CITY OF YAKIMA, WASHINGTON
APRIL 14, 1992
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in
the Council Chambers of City Hall, Yakima, Washington. Mayor
Pat Berndt, presiding, Councilmembers Henry Beauchamp
(present after 2:04 P.M.), Bill Brado, Lynn Buchanan, and
Skip Semon present on roll call. Councilmembers Clarence
Barnett and Bernard Sims absent and excused. City Manager
Zais, City Attorney Vanek, City Clerk Roberts and Clerk
Harris also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilmember Buchanan.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Referring to a memo furnished to Council by Jerry Copeland,
Director of Public Works, Councilmember Brado questioned the
$100,000 funding from the Water Division and possible future
impact of water rates on the Kissel Park project. City
Manager Zais and Ty Wick, Water and Irrigation Supervisor,
responded that various funding sources within the Water
Division capital budget and Public Works Trust Fund money
would be used. Councilmember Buchanan responded that for
future extensive planned development, additional funding
would also be needed.
City Manager Zais and Ron Johnson, President of IAFF Union,
reported on the progress of the negotiations on the disputes
over the Fire Department labor contracts. They both feel
these discussions and negotiations have been very successful
and have resulted in a tentative agreement. They commended
the efforts of the mediator, Fred Rosenberry, which has been
helpful to both parties. These negotiations will continue in
a couple of weeks.
Mayor Berndt proclaimed April 19 -25 as Sexual Assault
Awareness Week. The proclamation was accepted by Debbie
Ruggles. She thanked the City and the Council for their
support.
Mayor Berndt proclaimed April 20 -26 as Parliamentary Law
Week. The proclamation was accepted by John Klingele. He
thanked the Council and City and commented that Roberts Rules
of Order is used by 88% of organizations.
Councilmember Semon announced that on Wednesday evening, in
the Council Chambers, there would be a public meeting held by

the Community Program Advisory. concerning cable
television.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Councilmembers or citizens present.
Mayor Berndt made the Council aware that Item No. 15D was an
Off - Agenda Item, concerning the softball fence improvement
for Parks and Recreation. It was the consensus of the
Council to add Off- Agenda Item No. 15D and remove Item No. 5
from the Consent Agenda. The City Clerk then read the
Consent Agenda items, including resolutions and ordinances by
title. It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, THAT
THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried
by unanimous roll call vote. (Subsequent paragraphs preceded
by an asterisk ( *) indicate items on the Consent Agenda
handled under one motion without further discussion.)
5. APPROVAL OF THE MINUTES OF THE MARCH 10, 1992 ADJOURNED
MEETING AND MARCH 24, 1992 BUSINESS MEETING
Councilmember Brado commented that at the March 24, 1992
Business meeting, during Audience Participation, Council was
argumentive with the audience and he does not think this is
proper and asked the Council to refrain from it in the
future. Councilmember Buchanan stated he felt there were
points brought up by citizens in the audience that had to be
clarified.
It was MOVED BY BUCHANAN, SECONDED BY SEMON, TO APPROVE THE
MINUTES OF THE MARCH 10, 1992 ADJOURNED MEETING AND MARCH 24,
1992 BUSINESS MEETING. The motion carried by unanimous voice
vote.
6. AUDIENCE PARTICIPATION
Richard Andring, 203 S. 8th Avenue, stated he had watched
last week's meeting on TV and he wished to come before the
Council this week to voice his support for the Union Gospel
Mission and for the fine work of Roger Phillips. He stated
the sidewalk and street in front of the Mission are as clean
or cleaner than any in town.
7. REPORT FROM REFUSE DIVISION REGARDING 1992 BUDGET
MODIFICATION
Refuse and Recycling Manager Gaudette reported on the cost
reduction plan and implementation of the cost reduction plan
in the Refuse Division. She stated they have rearranged some
of the routes so that all of the refuse workers will be
working in the same general area of the City at the same
time. This will save time and money by not having to hire

