Yakima Trolley presentation — Ken Johnson Mr. Johnson thanked Dick Zais for his involvement with the Yakima trolleys over the years and presented Mr. Zais with a model trolley in appreciation for his service. 3. David Reepalog, representing Senator Maria Cantwell, read a letter on her behalf congratulating Dick Zais on his retirement. 4. Deputy Director of Finance and Budgeting Cindy Epperson read a letter from State Auditor Brian Sontag congratulating Dick Zais on his retirement. 5. Special Recognition of retiring City Manager Dick Zais ➢ Proclamation of Commendation and Appreciation 25 JULY 5, 2011 • The Council Members read a Proclamation of Commendation and Appreciation for Dick Zais' service to the City. The • Council presented Mr. Zais with a service award and a watch. ➢ Resolution designating the name of "Richard A. Zais, Jr. Center for Law and Justice" as the name of the City of Yakima building at 200 South Third Street in Yakima in honor and recognition of the outstanding service of City Manager Dick Zais to the City of Yakima. The City Clerk read the resolution by title. MOVED BY COFFEY SECONDED BY ENSEY TO ADOPT THE RESOLUTION. Following accolades by the City Council, motion carried by a unanimous roll call vote. City Manager Zais then gave up his chair to Interim City Manager Morales. RESOLUTION NO. R 2011 - 104, A RESOLUTION of the City of Yakima, Washington, designating the name of the "Richard A. Zais, Jr. Center for Law and Justice" as the name of the City of Yakima building at 200 South Third Street in Yakima, Washington, in honor and recognition of the outstanding service of City Manager Dick Zais to the City of Yakima. C. Status reports on prior meeting's citizen service requests 1. Response to Tony Courcy regarding traffic volume information Public Works Director Chris Waarvick reviewed the report provided to Council. In response to Mr. Courcy's additional question, the lights at the cross walk on 4th Street and Martin Luther King Jr. Boulevard are currently functioning. 2. Response to Lynne Kittelson regarding truck routes Public Works Director Waarvick advised that establishing truck routes within the city would require infrastructure improvements and enforcement. At this time, neither is possible. D. Appointments to Boards, Commissions and Council Committees -- None 4. Consent Agenda Mayor Cawley referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Items 6, 7, 8 and 20 were added to the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. MOVED BY COFFEY AND SECONDED ENSEY TO ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *A. Consideration of approval of City Council Meeting Minutes • Special Meeting /Study Session — March 8, 2011 • Business Meeting — March 15, 2011 The minutes of the Special Meeting /Study Session on March 8 and the Business Meeting on March 15, 2011 were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 2 26 JULY 5, 2011 *B. Consideration of approval of Council Committee Meeting Minutes • Gang Free Initiative — June 2, 2011 • • Economic Development Committee — June 14, 2011 • Public Safety Committee — June 15, 2011 • Boards and Commissions Nominating Committee — June 16, 2011 • Budget Committee — June 16, 2011 The Council Committee Meeting Minutes were approved. 5. Audience Participation Lynne Kittelson complained that, due to recent graffiti on City buses, passengers are now required to exit the bus at the transit station and not allowed to re -board until the driver is ready to continue the route. Mayor Cawley assured her staff would look into the matter and respond at a future Council meeting. Deanna Pemberton — 3601 Fairbanks Avenue, asked Council whether they have reviewed City employees' medical and dental benefits for the 2012 budget. Interim City Manager Morales explained the structure of the board for the City's self- insured health and benefit program and the review process the board undertakes for tracking expenses and considering cost - containment measures. Mike Hunnel — 1502 S. 18 Avenue, was concerned about public safety officers multi- tasking and using cell phones without a hands -free device while on patrol. Several Council members explained the extensive training officers receive in order to multi -task safely. CITY MANAGER'S REPORTS *6. Accepting public input and consideration of a Resolution adopting the 2010 Water System Plan Update RESOLUTION NO. R- 2011 -105, A RESOLUTION adopting the 2010 the Water System Plan Update with its Appendices for the City of Yakima, Washington. *7. Update of the Multi -year Irrigation System Rebuild Project *8. Consideration of a Resolution approving the Maple Street Incinerator designation as a historic property and placement on the Yakima Register of Historic Places RESOLUTION NO. R- 2011 -106, A RESOLUTION relating to historic preservation; Adding the City of Yakima Maple Street Incinerator, a property designated by the Yakima Historic Preservation Commission under Chapter 11.62 of the City of Yakima Municipal Code, to the Yakima Register of Historic Places; and imposing controls upon construction, renovation and /or repair thereof. • 3 27 JULY 5,2011 *9. Consideration of a Resolution authorizing execution of an agreement with Mercer Group, Inc. to provide recruitment services for the position of Chief of Police RESOLUTION NO. R- 2011 -107, A RESOLUTION authorizing the City Manager to execute a Professional Services Agreement between the City of Yakima and The Mercer Group, Inc. for executive recruitment services for the position of Chief of Police of the City of Yakima. *10. Consideration of a Resolution authorizing execution of a Memorandum of Understanding with the U.S. Department of the Interior, Bureau of Land Management, for implementation of the Cowiche Mill Post -fire Emergency Stabilization and Rehabilitation on City -owned parcels that were purchased for the William O. Douglas Trail RESOLUTION NO. R- 2011 -108, A RESOLUTION authorizing the City Manager to execute a Memorandum of Understanding (MOU) with the United States Department of the Interior, Bureau of Land Management, Oregon/Washington, Spokane District (BLM) to allow implementation of the Cowiche Mill Post -Fire Emergency Stabilization and Rehabilitation Plan (ESR Plan) on City -owned parcels (171310 -43003 and 171310 - 34001) that were purchased for the William