ITEM TITLE: Set September 6, 2011, as the date for an Open Record Public Hearing to
consider the recommendation of the Hearing Examiner to approve the vacation
of a portion of Poplar Street between North 1 and 3rd Avenues.

SUMMARY EXPLANATION: Roche Fruit Inc. /MWR Cold Storage has submitted a petition for
the vacation of the following portion of right -of -way, which in the vicinity of 612 North 1st
Avenue:
• That portion of Poplar Street lying East of the East right -of -way of North Third Avenue
and West of the West right -of -way of North First Avenue.
On July 14, 2011, the Hearing Examiner held an open record public hearing to consider this
vacation petition. On July 28, 2011, the Hearing Examiner issued his recommendation for the
411 approval of this petition. You are now being requested to set September 6, 2011 as the hearing
date for City Council consideration of the Hearing Examiner's recommendation.

recommendation for the approval of this right -of -way vacation.