additional workers. The work load will be equalized among
all the workers. Councilmember Beauchamp questioned why
personnel are being cut from the Refuse Division and not from
other departments. He feels the refuse rates are continually
raised and the amount of work for employees is increased,
while the number of employees is being decreased. City
Manager Zais explained that each year the departments are
asked to reduce their budgets to balance the total budget.
Councilmember Buchanan stated the City is going to have to go
to some type of automated refuse pickup, to remain
competitive, and because of the larger labor force needed
with the present system. The automated machinery is also
much easier on the workers and will result in less injuries
on the job. Councilmember Semon commented he feels the
Refuse Division is doing a good job in trying to meet the
Council's direction to work on a funding plan, other than
raising the refuse rates. It was explained that no one would
lose their job as a result of this cost reduction, but a
full -time vacant position would not be filled. It was MOVED
BY BRADO, SECONDED BY BUCHANAN, TO APPROVE THE COST
REDUCTIONS AND IMPLEMENTATIONS OF THE PILOT PROGRAM. The
motion carried by a 4 -1 voice vote; Beauchamp voting nay;
Barnett and Sims absent.
*8. CONSIDERATION OF RESOLUTION AUTHORIZING SUBMITTAL OF
APPLICATION FOR HOPE 3 PROGRAM
RESOLUTION NO. D -6094, A RESOLUTION authorizing and directing
the City Manager and the City of Yakima to file an
application with the Department of Housing and Urban
Development for funding for a Hope III Program.
*9. CONSIDERATION OF RESOLUTION SETTING BOND INTEREST ON HOUSING
BOND ISSUE
RESOLUTION NO. D -6095, A RESOLUTION of the Council of the
City of Yakima, Washington fixing the interest rate of the
City's Limited Tax General Obligation Bond, 1992 in the
principal amount of $400,000.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING AMENDMENT WITH YAKIMA
SCHOOL DISTRICT NO. 7 FOR AFTER SCHOOL PROGRAMS
RESOLUTION NO. D -6096, A RESOLUTION authorizing the
continuation of the agreement with Yakima School District #7
for an After School Program.

*11. CONSIDERATION OF JOINT RESOLUTION WITH YAKIMA COUNTY
ESTABLISHING PASSENGER FACILITY CHARGE PROGRAM
RESOLUTION NO. D -6097, A JOINT RESOLUTION of the City of
Yakima and Yakima County authorizing, ratifying, and adopting
Yakima Air Terminal Board Resolution 03 -92 -001 establishing
a Passenger Facility Charge Program at the Yakima Air
Terminal.
*12. CONSIDERATION OF RESOLUTIONS AUTHORIZING EXECUTION OF UTILITY
REIMBURSABLE AGREEMENTS WITH:
A. YAKIMA HOUSING AUTHORITY - SEWER
RESOLUTION NO. D -6098, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Yakima Housing Authority for the partial
reimbursement of construction cost for a sewer main
extension.
B. RICHARD SMITH - WATER
RESOLUTION NO. D -6099, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Richard C. Smith for the partial reimbursement
of construction cost for a water main extension.
C. DEAN BRINKLEY - SEWER
RESOLUTION NO. D -6100, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Dean Brinkley for the partial reimbursement of
construction cost for a sewer main extension.
D. AZIZ JURBRAN - SEWER
RESOLUTION NO. D -6101, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Aziz Jurbran for the partial reimbursement of
construction cost for a sewer main extension.
E. THOMAS A. SVENDSEN - SEWER
RESOLUTION NO. D -6102, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Thomas A. Svendsen for the partial
reimbursement of construction cost for a sewer main
extension.

F. PAUL MC COULLOCH - SEWER
RESOLUTION NO. D -6103, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Paul McCulloch for the partial reimbursement
of construction cost for a sewer main extension.
G. DOUG KELLER - SEWER
RESOLUTION NO. D -6104, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement with Doug Keller, Cliffacres Orchards, Inc. for the
partial reimbursement of construction cost for a sewer main
extension.
*13. APPROVAL OF REPORTS FROM DEPARTMENT OF FINANCE & BUDGET:
A. 1991 YEAR -END BUDGET REPORT
The 1991 Year -End Budget Report was accepted.
B. FOURTH QUARTER 1991 CENTRAL BILLING REPORT
The Fourth Quarter 1991 Central Billing Report was accepted.
*14. APPROVAL OF FINAL CONTRACT PAYMENTS FOR (STANDARD MOTION VB -
ACCEPT CONTRACT AND APPROVE FINAL PAYMENT):
A. 1990 LIGHTING IMPROVEMENT PROJECT
The report from the City Engineer dated March 20, 1992, with
respect to the completion of the work on the 1990 Lighting
Improvement Project, performed by Knobel's Electric, was
approved, the work accepted and payment of the final
estimates as therein set forth was authorized.
B. 56TH AVE /SUMMITVIEW & 32ND AVE /SUMMITVIEW PROJECT - AMENDED
The report from the City Engineer dated April 6, 1992 with
respect to the completion of the work on the 56th Avenue &
Summitview Avenue and 32nd Avenue & Summitview Avenue
Project, was approved, the work accepted and the amended
payment of the final estimates as therein set forth was
authorized.
*15. SECOND READING OF ORDINANCES AMENDING THE 1992 BUDGET AND
PROVIDING FUNDS FOR:
A. ARCHITECTURAL DESIGN SERVICES FOR LAW & JUSTICE FACILITY
An Ordinance amending the 1992 budget and appropriating funds

