HomeMy WebLinkAbout11/15/2011 13 Paratransit Services Contract Extension with TC Transportation • BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT Item No. 13 For Meeting of: November 15, 2011 ITEM TITLE: A resolution authorizing and directing the City Manager to enter into an extension of an existing operating contract and lease agreement with TC Transportation to continue to provide paratransit services through December 31, 2011, and on a subsequent monthly basis as necessary. SUBMITTED BY: Chris Waarvick, Public Works Director, 576 -6411 CONTACT PERSON: Ken Mehin, Transit Manager, 576 -6415 SUMMARY EXPLANATION: Yakima Transit is required to provide comparable complementary paratransit services under 49 CFR Ch. 37, Subpart F of the Americans with Disabilities Act, because Yakima Transit provides public transportation. Yakima Transit sent out a request for proposals. Yakima Transit negotiated with the top prospect; however, negotiations were terminated by that prospective contractor. As a result, Yakima Transit needs to extend the existing agreement through December 31, 2011, with the current provider, with the possibility of subsequent month by month extensions until the long -term contract with a provider is executed. The material portions of the contract and lease agreement are similar to previous paratransit • service and transit vehicle lease contracts that the City has executed, except that the contractor will be receiving an estimated 7% increase in monthly compensation. City Manager STAFF RECOMMENDATION: Adopt the resolution authorizing and directing the City Manager to enter into an operating contract and lease agreement extension with TC Transportation to provide another month of paratransit services. BOARD RECOMMENDATION: Due to the short history of events, the Council Transportation and Utilities Committee hasn't had an opportunity to discuss this particular issue; however, the Council Committee supports outsourcing paratransit services. COUNCIL ACTION: • • RESOLUTION NO. R -2011- A RESOLUTION authorizing and directing the City Manager to execute an extension of an existing operating contract and lease agreement with TC Transportation to continue to provide paratransit services on a month -to -month basis. WHEREAS, the City of Yakima operates public transportation services in and through the cities of Yakima and Selah including fixed -route service and Americans with Disabilities Act required (49 CFR Ch. 37, Subpart F) comparable complementary paratransit service (Dial A Ride); and, WHEREAS, the City has determined that contracting Yakima Transit's paratransit services is in the City's best interest along with leasing vehicles for use in providing the service; and, WHEREAS, following a sealed request for proposals (RFP No. 11106 -P), Medstar Cabulance Inc., was determined to be the most qualified bidder based on experience, qualifications, project understanding, financial stability, technical ability, facilities, and cost; however, contract negotiations were terminated by Medstar Cabulance Inc.. As a result, Yakima Transit negotiated an extension of the contract with the current Contractor, TC Transportation; and, WHEREAS, it is in the City's best interest to enter into an extension with TC Transportation to prevent an interruption in service that would violate FTA regulations. • NOW, THEREFORE, be it resolved by the City Council of the City of Yakima, the City Manager is hereby authorized and directed to enter into the attached contract extension with TC Transportation, to provide paratransit services for Yakima Transit through December 31, 2011, and subsequent month -to -month extensions as necessary and is authorized to sign any subsequent modifications or extensions to the agreement. Micah Cawley, Mayor ATTEST: Deborah Kloster, City Clerk • CONTRACT AMENDMENT NO. 7 PROJECT: City of Yakima RFP No. 10612 DESCRIPTION: Dial -A -Ride Paratransit Transportation Services VENDOR: TC Transportation Services, LLC THIS CONTRACT AMENDMENT NO. 7, is made and entered by and between the City of Yakima, a Washington municipal corporation (hereinafter "City ") and TC Transportation Services, LLC (hereinafter "Contractor ") WHEREAS, City and Contractor executed a "Contract" on August 15, 2006, providing for ADA Paratransit Service for the City pursuant to the above - referenced RFP, which will expire November 30, 2011; and WHEREAS, in anticipation of expiring contract, ADA Paratransit Services were solicited on a new Request for Proposals No. 11106 due June 23, 2011 and analysis /negotiations for a vendor have not been finalized and are taking longer than anticipated; and WHEREAS, both parties have determined that it is in their mutual interest and it is imperative to continue their relationship and extend Paratransit Service uninterrupted until a provider can be determined; and WHEREAS, TC Transportation has been operating at a loss each month, pending a new contract/vendor; and WHEREAS, it has been determined in order to continue to provide this service, consideration should be increased to what TC Transportation offered in their new proposal as listed in Section D of RFP No. 11106; NOW THEREFORE, in consideration of the mutual covenants, promises, and agreements set forth herein, it is agreed by and between the City and Contractor, effective December 1, 2011, . to continue on a month -to -month basis until a new contract can be secured as follows: Ambulatory and Non - Ambulatory: $14.79 No- Show's: No Charge Terms: 2% Net 10 Except as expressly modified herein, all other terms and conditions of the contract dated August 15, 2006, including any approved formal amendments and modifications, shall remain in full force and effect.
