CITY OF YAKIMA, WASHINGTON
AUGUST 18, 1992
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m. in
the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members Clarence Barnett
(absent after 5:00 p.m.), Henry Beauchamp, Bill Brado,
Lynn Buchanan, and Skip Semon present on roll call. Council
Members Bernard Sims absent and excused. City Manager Zais,
City Attorney Vanek, City Clerk Roberts and Deputy City
Clerk Skovald also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Invocation was given by Council Member Beauchamp.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Robert Wheeler, Finance and Budget Accounting Manager,
announced the Certification of Excellence Award received from
the Municipal Treasurer's Association of the United States
and Canada on the City's investment policy.
A provision in the Sign Code regarding placement of political
yard signs in the rights -of -way was discussed. Staff was
directed to bring the Sign Code to Council for review.
The Council expressed concern regarding the issue of spending
money on architectural services for lighting at the tennis
courts at Larson Park. John Marsh explained the existing
system is obsolete and dangerous. Dave Flaherty will
reevaluate this issue and update the Council.
4. CONSENT AGENDA
Mayor Berndt referred to the items place on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
Mayor Berndt stated that Items 11 and 12 were removed from
the Agenda. The City Clerk then read the Consent Agenda
items, including resolutions and ordinances by title. It was
MOVED BY SEMON, SECONDED BY BUCHANAN, THAT THE CONSENT
AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous
roll call vote; Sims absent. (Subsequent paragraphs preceded
by an asterisk ( *) indicate items on the Consent Agenda
handled under one motion without further discussion.)

5. PUBLIC HEARING ON NORTHACRES ANNEXATION
I/ This being .the time set for public hearing, Bruce Benson,
Associate Planner, explained this annexation and was
available to answer questions.
Council Member Brado commented on the additional $21,000 that
will be necessary to take care of this area and verified
82 percent of the owners have signed the petition.
Mayor Berndt opened the public hearing and asked for anyone
wishing to speak. There being no one present to speak to the
issue, the public hearing was closed.
Ordinance No. 3483, having been read by title, it was MOVED
BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT THE ORDINANCE.
The motion carried by unanimous roll call vote; Sims absent.
ORDINANCE NO. 3483, AN ORDINANCE annexing property to the
City of Yakima and zoning said property.
6. PUBLIC MEETING TO CONSIDER HEARING EXAMINER RECOMMENDATION ON
KKR DEVELOPMENT /RON MASTER APPLICATION FOR PROPERTY IN
VICINITY OF SOUTH WASHINGTON AVENUE AND 15TH AVENUE
This being the time 'set for :public meeting, Dan Valoff,
Associate Planner, explained this was an application to
rezone property from R -1 to R -2, a proposed 20 -lot
subdivision to be platted in three phases, a planned
residential development, and an administrative adjustment to
lot coverage.
After further discussion, all Council members declared no
exparte contact. Mayor Berndt opened the public meeting and
asked for anyone wishing to speak in favor of the proposal.
Bill Huibregtse, 501 North 2nd Street, explained the proposed
three- phased plat. He commented about the city requirements
of approval and compared the Vision 2010 statement, January
I/ 1992, with this proposed development.
Ron Knight, representing KKR Development, presented
information regarding the need for this type of housing in
the community, other similar mixed uses of housing in the
community, and also his observations regarding traffic, since
this has been one of the concerns of some of the neighboring
residents throughout the process.

