R- 2011 -117 A RESOLUTION authorizing the City Manager to execute an Interlocal Agreement (ILA) between the City of Yakima and Yakima County regarding the development of improvements known as the East — West Corridor /Cascade Mill District Redevelopment project. WHEREAS, the City and the County have determined that it is desirable to undertake construction of the first phase of the East — West Corridor from North 1 Street in the City to Butterfield Road in the County in conjunction with other infrastructure improvements required for the redevelopment project; and, WHEREAS, the City and County recognize that coordination of the public and environmental review of necessary, planned street improvement projects is a priority for the Region and intend to approach these improvements and the related economic development on an inclusive, comprehensive basis; and, WHEREAS, the City has established the Cascade Mill District Redevelopment Project for the purpose of creating the necessary infrastructure to support enhanced economic development opportunities in and around the former Boise Cascade sawmill property; and, WHEREAS, pursuant to RCW Chapter 39.34, the parties are each authorized to enter into an interlocal agreement; and, WHEREAS, the City Council deems it to be in the best interests of the City to enter into this Interlocal Agreement with the County for the development of this East — West Corridor; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute an Interlocal Agreement (ILA) between the City of Yakima and Yakima County regarding the development of improvements known as the East — West Corridor /Cascade Mill District Redevelopment project. ADOPTED BY THE CITY COUNCIL this 19 day of July, 2011. /1 4)14 -' CaLel Micah Cawley / Mayor ATTEST: City Clerk INTERLOCAL AGREEMENT BETWEEN YAKIMA COUNTY AND THE CITY OF YAKIMA REGARDING THE DEVELOPMENT OF IMPROVEMENTS KNOWN AS THE EAST — WEST CORRIDOR / CASCADE MILL DISTRICT REDEVELOPMENT PROJECT This Interlocal Agreement (hereinafter "Agreement ") is made and entered into by and between Yakima County (hereinafter "County ") and the City of Yakima (hereinafter "City ") for the purpose of facilitating transportation improvements necessary to support future capacity needs and .safety of the 1 -82 interchange system, as well as economic expansion within the City and continued development in the County's Terrace Heights area. WHEREAS, in 2001 the County completed a preliminary alignment study for the Terrace Heights East — West Corridor which identified potential alignments for a new arterial that would connect Fruitvale Boulevard in the City with N. 57 Street in the County; and, WHEREAS, all alignments studied for the East — West Corridor crossed through the then operating Boise Cascade sawmill property, which is now known as the Cascade Mill District, and required a new crossing over the Yakima River; and, WHEREAS, the City and County recognize that coordination of the public and environmental review of necessary, planned street improvement projects is a priority for the Region and intend to approach these improvements and the related economic development on an inclusive, comprehensive basis; and, WHEREAS, the City has established the Cascade Mill District Redevelopment Project for the purpose of creating the necessary infrastructure to support enhanced economic development opportunities in and around the former Bosie Cascade sawmill property; and, WHEREAS, the City has concluded an Engineering Services selection process in accordance with State law for infrastructure design for the Cascade Mill District, and has selected the firm of H.W. Lochner as the best qualified to perform the required services; and, WHEREAS, the City and the County have determined that it is desirable to undertake construction of the first phase of the East —West Corridor from North 1 Street in the City to Butterfield Road in the County in conjunction with other infrastructure improvements required for the redevelopment project; and, WHEREAS, pursuant to RCW Chapter 39.34, the parties are each authorized to enter into an interlocal agreement, NOW THEREFORE, it is agreed by the parties as follows: 1. The City and County will jointly undertake planning and development of an arterial corridor to be known as the East — West Corridor which shall connect Fruitvale Boulevard in the City to North 57 Street in the County. Said planning efforts shall include jointly requesting "Functional Classification" of the corridor from the Federal Highway Administration, and inclusion of the Page 1 of 3 Corridor in their respective Transportation Planning documents for future development and implementation. 2. The City and County agree that the first phase of the East — West Corridor shall be from North 1st Street in the City to Butterfield Road in the County, including a new bridge over the Yakima River and access modifications to Interstate 82. The project will be developed concurrently with the infrastructure improvements for the Cascade Mill District redevelopment project. 3. The City and County have reviewed the draft Scope of work for the Cascade Mill District / East — West Corridor infrastructure development submitted by the Consultant team led by H.W. Lochner for preliminary design, environmental documentation and other necessary engineering services for the project. The City and County agree that the scope of work should be divided into three elements of work which are: Interchange Justification Report; Fair Avenue Extension and the first phase of the East - West Corridor; 1 Street to Butterfield Road. The Consultant team has been directed to produce a Final scope of work and proposal. The final scope of work shall define the tasks to be undertaken by the City and County as set forth in paragraphs 4 and 5 below. 4. The County will negotiate directly with the Lochner team for, and will manage the Interchange Justification Report and the East — West Corridor elements of the Final Scope of Work. The City agrees that the County will be the "Lead Agency" for SEPA and NEPA environmental reviews for these two elements of the work. 5. The City will negotiate directly with the Lochner team for, and will manage the Fair Avenue Extension element of the Final Scope of Work. The City will be the "Lead Agency" for this element of the work. 6. If either the City or County is unable to negotiate an agreement with H.W. Lochner for the work identified in 4 and 5 above, that party may negotiate with another consultant in accordance with applicable Law. Any such unsuccessful negotiation shall not preclude the other party from negotiating an agreement with H.W. Lochner for their respective work. 7. To the extent possible all public involvement will be a joint effort and jointly sponsored by and between the City and the County. 8. Apportionment of the costs between the City and County for the completion of the work identified in paragraphs 4 and 5 above will be determined at a future time agreed to by the parties . and such apportionment shall be included as a supplement to this agreement. 9. The City and County will work cooperatively to develop and implement a construction funding plan for the infrastructure improvements outside of the Cascade Mill District redevelopment area. Engineer — 576 -6678 SUMMARY EXPLANATION: This ILA is entered into by the City and County for the purpose of facilitating transportation improvements necessary to support future capacity needs and safety of the Interstate 82 interchange system, as well as economic expansion within the City and continued development in the County's Terrace Heights area. The City and County will jointly undertake planning and development of: • An arterial corridor to be known as the East — West Corridor which shall ultimately connect Fruitvale Boulevard in the City to 57 Street in the County. • An Interchange Justification Report which will provide for a connection of the East — West Corridor with Interstate 82. • A North — South arterial corridor to be known as the Fair Avenue Extension, which will ultimately extend Fair Avenue to the north to the vicinity of 1 Street and 'R' Street.
