ITEM TITLE: Open record public hearing to consider the Yakima Planning
Commission's recommendation on a Comprehensive Plan
Amendment(CPA#001-20) and Rezone (RZ#002-20) request
submitted by Les Heimgartner for property at 8014 Occidental Rd

SUMMARY EXPLANATION:
Hordan Planning Services, on behalf of property owner Les Heimgartner, submitted a
Comprehensive Plan Map Amendment(CPA), Rezone, and Environmental Review application
for property at 8014 Occidental Rd. The applicant is requesting to change the Future Land Use
Map designation from Low Density Residential to Mixed Residential and to concurrently rezone
from Single-Family Residential (R-1)to Multifamily Residential (R-3). This request is for one
parcel.After holding virtual study sessions on August 12th and September 9th, and a virtual
public hearing on September 23rd, the Yakima Planning Commission recommended approval of
the CPA and Rezone application, with the Findings being signed by the chair on October 7,
2020.
In accordance with YMC 16.10.090, the City Council shall direct planning staff to prepare
legislation to approve, approve with conditions, or deny each amendment under consideration;
and at a subsequent City Council meeting enact an Ordinance adopting the decision reached at

Hordan Planning Services has been asked to make the following request on behalf of its client, Mr. Les Heimgartner, and
submit it for consideration at tonight's City Council Meeting:
After much thought, and with all due respect, I, Les Heimgartner am requesting that Council Member Kay Funk recuse
herself from Item Number 5 on the Council Agenda (CPA#001-20 and RZ#002-20). Testimony presented by Council
Member Funk at the City Planning Commission Meeting has been transcribed and is attached hereto. Council Member
Funk presented testimony at the City Planning Commission Meeting on September 23, 2020 in her official capacity as a
liaison of the City Council and/or as a member of the public. It is clear from her testimony at the Planning Commission
Meeting that she has pre-judged this matter, in either capacity, and cannot be fair and impartial in this matter.
It is respectfully requested that she recuse herself in this matter as any decision rendered involving Council Member
Funk will be subject to being reversed.

Kay Funk: Yes, this is Kay Funk. I'm the council liaison. I am of course speaking for
myself alone and maybe that makes me a member of the public. I'm not quite
sure.
I realize that this is a problematic little piece of property with the slope -- the very
long access or line that is an easement only, not really a street, and the wet area at
the bottom —so some challenges to building on it. My concern is that Yakima
does have an urgent need for more housing, specifically for more multi-family
housing and as stated in the staff report that is at a crisis level but (inaudible)
creation of more R-3 land would allow for more residential housing units. That's
only if more residential housing units are built on that R-3 land and its specifically
not true if a mini-storage facility is built on that R-3 land.
It is— it seems to me even more ironic that the need for the storage unit is to
accommodate recreational vehicles that cannot be stored on the owners property
because of restrictive covenants. So my feeling is while I would support — while I
would speak in favor of a rezone to create more housing units, 1 would speak
against this purpose. I don't think that the current neighbors should be
inconvenienced in having this rezoned to accommodate other people's
recreational units— recreational vehicles.