O. Douglas Trail. This resolution will also authorize the City Manager to execute other contracts and agreements required for maintenance and other needs on these properties. *11. Consideration of a Resolution authorizing execution of an easement to Yakima County for improvements to the Yakima County Courthouse RESOLUTION NO. R- 2011 -109, A RESOLUTION authorizing the City Manager to, execute an Easement to Yakima County authorizing construction, use and maintenance of improvements to the Yakima County Courthouse within the right of way of Martin Luther King, Jr. Boulevard between 1 Street and 2 Street within the City of Yakima, and authorizing delivery and recording thereof. *12. Consideration of a Resolution authorizing execution of an interlocal agreement to fund a portion of Yakima Transit's vanpool program RESOLUTION NO. R- 2011 -110, A RESOLUTION adopting a resolution authorizing the City Manager to enter into an interlocal agreement to fund a portion of Yakima Transit's vanpool program. *13. Consideration of a Resolution authorizing execution of the two -year temporary staffing services agreement with Entrust RESOLUTION NO. R- 2011 -111, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute the two -year Temporary Staffing Services Agreement with Entrust, a nonprofit vocational rehabilitation employment service. *14. Consideration of a license agreement with the North Front Street Improvement Association for primary use of the street banner poles on North Front Street 4 28 JULY 5, 2011 *15. Consideration of a Resolution authorizing the Department of Community and Economic Development to submit to the Washington State Department of Ecology a Shorelines Master Program grant application in the amount of $40,000 RESOLUTION NC). R- 2011 -112, A RESOLUTION authorizing the Department of Community and Economic Development to submit to the Washington State Department of Ecology a Shorelines Master Program grant application in the amount of $40,000. *16. Consideration or a Resolution approving the preliminary plat of Apple Blossom Phase VII RESOLUTION NC). R- 2011 -113, A RESOLUTION approving a preliminary long plat, subject to certain conditions, for a three (3) lot subdivision know as Apple Blossom Phase VII to be located in the vicinity of 2140 South 64 Avenue, Yakima, Washington. *17. Consideration of a Resolution amending the Capitol Theatre Operating Agreement for the purpose of correcting the legal description of the property RESOLUTION NO. R- 2011 -114, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute Amendment No. 1 to the Capitol Theatre Operating Agreement for the purpose of correcting the property description. *18. Consideration of A resolution authorizing execution of a public defender agreement with Richard Gilliland, Attorney at Law RESOLUTION NO. R- 2011 -115, A RESOLUTION authorizing and directing the City Manager and City Clerk to execute the Public Defender Agreement with Richard Gilliland. *19. Set date of public hearings for July 19 and August 2, 2011 to consider amendments to the City of Yakima 2011 Annual Action Plan regarding the reduction of CDBG and HOME program funding July 19 and August 2, 2011 were set as dates of public hearings to consider amendments to the City of Yakima 2011 Annual Action Plan regarding the reduction of CDBG and HOME program funding ORDINANCES *20. Consideration of an Ordinance amending Chapter 11.62 of the Yakima Municipal Code pertaining to historic preservation 5 29 JULY 5, 2011 ORDINANCE NO. 2011 -28, AN ORDINANCE relating to historic preservation, amending Chapter 11.62 of the Yakima Municipal Code regarding historic preservation of buildings, sites and historic districts *21. Consideration of an Ordinance amending the City of Yakima Municipal Code, repealing section of Chapter 6.48 and Chapter 6.04 to adopt the equivalent and /or similar Revised Code of Washington statutes relating to public safety ORDINANCE NO. 2011 -29, AN ORDINANCE relating to Public Safety; amending the City of Yakima Municipal Code, repealing certain sections of Chapter 6.48 and a certain section of Chapter 6.04 for the purpose of adopting the equivalent and /or similar Revised Code of Washington statutes: obstructing a law enforcement officer, resisting arrest, escape in the third degree, making a false or misleading statement to a public servant, and false reporting ;re- codifying and amending Section 6.04.325; adopting Revised Code of Washingtori±statute relating to refusing to summon aid for a peace officer; and changing the title 'of Chapter 6.48 to reflect the new contents. *22. Second reading of an Ordinance amending the.2011 Budget and making appropriations in the 477 - Domestic Water Improvement fund to repair a broken water main An Ordinance amending the 2011 budget and appropriating funds to repair a broken water main, previously having been read by title only, was brought before the Council for aksecond reading. ORDINANCE NO. 2011 -30, AN ORDINANCE amending the 2011 budget for the City of Yakima; and making appropriations of $200,000 within the 477 — Water Improvement Fund for expenditure during 2011 to repair a broken water main. 23. Other Business • Update on City Manager search process Colin Baenziger advised he would forward three candidates to the Council for consideration and outlined the next steps in the city manager interview process to take place on July 12 and 13. CAWLEY MOVED AND ADKISON SECONDED TO ACCEPT MR. BAENZIGERS REPORT AND DIRECT MR. BAENZIGER TO CARRY OUT THE ACTION BASED ON THE QUALIFICATIONS OF THE CANDIDATES THAT COUNCIL APPROVES. Motion carried by unanimous roll call vote. Council Member Edler asked if he could make a presentation to the City Council at the next meeting regarding a streets bond. Council agreed to his request. Interim City Manager Morales advised that the Chamber of Commerce has requested Council members to give a short presentation at the July 1 1 `h Membership Luncheon on the status of the City Manager search as well as their projections for the future of Yakima in 2012. He also referenced the recent letter to the editor in the Yakima Herald- Republic regarding electronic bill paying. Efforts will be made to contact this citizen and provide an update on the status of this system. 6 30 JULY 5, 2011 ' 24. Adjournment MOVED BY ENSEY SECONDED BY EDLER TO ADJOURN.
