3. Open Discussion for the Good of the Order
A. Proclamations
• Harvest Marching Band Festival
Mayor Cavvley read a proclamation declaring October 15, 2011 as Harvest
Marching E3and Festival Day. Forrest Fisher accepted the proclamation and
stated this will be their biggest event to date with 22 bands participating,
which is almost double in size from the previous year.
> Domestic Violence Awareness Month
Assistant Mayor Coffey read a proclamation declaring the month of October
2011 as Domestic Violence Awareness Month. Erin Black accepted and
thanked the City Council for the proclamation. Council Member Edler
reported that statistically, those most in danger in a domestic violence setting
are women and thanked the YMCA for their involvement.
B. Presentations /recognitions /introductions
➢ Recognition of service awards for City employees
Mayor Cawley recognized Ted Cantrell, Industrial Maintenance Mechanic, for
20 years of service to the City.

➢ Presentation by Sgt. Boyle regarding Washington Traffic Safety Commission
Designation. Sgt. Boyle explained the Washington Traffic Safety
Commission would like to utilize over $600,000 to designate 1st Street from
1 -82 to Highway 97 and on Nob Hill Blvd from K -mart to 64 Avenue as
"Traffic Safety Corridors." This amount would fund some signage, emphasis
patrols, and education campaigns —all aimed at reducing accidents on the
two roadways, which is approximately 12 miles. CAWLEY MOVED AND
ADKISON SECONDED TO SUPPORT THE PROJECT. The motion carried
by a 6 -0 voice vote; Ettl absent.
C. Status reports on prior meeting's citizen service requests
➢ City Manager Cooper explained two options that were included in his report
in an effort to resolve the screening problems at the Doty development. The
City can either replant the shrubbery and irrigate or do nothing and move on.
Citizen Jim Evans spoke in favor of the City replanting and irrigating the
property. Council Member Ensey added he feels it was a bad agreement
initially and if they walk away it would be abandoning the situation. ENSEY
MOVED AND ADKISON SECONDED TO PLANT THE BUSHES AND KEEP
• THEM WATERED. The motion failed 3 -3; Coffey, Edler and Lover voting no;
Ettl absent.
D. Appointments to Boards, Commissions and Council Committees
4. Consent Agenda
Mayor Cawley referred to the items placed on the Consent Agenda, questioning whether
there were any additions or deletions from either Council members or citizens present.
There were not changes. The City Clerk read the Consent Agenda items, including
resolutions and ordinances by title. COFFEY MOVED AND ADKISON SECONDED TO
ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call
vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent
Agenda handled under one motion without further discussion.)

The minutes of the August 16, 2011 and September 20, 2011 Business meetings and
September 22, 2011 Adjourned meeting were approved, having been duly certified
accurate by two Council members and no one present wishing to have said minutes
read publicly.

5. Audience Participation
Robert Owen, 614 N. 3 Street, stated he is against universal recycling and believes it is
about the City making money.
Jim Evans, 4405 Sumrnitview, expressed his strong disagreement with the Council's
decision not to take any action on the problems at the Doty development that he feels the
City caused.
Bernie Sims and Don Hinman spoke in favor of a proposition, which would change
Yakima County's current government structure to a Home Rule structure.
Candie Turner, 7800 W. Mead Avenue, again addressed the issue of people dumping
garbage at various recycling centers and asked Council to increase fines for those
violating the code.
7:00 P.M. — PUBLIC HEARINGS
6. Public meeting to consider a Resolution authorizing approval of the final plat for
Malibu Subdivision
Supervising Planner Bruce Benson briefed the council on the Malibu Subdivision. Mayor
Cawley opened and closed the public meeting as no one came forward to speak.
Council Member Edler recused himself from voting as he is related to one of the
property owners.

SECONDED TO ADOPT THE RESOLUTION. The motion carried by 5 -0 roll call vote;
Edler abstained; Ettl absent.
RESOLUTION NO. R -2011 -149, A RESOLUTION approving the final plat of Malibu
Subdivision and authorizing the Mayor to sign the final plat
7. Public hearing to consider a Resolution amending the Six -year Transportation
Improvement Program (STIP)
City Engineer Doug Mayo explained the proposed amendment is to place the Yakima
Railroad Grade Separation — Phase 2 project back on the STIP (removed when the
project began) so additional federal funds could be used for construction of the Lincoln
Avenue underpass. Mayor Cawley opened and closed the public hearing as no one
came forward to speak.
The City Clerk read the Resolution by title only; ADKISON MOVED AND EDLER
SECONDED TO ADOPT THE RESOLUTION. The motion carried by 6 -0 roll call vote;
Ettl absent.
RESOLUTION NO. R-2011 -150, A RESOLUTION to amend the Six -year Transportation
Improvement Program (TIP) for the period of 2011 through 2016 to include projects
affecting the City's Transportation Plan.

