ITEM TITLE: Resolution authorizing an Extension of an Interlocal Agreement with the City of Selah for the provision of Yakima Transit fixed -route and paratransit services within the City of Selah SUBMITTED BY: Chris Waarvick, Public Works Director, 576 -6411 Ken Mehin, Transit Manager, 576 -6415 CONTACT Ken Mehin, Transit Manager, 576 -6415 PERSON /TELEPHONE: SUMMARY EXPLANATION: On December 12, 2008, the City of Yakima entered into an Interlocal Agreement with the City of Selah to extend Yakima Transit's fixed -route and paratransit services into the City of Selah. (R- 2008 -176) The agreement contained the full agreement between the parties. Since the inception of the agreement, it has been agreed between the Cities of Selah and Yakima to extend service an additional year and expand routes to other areas of Selah that were not previously serviced. Selah also added half -hour fixed -route service to that route. The route expansion and half -hour service were added March 1, 2010. Grant funded limited Sunday fixed -route service started April 2011. The service is anticipated to operate through the end of March 2013. Selah is participating in this grant. The attached Extension continues the current agreement between the parties through the end of 2012. This is the last extension allowed under the existing contract. No Funding Selah Transit Sales Tax & Yakima Transit Sales Phone: Source: Tax APPROVED FOR *#, SUBMITTAL: City Manager STAFF RECOMMENDATION: Staff respectfully requests City Council to adopt the Resolution authorizing and directing the City Manager of the City of Yakima to execute an "AMENDMENT 2011 -2 TO CITY OF YAKIMA - CITY OF SELAH INTERLOCAL TRANSPORTATION AGREEMENT" between the City of Yakima and the City of Selah, substantially conforming to the attached amendment agreement. BOARD /COMMISSION RECOMMENDATION: The City Council Transit Committee is aware of the contract extension. Yakima Transit has the support of the Council Transit Committee members for continuation of this service. R -2012- A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute an Extension of an Interlocal Agreement with the City of Selah for the provision of fixed -route bus and paratransit services within the borders of the City of Selah. WHEREAS, the City of Yakima has developed and operates a public mass transportation system and, pursuant to the provisions of RCW 39.33.050 and RCW 39.34.085, has the authority to contract with any other municipal corporation or political subdivision of the state for public mass transportation services; and WHEREAS, the City of Selah has not developed and does not own or operate a public mass transportation system, but has contracted with the City of Yakima for provision of such services through Yakima Transit; and WHEREAS, Revised Code of Washington Ch. 39.34, entitled "Interlocal Cooperation Act," permits local governmental units to make the most efficient use of their powers by enabling them to cooperate with other municipalities on the basis of mutual advantage; and WHEREAS, regionalizing common public services is a top strategic direction priority of the Yakima City Council and through cooperative agreements such as this Interlocal Agreement, partnerships and other collaborative arrangements, the City of Yakima is committed to discovering and developing innovative ways to deliver critical public services to its residents and to its neighbors. WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to authorize an extension of the existing transit Interlocal Agreement with the City of Selah for an additional year from the date the previous extension ends and modifying the cost to provide service to the City of Selah, which also allows for a fee reduction to take into consideration grants obtained by Yakima Transit on behalf of the City of Selah, to offer the citizens of the City of Yakima and the City of Selah the fullest opportunity for access to mass transportation and to reduce congestion and pollutions on those cities roadways, NOW, THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute an "AMENDMENT 2011 -2 TO CITY OF YAKIMA -CITY OF SELAH INTERLOCAL TRANSPORTATION AGREEMENT" BETWEEN THE City of Yakima and the City of Selah, which amendment substantially conforms to the amendment agreement attached hereto and incorporated herein by this reference. Micah Cawley, Mayor ATTEST: City Clerk AMENDMENT 2011 -2 TO CITY OF YAKIMA — CITY OF SELAH INTERLOCAL TRANSPORTATION AGREEMENT The Interlocal Transportation Agreement between the City of Yakima, a municipal corporation of the State of Washington (hereinafter referred to as Yakima), and the City of Selah, a municipal corporation of the State of Washington (hereinafter referred to as Selah) that became effective on January 1, 2011, and was set to expire on December 31, 2011, is amended as follows: Amending Section 6.2 of the initial Agreement to extend the Agreement for one additional year, from an effective date of January 1, 2012 through December 31, 2012 as follows: 6.2 Term. The Term of this Agreement shall be January 1, 2012 to December 31, 2012. This is the final extension available under the initial terms of the contract. This Agreement may be terminated early because the funding source (sales tax revenue) drops to a level that makes continuation of the Agreement not feasible. Either party wishing to cancel this Agreement prior to the end of the Term shall provide at least one hundred twenty (120) days prior written notice of such cancellation in order to comply with Federal transit regulations concerning service discontinuation. Replacing Appendix B with the attached amended Appendix B to modify the cost to provide service to the City of Selah as previously agreed by the parties and to continue a fee reduction of said service costs to take into consideration grants obtained by the City of Yakima (Job Access and Reverse Commute Grant for extended hours service & Congestion Mitigation and Air Quality Grant for fixed -route service on Sundays) for the City of Yakima and on behalf of the City of Selah, all in accord with the provisions of Section 6.4. Except to the extent expressly set forth in this amendment, all other terms, conditions and provisions of the underlying Transportation Agreement that became effective on January 1, 2009, and as modified in the 2011 contract extension and amendments, shall remain in full force and effect.