There being no one else present wishing to speak in favor of
the proposal, Mayor Berndt asked for anyone wishing to speak
in opposition.
John Ditzler, 1615 South 14th Avenue, who lives very close to
the subject property, requested the Council send this
proposal back to the hearing examiner. He didn't feel the
hearing examiner adequately addressed the neighborhood
concerns about the increased density in traffic on a road
that is already overburdened.
Bill Campbell, 1206 Spokane Avenue, who bought his new house
two" years ago, urged the Council to make this property single
family residential due to the traffic conditions that will be
created. Mr. Campbell also suggested that a provision for
play areas be incorporated into this proposed development.
He suggested the meeting be postponed for at least 30 days so
their group could be better represented.
Richard McClusky, 1611 South 14th Avenue, expressed his
concern about the amount of traffic that will be generated by
this development and will make it unsafe.
Ron Washburn, 1306 Spokane Street, questioned whether there
were 26 or 20 duplexes planned for this development. There
had been conflicting reports. Mr. Washburn complained about
the increased number of people, the increased amount of
traffic, and overcrowding the schools.
Tom Bridges, 1702 South 15th Avenue, complained about the
tremendous increase in the amount of traffic on 13th, 14th,
and 15th Avenues intersecting with West Pierce Street. The
high rate of speed the automobiles travel is dangerous.
Mr. Bridges suggested the intersections be controlled.
Harold Gordon, 1616 South 15th Avenue, complained about the
property being at the end of the runway and the possibility
of a low- flying airplane crashing. Mr. Gordon also expressed
a desire for more sidewalks in this area.
Steve Woody, 1308 Perry Court, explained how the parking
situation to be created by this development will affect him.
Most of the parking will be off - street parking. Mr. Woody
suggested cul -de -sacs to prevent a potential problem with
parking.
David Ramirez, 1208 Spokane Street, explained that most of
the people who live in this area look out for each other and

there is a sense of community. He is afraid this will be

lost because most people, who will be living in the proposed
duplexes, will not stay in the area long enough to become
acquainted. Mr. Ramirez expressed concern that crime will
increase.
Betty Stoltie, 1622 South 15th Avenue, was also very
concerned about traffic congestion, speeding, and other
problems that could be created.
Mary Ann Ramierez, 1208 Spokane Street, stated she thought
the area should be kept R -1 zoning, and stated her concern
about the potential traffic problems.
Mayor Berndt asked for any rebuttals or closing statements
from the proponents.
Ron Knight explained that there are some residents living
near the proposed development who are in favor of it. He
submitted photographs of the parking area to Council, and
stated his company would be paving the half - street.
Mr. Knight stated that the traffic is not as busy as those
opposing this project have claimed.
Bill Huibregste answered the Council's questions about
traffic density by Specifying =how the traffic would be
dispersed, and what percentage of the traffic will travel
what street. He also explained the three phases of this
proposed development.
Harold Gordon, 1616 South 15th Avenue, stated that upon the
completion of the last phase of the apartment complex, if
approved 15th Avenue will turn out onto a gravel road
located at the west end of the trailer park.
Mayor Berndt closed the public meeting and asked for Council
discussion. Following legal explanation from City
Attorney Vanek and further discussion among council members,
it was MOVED BY BARNETT TO REMAND TO.THE HEARING EXAMINER TO
I/ REVIEW THE TRAFFIC FLOW ON PIERCE TO DETERMINE WHETHER THE
TRAFFIC CONCERNS CAN BE MITIGATED. The motion died for a
lack of a second. It was MOVED BY BEAUCHAMP, SECONDED BY
BUCHANAN, TO TABLE THIS ITEM FOR TWO WEEKS (SEPTEMBER 1).
The motion carried by unanimous voice vote; Sims absent.

7. PUBLIC MEETING TO CONSIDER THE PRELIMINARY LONG PLAT APPROVAL
FOR CEDAR HILLS SUBDIVISION IN VICINITY OF SO. 18TH AVENUE,
BETWEEN KING AND TAHOMA AVENUE
This being the time set for the public meeting, Bruce Benson,
Associate Planner, explained the proposed preliminary long
plat application, recommended its approval, and was available
for questions.
Mayor Berndt opened the public meeting and asked for anyone
present wishing to speak in favor of the project.
Vern Holbrook, developer, explained that during the course of
meetings and conversations about this development, there has
been negotiation with the neighborhood. Compatibility is the
reason why. Mr. Holbrook stated they were ready to move
forward with this project, if approved, as soon as possible.
Gary Beeman, 1614 West King Street, stated he appreciated the
developer's willingness to work with the neighborhood.
However, he expressed concern about future owners of the lots
building two -story units instead of only one -story units.
There being no one else present to speak to the issue,
Mayor Berndt closed the public meeting. It was MOVED BY
BRADO, SECONDED BY BUCHANAN, TO APPROVE THE PLAT. The motion
carried by unanimous voice vote; Sims absent.
8. AUDIENCE PARTICIPATION
None
9. REPORT FROM LEGAL DEPARTMENT REGARDING CLEANUP REMEDIES UNDER
WASHINGTON STATE MODEL TOXICS CONTROL ACT
City Attorney Vanek outlined the report which included a
general overview of the law and remedies available for the
environmental cleanup in the Yakima railroad area. There
will be a $4.5 million grant from DOE for a water system in
the railroad area.
Ray Paolella, Assistant City Attorney, spoke briefly about
the stage of remediation that the railroad area project is
currently at and answered questions from Council.