for the Law & Justice Facility architectural design services,
having been read by title only at the March 24, 1992 meeting,
was brought before the Council for a second reading.
ORDINANCE NO. 3447, AN ORDINANCE amending the 1992 budget for
the City of Yakima; and making an appropriation of $22,000 in
the General Fund for expenditure during 1992 for
architectural services for the proposed Law & Justice Center.
B. PROFESSIONAL SERVICES (HAAS UDAG)
An Ordinance amending the 1992 budget and appropriating funds
for the payment of legal services for the J. I. Haas Co. UDAG
grant, having been read by title only at the March 24, 1992
meeting, was brought before the Council for a second reading.
ORDINANCE NO. 3948, AN ORDINANCE amending the 1992 budget for
the City of Yakima; and creating the Economic Development
Fund #123; making an appropriation of $15,000 in the Fund for
expenditure during 1992 for professional services.
C. PURCHASE OF COMPUTER EQUIPMENT
An Ordinance amending the 1992 budget and appropriating funds
for a Computer Purchase Lease, having been read by title only
at the March 24, 1992 meeting, was brought before the Council
for a second reading.
ORDINANCE NO. 3449, AN ORDINANCE amending the 1992 budget for
the City of Yakima; and making an appropriation of $213,059
in the General Fund for expenditure during 1992 for a
Computer Purchase Lease.
D. PARKS & RECREATION SOFTBALL FENCE IMPROVEMENTS
An Ordinance amending the 1992 budget and appropriating funds
for softball fence improvements, having been read by title
only at the April 7, 1992 meeting, was brought before the
Council for a second reading.
ORDINANCE NO. 3450, AN ORDINANCE amending the 1992 budget for
the City of Yakima; and making an appropriation of $10,200 in
the Parks & Recreation Fund for expenditure during 1992 for
softball fence improvements.
16. CONSIDERATION OF ORDINANCE INITIATING CONDEMNATION
PROCEEDINGS FOR ACQUISITION OF PROPERTY AT SOUTH 4TH STREET,
BETWEEN CHESTNUT AND WALNUT STREET
Councilmember Brado asked for clarification on the
condemnation proceedings which he received from staff.
Mr. Brado stated he supports the transit center but thinks

the location is a poor one because of the lack of parking in
the area. He also feels this project will deplete the
Transit budget. Councilmember Semon asked if landowners
would gain a tax benefit from the property being taken by
condemnation, rather than a normal sales. City Attorney
Vanek stated he believes this is a fact, but did not have
specific information on it.
Richard Andring, 203 S. 8th Avenue, expressed his concern for
the parking spaces being lost and also the loss of low income
housing on these properties. He also questioned the lack of
a plan for restrooms in the facility. He was told by Council
and staff that parking would be replaced and there would be
restrooms and a break room for the Transit drivers.
Mr. Andring does not agree with a need for this facility.
Ordinance No. 3451 having been read by title, it was MOVED BY
BUCHANAN, SECONDED BY SEMON, TO APPROVE THE ORDINANCE. The
motion carried by 4 -1 roll call vote; Brado voting nay;
Barnett and Sims absent.
ORDINANCE NO. 3451, AN ORDINANCE authorizing and directing
the law firm of Lyon, Beaulaurier, Weigand, Suko & Gustafson
to institute and prosecute legal proceedings for the
condemnation and acquisition of real property for the
Downtown Transit Transfer Facility to be located between East
Chestnut Avenue and East Walnut Street and between South 4th
Street and South Naches Avenue and for public facilities
related thereto; providing for the condemnation and taking of
such real property and declaring the condemnation and taking
thereof to be necessary for a public use required by the
public interests; directing that compensation for such taking
be paid from fund number 364 - Transit Capital Reserve Fund
of the City of Yakima.

OF PROPERTY AND COLLECTIVE BARGAINING, WITH IMMEDIATE
ADJOURNMENT THEREAFTER TO MARCH 21, 1992 AT 7:00 A.M. AT THE
YAKIMA CENTER. The motion carried by'unanimous voice vote;
Barnett and Sims absent.
