumpers, and Mr. Mach stated he 3 35 NOVEMBER 24, 1992 did not. Council Member Brado stated the people who can least afford these services will be impacted. Dave Gutierrez, Roto- Rooter Septic Tank Service, announced there was an error in the Supplemental Budget Request. The amount of septage waste dumped by the industry was not correct. Their records indicate that the amount is only 2.3 %, instead of 7 %. Council Member Barnett commented that although the septage customers do not pay debt service on the facilities constructed for septage use, they pay,more than their fair share. Council Member Barnett suggested staff explain, in general terms, how the rate increase was determined, in order to develop an understanding between the City and the septage haulers. John Klingele, 1312 West Walnut, objected to the decrease in street sweeping operations in the City. He commented on water and septage rate increases, disagreeing with the methodology. City Manager Zais stated this subject has been deferred until the middle of 1993. Mr. Klingele agreed with the 3 -year step increase for septage waste charges. He stated it is very difficult for the public to see what benefit there is and what brought this about. There being no one else present wishing to speak to this issue, Mayor Berndt closed the public hearing. 9. PRESENTATION OF 1993 AGRICULTURAL SHOWCASE SPONSORSHIP PROPOSAL Ed Harrell, Director, Ki -Yak Showcase, thanked the Council for considering participation in the 1993 Agricultural Showcase as a sponsor. City of Yakima's sponsorship in last year's Showcase being very beneficial to its success, Mr. Harrell offered the City a sponsorship package for $8,000 cash and $7,000 in -kind services for a total of $15,000. After further discussion about the sponsorship, it was MOVED BY BARNETT, SECONDED BY BUCHANAN, TO ADD THIS AS A 1993 BUDGET POLICY ISSUE. The motion carried by unanimous voice vote; Sims absent. 10. REPORT FROM TRANSIT DIVISION REGARDING THE PAINTING OF TRANSIT BUSSES FOR ADVERTISING PURPOSES Bill Schultz, Transit Manager, explained the advertising concept proposed by Washington Transit Advertising to provide 4 36 NOVEMBER 24, 1992 advertising on and in transit busses. After discussion about the design of this proposed advertisement, the amount of revenue that would be generated, and other aspects of this concept, it was MOVED BY BARNETT, SECONDED BY BEAUCHAMP, TO DENY THE CONCEPT. The motion carried by unanimous voice vote; Sims absent. 11. CONSIDERATION OF RESOLUTION SETTING DATE OF PUBLIC HEARING BEFORE THE HEARING EXAMINER FOR DECEMBER 17, 1992, FOR VACATION OF A PORTION OF CHERRY AVENUE, BETWEEN NORTH 1ST AND 3RD AVENUES Mayor Berndt explained this was not put on Consent Agenda because Council Member Buchanan signed the petition and must be excused from discussion of this item due to potential conflict of interest. Council Member Buchanan temporarily absented himself from this discussion. Resolution No. D -6211, having been read by title, it was MOVED BY BARNETT, SECONDED BY BEAUCHAMP, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote; Buchanan and Sims absent. RESOLUTION NO. D •6211, A RESOLUTION fixing time for public hearing before the Hearing Examiner on December 17, 1992, on a petition to vacate a portion of Cherry Avenue between North 1st and 3rd Avenues. *12 CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH THE YAKIMA HERALD REPUBLIC FOR PRINTING AND DISTRIBUTION OF PARKS AND RECREATION WINTER /SPRING PROGRAM BROCHURE RESOLUTION NO. D •6212, A RESOLUTION authorizing execution of an agreement with the Yakima Herald - Republic for the publication of the City of Yakima Parks and Recreation Division Winter /Spring Brochure. *13 CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF RENTAL AGREEMENT FOR RESIDENCE AT RANDALL PARK WITH STEVE AND MARY GREGORY RESOLUTION NO. D - 6213, A RESOLUTION authorizing and directing I/ the City Manager and City Clerk of the City of Yakima to execute a Residential Rental Agreement with Steve and Mary Gregory. 5 37 NOVEMBER 24, 1992 *14 CONSIDERATION OF AN ORDINANCE AUTHORIZING THE IMPLEMENTATION OF A SECTION 125 SPENDING PLAN FOR VARIOUS NEW EMPLOYEE GROUPS ORDINANCE NO. 3500, AN ORDINANCE relating to personnel; authorizing the implementation of the Section 125 Spending Plan for various new employee groups; and amending Section 2.20.150 of the City of Yakima Municipal Code. 15. OTHER BUSINESS Don Skone, Planning Manager, reported on the neighborhood meeting regarding traffic problems in the vicinity of 24th Avenue and Nob Hill Boulevard. The residents are exploring a neighborhood solution and will bring their request to Council. City Manager Zais reviewed the tentative agenda for next week's meeting, since only four Council members will be in attendance. Information items: Items of information supplied to Council were: Notice of neighborhood meeting regarding Nob Hill Boulevard /24th Avenue traffic patterns. 11/17/92; and Inter - Office memo from Supervising Associate Planner and Supervising Traffic Engineer regarding November 9, 1992, Neighborhood meeting. 11/19/92; Auditor's Certificate of Special Election regarding Ban on Fireworks Proposition. 11/18/92; Agenda for the November 19, 1992 Yakima Air Terminal Board meeting and minutes of its October 29, 1992 meeting; Minutes of the October 8, 1992 Community Development Advisory Committee. 16. EXECUTIVE SESSION REGARDING PENDING AND PROSPECTIVE LITIGATION It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO MOVE INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PROSPECTIVE AND PENDING. LITIGATION, WITH ADJOURNMENT THEREAFTER TO DECEMBER 1, 1992, AT 9:00 AM FOR BUDGET REVIEW. The motion carried by unanimous voice vote; Sims absent. 6 NOVEMBER 24, 1992 17.