*10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH STATE DEPARTMENT OF TRANSPORTATION FOR
I/ FINANCIAL ASSISTANCE TO CONDUCT REQUIRED FINANCIAL PLANNING
RESOLUTION NO. D -6172, A RESOLUTION authorizing the City
Manager and the City. Clerk of the City of Yakima to execute
an agreement with the Washington State Department of
Transportation for financial assistance.
11. CONSIDERATION OF RESOLUTION AUTHORIZING ENGAGEMENT OF
PROFESSIONAL ARCHITECTUAL SERVICES FOR TENNIS COURT LIGHTING
IMPROVEMENTS AT LARSON PARK
This item was removed from the agenda.
12. APPROVAL OF AMENDMENT TO 1992 AIR TERMINAL BUDGET
This item was removed from the agenda.
13. CONSIDERATION OF ORDINANCE AMENDING THE BUILDING PERMIT FEE
SCHEDULE TO INCLUDE RADON DETECTOR FEE (REQUIRES MOTION TO
REMOVE FROM TABLE PRIOR TO DISCUSSION)
It was MOVED BY BEAUCHAMP, SECONDED BY BUCHANAN, TO REMOVE
THE ITEM FROM THE TABLE. The motion carried by unanimous
voice vote; Sims absent.
Ordinance No. 3484, having been 'read by title, it was MOVED
BY BARNETT, SECONDED BY BEAUCHAMP, TO ADOPT THE ORDINANCE.
The motion failed by 3 -3 roll call vote; Brado, Buchanan, and
Semon voting nay; Sims absent. It was MOVED BY BARNETT,
SECONDED BY BRADO, TO AMEND THE ORDINANCE TO REFLECT THE CITY
TO ABSORB THE FEE. The motion failed by 2 -4 voice vote;
Barnett and Brado voting aye; Sims absent. It was MOVED BY
BARNETT, SECONDED BY BRADO, TO TABLE. The motion failed by
2 -4 voice vote; Buchanan and Brado voting aye; Sims absent.
It was MOVED BY BEAUCHAMP, SECONDED BY SEMON, TO BRING BACK
LEGISLATION AND TO ASSESS AN $8 FEE. The motion failed by
3 -3 voice vote; Beauchamp, Berndt, and Semon voting aye; Sims
absent. It was MOVED BY BARNETT, SECONDED BY BRADO TO TABLE.
The motion failed by 2 -4 voice vote; Barnett and Brado voting
I/ aye; Sims absent. (Council Member Barnett absent after
5:00 p.m.) It was MOVED BY BUCHANAN, SECONDED BY SEMON TO
SET A PRICE OF $10 AND BRING LEGISLATION BACK. The motion
failed by 3 -2 voice vote; Buchanan and Semon voting aye;
Barnett and Sims absent. It was MOVED BY BUCHANAN, SECONDED
BY SEMON, TO AMEND THE ORDINANCE TO REFLECT A $10 FEE FOR
EACH RADON KIT. The motion carried by 3 -2 roll call vote;
Brado and Beauchamp voting nay; Barnett and Sims absent.

ORDINANCE NO. 3484, AN ORDINANCE related to buildings;
increasing building permit fees for certain structures; and
amending Section 11.04.028 of the City of Yakima Municipal
Code.
14. OTHER BUSINESS

It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADJOURN
TO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PROPERTY
ACQUISITION AND PENDING LITIGATION, WITH IMMEDIATE
ADJOURNMENT THEREAFTER. The motion carried by unanimous
voice vote; Barnett and Sims absent.
16. ADJOURNMENT
Following completion of the Executive Session, the meeting
was adjourned at 5:40 p.m.
