R- 2011 -124 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Professional Services Agreement with Huibregtse Louman Associates, Inc. in an amount not to exceed $75,000 to provide Engineering Services for extension of the City of Yakima's Industrial Waste line. WHEREAS, the City of Yakima desires to have plans, specifications and an estimate (PS &E) package developed to extend the industrial waste line; and WHEREAS, the City of Yakima will require professional surveying services for industrial sewer system improvements; and WHEREAS, the City maintains a roster of consultants whose statements of qualifications represent that they have the expertise necessary to perform the services required by the City; and WHEREAS, the City Council has determined that it is in the best interest of the City to enter into a Professional Services Agreement with a consultant selected from the roster for such expertise; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk of the City of Yakima are authorized and directed to execute a Professional Services Agreement in amount not to exceed Seventy Five Thousand Dollars ($75,000) for Huibregtse Louman Associates, Inc. to provide the Professional Engineering Services required to design an extension of the City's Industrial Waste Line, a copy of which agreement (addendum No. 2) is attached hereto and by reference made a part hereof. COMPENSATION ON A TIME SPENT BASIS: For the services described in the attached Addendum No. 2 Exhibit A for BNSF Railroad Crossing Permitting, compensation shall be on a time spent plus expenses basis with estimated fee of $10,000.00, at the ENGINEER's normal hourly billing rates shown on Exhibit C. All other provisions, terms and conditions set forth in the underlying City Contact No. 2008 -15 and all approved amendments thereto shall remain in full force and effect unless otherwise amended in writing per the conditions of said underlying contract. The work to be performed involves (1) project management, and design and final plans and specifications for an Industrial Waste Forcemain from 3 Avenue to west line of BNSF Right of way, and east line of BNSF Right of Way to 7 Street; and (2) a sewer main extension to Jewel Apple from 1 Avenue to 3rd Avenue. The work to be performed also involves (3) administrative work with BNSF RR representatives to obtain permit(s) necessary to cross the railroad right of way with a new industrial waste forcemain. 3. DESIGN AND FINAL PLANS AND SPECIFICATIONS A. The project manager will coordinate ENGINEER'S design team to ensure that the work is completed on schedule, is technically competent, and meets the CITY'S needs. The project manager will provide overall project management for ENGINEER'S work element, including coordination with subconsultants, progress reports, and invoicing. B. Attend up to two (2) project meetings in Yakima with CITY Wastewater Department staff to coordinate the design aspects of the project with the CITY. C. Complete a topographic survey from 3 Avenue to Jewel Apple, along the alignment of Willow Street. Call for utility locates prior to survey. C. Perform the final design and prepare complete Plans and Specifications for bid call on the proposed work, as authorized by the City. D. Furnish the CITY thirty (30) copies of the final Plans and Specifications for bidding and construction for each Phase of work. It is anticipated that the ENGINEER will prepare one (1) complete set of plans and specifications for forcemain improvements in conjunction with the FRUITVALE CANAL PIPELINE IMPROVEMENT PROJECT. Plans and Specifications for the BNSF RR Crossing are not included in this Addendum No. 2. E. Furnish to the CITY engineering data for and assist in the preparation of the required documents so that the CITY may secure approval of such governmental authorities as have jurisdiction over design criteria applicable to the Project. F. Prepare legal descriptions and exhibits necessary for the City to obtain a public utility easement for a sewer main extension across Parcel No. 181313-44441, which may be necessary to extend the sewer main in alignment with Willow Street, east to Jewel Apple. F. Answer and supply such information as is requested by prospective bidders. G. Prepare and issue addenda, if necessary. Attend bid opening and participate in the bid opening and evaluation process. J. Prepare tabulation of all bids received by the CITY and review bidder's qualifications. K. Make recommendation of construction contract award to the lowest responsible bidder. 3A. BNSF RAILROAD CROSSING PERMITTING L. Work with BNSF Railroad representatives to determine potential and to receive a crossing permit for the new industrial forcemain from 1 st Avenue to Front Street. M. Work with BNSF Railroad representatives to determine construction requirements to install a new industrial forcemain from 1 Avenue to Front Street. N. Work with BNSF Railroad . representatives to complete permit applications necessary for the City to receive a crossing permit for a new industrial forcemain from 1 Avenue to Front Street. O. SUBMITTED BY: Chris Waarvick; Public Works Director Scott Schafer, Storm and Wastewater Division Manager Shelley Willson, Utility Engineer CONTACT PERSON /TELEPHONE: Shelley Willson/ 575 -6077 SUMMARY EXPLANATION: Construction of a main irrigation line provides the opportunity for the extension of the City of Yakima's Industrial Waste (IW) Line to the area previously occupied by Boise Cascade. This will allow the location of food processing industries such as wineries or breweries to this area to be developed that discharge high strength process wastewater. Placing the IW line in the same alignment and construction area as the Fruitvale Pipeline Improvement Project will reduce costs and construction disruption to the public. The irrigation project is scheduled to begin construction this fall, resulting in a fast approaching deadline for the design of the IW line. In order to meet the timelines, Huibregstse, Louman Associates, Inc. has been chosen to complete the work for the IW line because they are currently the Engineers under contract with the City's Irrigation Division for design and contract administration for the Fruitvale Canal Improvement Project. The attached resolution authorizes the City Manager to execute the attached Professional Services Agreement with Huibregtse, Louman Associates, Inc. to develop the Plans, Specifications and Estimate (PS &E) and provide surveying services required for IW system improvements and expansion. The attached Addendum No. 2 identifies the tasks and estimated costs for performing the PS &E, not to exceed seventy -five thousand dollars ($75,000).
