CITY OF YAKIMA, WASHINGTON
JUNE 9, 1992
SPECIAL MEETING WITH YAKIMA COUNTY AND UNION GAP
The City Council met in session on this date at 1:30 P.M., in a
Special Meeting with Yakima County and Union Gap representatives
to discuss a remedial action grant for water supply to the Yakima
Railroad Area. City of Yakima Council Members present were Mayor
Pat Berndt, Clarence Barnett, Henry Beauchamp, Bill Brado, Skip
Semon and Bernard Sims. Council Member Lynn Buchanan absent and
excused. City of Yakima staff members present were City Manager
Zais, City Attorney Vanek, Dennis Covell, Director of Engineering
and Utilities, and City Clerk Roberts. Representatives from Yakima
County were Commissioners Alex Deccio, Chuck Klarich and Bettie
Ingham, and Terry Austin and Larry Peterson from the Prosecuting
Attorneys' Office. Mayor Ron Krebs, City Supervisor Paul
Burlingame and attorney, Dorothy Brodrick were present from Union
Gap. Department of Ecology representatives present were Pat
Spurgin, Bob Swackhamer, Tony Grove, and Alex Gonzales.
1. CONSIDERATION OF RESOLUTION AUTHORIZING SUBMITTAL OF GRANT
REQUEST BETWEEN CITY OF YAKIMA, YAKIMA COUNTY AND UNION GAP
FOR A REMEDIAL ACTION GRANT TO DOE FOR WATER SUPPLY TO YAKIMA
RAILROAD AREA
Mayor Berndt excused Council Member Sims from this discussion
due to possible conflict of interest.
City Attorney Vanek read the resolution before the three
legislative bodies, in its entirety. Pat Spurgin commented
that the Department of Ecology's (DOE) main goal is to work
out a means for interim action per the joint resolution. DOE
has been encouraged by the interest in the various local
governments to join in an agreement that would lead to the
extension of water to areas that are not currently serviced.
We have been working on a change to the rules that are
applicable to remedial action grants because prior to this,
they were only available to potential liable parties. DOE's
goal is to be a part of the remediation. Mayor Berndt agreed
with those sentiments. Mayor Berndt noted that the City of
Yakima and Yakima County have a quorum present to vote on the
resolution and inquired if Union Gap has voted on this
resolution. Mayor Krebs responded that the Council previously
authorized him to sign the resolution.
It was MOVED BY KLARICH, SECONDED BY INGHAM, TO ADOPT THE
JOINT RESOLUTION APPLYING FOR FUNDS FOR CLEAN -UP OF GROUND
WATER AND HOOK -UPS; Deccio concurred, and the motion passed.
It was MOVED BY BARNETT, SECONDED BY SEMON, TO ADOPT THE
RESOLUTION. The motion passed by unanimous roll call vote;
Sims not voting due to possible conflict of interest; Buchanan
absent.

SPECIAL MEETING
The resolution was circulated for signatures. Mr. Covell
commented on the cost estimate and the grant request. He
stated that DOE is estimating a one -month turn around on this
grant request. Staff would attempt to have the design work
done by spring of 1993 and have the work done by this time
next year, if not sooner. It should all be done by 1995. For
the benefit of the television audience, Mr. Covell outlined
the Yakima Railroad area on the map.
County Commissioners discussed the bottled water program to
citizens in the affected area, which may cease to individuals
who have access to City water. Commissioner Klarich asked if
DOE would object to a letter being sent to people who could
hook up. Mr. Spurgin stated he has some hesitancy with that
because there is an enforcement order that pertains to bottled
water and that would affect a lot of potential liable parties.
Tony Grove, Section Manager for Toxic Program Clean -Up, stated
there may be a water main in front of a house, but no hook -up
and when the funds become available through the grant program
we would offer to do the connecting for those people. Then
they will have a choice and if they deny the hook -up, then
they have been given every opportunity and he sees no reason
to continue the bottled water. Commissioner Klarich commented
that we won't know if we are subsidizing some wealthy
landlord. Mr. Grove stated that has been a concern, and the
local governments could work with DOE to address that issue.
Commissioner Deccio stated that would be an appropriate
subject before the District Health Board. Mayor Berndt stated
a similar joint venture was entered into for the
Fairview /Sumac area and she is sure we can solve this issue.
RESOLUTION NO. D -6128, A RESOLUTION by the Yakima County
Commissioners, the City Council of Union Gap, and the City
Council of the City of Yakima authorizing joint submittal of
an application to the Department of Ecology for a remedial
action grant for the "Yakima Railroad Area."