Supervising Planner Bruce Benson briefed the Council on the eight Comprehensive Plan
Amendments. Mayor Cawley opened and closed the public hearing as no one came

ORDINANCE NO. 2011 -46, AN ORDINANCE concerning comprehensive planning
and amending Chapter VIII - Utilities of the City of Yakima's Urban Area
Comprehensive Plan 2025.
CITY MANAGER REPORTS
9. Resolution authorizing execution of an agreement with Magallan Consultancy for
planning and coordination services related to Gang Free Initiative
Assistant City Manager Morales.briefed Council on the provisions of the proposed
agreement. Extensive discussion ensued on suppression, prevention and intervention.
Mayor Cawley indicated that the Council Public Safety Committee recommends approval
of this agreement. Council Member Edler indicated some frustration with the Council
Committee structure as items are vetted by committee and not by the full Council. He
also questioned who should be providing these services and are we duplicating services
with the County. Council Member Adkison and Assistant Mayor Coffey briefed the
Council on the Gang Free Initiative Executive Committee's work, which has put the City in
a positive place to raise funds to help address all three issues -- suppression, intervention
and prevention. Council Member Lover indicated he would like to see a more transparent
process and understands the frustration of the Council Committee structure and
suggested having YPAC tape the Executive Committee meetings. Assistant Mayor
Coffey explained the Committee meetings were not taped at the beginning because some
of the items discussed needed confidentiality.

RESOLUTION NO. R -2011 -151, A RESOLUTION authorizing The City Manager of the
City of Yakima to execute a contract with MagaIlan Consultancy for coordination and
planning services related to the Yakima Gang Free Initiative, final form of the contract to
be approved by the City Attorney.

LOVER MOVED ENSEY SECONDED TO PUT THE GFI STEERING COMMITTEE ON
YPAC. The motion died 3 -3. Edler, Adkison and Coffey voting no; Ettl absent.
10. Resolution authorizing execution of an interlocal agreement for the Regional Fire
Authority financial study
Fire Chief Willson gave an update on the ongoing process to study a Regional Fire
Authority, which Council approved nine months ago. The group involved in this project
recommends hiring a consultant to analyze whether to continue the study or not. He
outlined the next steps if the consultant recommends continuing the project and explained
the funding breakdown by each participating entity. Council Member Lover stated he
believes in these fiscal times we need to accept more responsibility and the fire districts
and cities involved are capable of doing the financial analysis. Council Member Ensey
feels a decision has already been made. Council Member Adkison noted she would not
be comfortable going forward without this study as no one on the committee has all the
tools to make that decision.

RESOLUTION NO. R -2011 -152, A RESOLUTION Authorizing the Yakima City Manager
to execute an Interlocal agreement with Yakima County Fire District 11 in the amount of
$12,374.00

develop the environmental documentation for the 64 Avenue roadway widening
project and authorizes the City Manager to execute other contracts and
agreements required for this project •
RESOLUTION NO. R- 2011 -153, A RESOLUTION authorizing the City Manager to
execute a Professional Services Agreement with Widener and Associates, in an amount
not to exceed $9,853, to develop the environmental documentation for the 64 Avenue
Roadway Widening project. This resolution also authorizes the City Manager to execute
other contracts and agreements required for this project.
*12. Resolution authorizing execution of an agreement with Golder Associates, Inc. for
the preliminary hydro- technical assessment services for the Water Treatment
Plant intake project
RESOLUTION NO. R- 2011 -154, A RESOLUTION authorizing the City Manager to
execute the attached and incorporated engineering and consulting services agreement
with Golder Associates, Inc. for engineering and consulting services associated with the
Water Treatment Plant Intake Project.

*13. Second reading of an Ordinance amending the 2011 Budget and making
appropriations in various funds to provide for increased costs of fuel, jail
contracts, street maintenance supplies, street -light electric power, unexpected
retirement cash outs, along with new grant awards
ORDINANCE NO. 2011 -47, AN ORDINANCE amending the 2011 budget for the City of
Yakima; and making appropriations from Unappropriated Fund Balances within various
Funds for expenditure during 2011 to provide for increased costs of fuel, jail contracts,
street maintenance supplies, street light electric power, unexpected retirement cash -
outs, along with new grant awards.

project costs; and to replace a damaged Refuse truck. Read Ordinance by title only,
no action required; second reading scheduled for October 18, 2011)

individuals from city parks when there is probable cause to believe a person has
committed a crime or infraction while in a city park and providing the opportunity
to appeal the decision to exclude

amending Chapter 13.16 of the City of Yakima Municipal Code by adding a new section
13.16.160 authorizing Yakima Police officers and the Parks and Recreation Manager to
exclude individuals from city parks when there is probable cause to believe a person has
committed a crime or infraction while in a city park and providing the opportunity to
appeal the decision to exclude.
16. Other Business
• EDLER MOVED ENSEY SECONDED TO CANCEL THE STUDY SESSION
SCHEDULED ON UNIVERSAL RECYCLING. The motion carried by 6 -0 voice vote;
Ettl absent. Council Member Edler explained he felt he was a lone proponent and

has found a willing partner in the Yakima County Commissioners. They will discuss
this as a county -wide issue.
• Council Member E:dler questioned what was being done to address the recent
shootings in the city. City Manager Cooper answered he has requested greater
police emphasis patrols and suppression. His goal is to see more officers on the
streets and patrol cars around the city.
• Council Member Edler asked for the current status on street maintenance. City
Manager Cooper stated Council needs to set a level of service they want to achieve
and he will offer options to fund it. These issues will be discussed at the upcoming
budget workshop.
