For Meeting of: November 2, 2020 ITEM TITLE: Resolution authorizing supplement 7 to contract 2014-180 with Maul Foster Alongi for environmental monitoring at former Tiger Oil site at 2312 West Nob Hill Blvd SUBMITTED BY: Joan Davenport, Community Development Director SUMMARY EXPLANATION: The City of Yakima desires to continue the remediation at the former Tiger Oil site located at 2312 West Nob Hill Boulevard. Funding for the remediation of this site has been provided by the Department of Ecology through a Remedial Action Grant. The scope of work for this phase of the project is detailed in the attached Supplemental Agreement and includes an additional $55,373 of tasks, as follows: - Task 21b, additional work which MFA has already completed in May through July 2020 due to the HVOCs issue: $20,583. - Tasks 22 through 24, accounting for the additional work for the HVOCs component in addition to the petroleum hydrocarbons (as the primary contaminant of concern at the site) in the semi-annual groundwater events (2 years: from November 2020 through May 2022), air quality assessments, and project management. o Each semi-annual groundwater event cost was increased by an additional $3,608. For 4 semi-annual events, the total additional cost is $14,432. o The air quality assessments (2 events) cost was increased by$2,090. o Project management task cost was increased by$4,557 per quarter. Previously, we didn't wholly account for the necessary level of efforts to prepare the monthly invoice letters, quarterly progress reports, and project discussions with Ecology and sometimes with the City. R-2020- A RESOLUTION authorizing a Supplement to the Professional Services Agreement with Maul Foster Alongi, Inc. (MFA) to provide additional tasks in the design and construction oversight for the environmental cleanup of the former Tiger Oil site at 2312 West Nob Hill Boulevard, in the City of Yakima. WHEREAS, The City of Yakima established that the environmental cleanup and redevelopment of the former Tiger Oil property at 2312 West Nob Hill Boulevard is both an "Economic Development" and "Improving the Built Environment" Strategic Priority; and WHEREAS, The Washington State Department of Ecology has provided funding for the cleanup of this site exceeding $1.2 Million with budget reserve still available for this Supplement; and WHEREAS, The City entered into a Professional Services Contract (2014-180) with MFA in 2014 to provide oversight and design of the cleanup activity at 2312 West Nob Hill Boulevard for the former Tiger Oil property; and WHEREAS, as a result of the contract monitoring, a new series of contamination (from HVOC sources was discovered in the summer of 2020 which is a result of up gradient source, the City was made aware of these new findings. Department of Ecology requested that MFA expand the monitoring at this site to document and evaluate the new source of contamination; and WHEREAS, the funding from this grant agreement is available to the City of Yakima for the additional tasks without exhausting the grant, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute Contract Supplement 7 of the Professional Services Agreement with Maul Foster Alongi, Inc (MFA) attached hereto and incorporated herein by this reference not to exceed Fifty-Five Thousand, Three Hundred Seventy-three dollars ($55,373) to provide the Professional Services as described in the tasks of the Agreement, now, therefore is. State Street, Suite 301 Number: 7 Bellingham, WA 98225 Original Contract Number: Execution Date of Supplement: 2014-180 September 14, 2020 City Engineering Project Number: 2389 Completion Date of Supplement: December 31, 2022 Project Title: Maximum Amount Payable this Supplement: Former Tiger Oil Site Interim Remedial Action $55,373 Maximum Total Amount Payable for the Agreement: $990,961 Section 1: Supplemental Agreement The City of Yakima, Washington desires to supplement the contract agreement entered into with Maul Foster Alongi, Inc, and executed on October 8, 2014 by Resolution No. 2014-121 and identified as Contract 2014-180. All provisions in the basic contract remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: The approved budget for CO06 was$156,136. The updated requested budget for CO07 is an additional $55,373. The key reasons for the difference in cost of an additional $55,373 from CO06 to CO07 are as follows: - Task 21 b, additional work which MFA has already completed in May through July 2020 due to the halogenated volatile organic compounds (HVOCs) issue: $20,583. - Tasks 22 through 24, accounting for the additional work for the HVOCs component in addition to the petroleum hydrocarbons (as the primary contaminant of concern at the site) in the semi- annual groundwater events (2 years:from November 2020 through May 2022), air quality assessments, and project management. o Each semi-annual groundwater event cost was increased by an additional $3,608. For 4 semi-annual events, the total additional cost is $14,432. o The air quality assessments (2 events) cost was increased by$2,090. o Project management task cost was increased by$4,557 per quarter. Section 2: Compensation Payment for this supplemented work will, is not to exceed $55,373, bringing the total amount of the Agreement to $990,961.
