Executive Session • Collective bargaining • Potential litigation Executive Session was held and adjourned at 5:47 p.m. 6:00 P.M. — BUSINESS MEETING 1. Roll Call • Present: Council: Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey, Council Members Maureen Adkison, Dave Edler, Rick Ensey, Dave Ettl and Bill Lover Staff: Acting City Manager Zabell, City Attorney Cutter and City Clerk Kloster 2. Invocation /Pledge of Allegiance Council Member Ettl gave an invocation and led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamations • Martin Luther King, Jr. Week Assistant Mayor Coffey read a proclamation declaring January 16 through the 22 as Martin Luther King, Jr. week. Reverend Trimble and James Park accepted the proclamation. • National School Board Month Council Member Adkison read a proclamation declaring January 2011 as National School Board Month. Walt Ranta accepted the proclamation. B. Presentations /recognitions /introductions • Assistant City Manager Zabell Mayor Cawley read a proclamation of commendation and appreciation of Assistant City Manager Dave Zabell for five and one -half years of service. He also received a plaque and an official City watch. Mr. Zabell has accepted the position of City Manager of Fife, Washington. • Police Chief Granato Council Member Edler read a commendation of Chief Sam Granato after he gave a personal thank you to the Chief for seven years of service to the City. Chief Granato received a plaque and an official City watch. 408 JANUARY 4, 2011 C. Status reports on prior meeting's citizen service requests - None D. Appointments to Boards, Commissions and Council Committees • Housing Authority Commission — Reappoint Christine Goodwin LOVER MOVED AND ETTL SECONDED TO REAPPOINT CHRISTINE GOODWIN TO THE HOUSING AUTHORITY BOARD. The motion carried by unanimous voice vote. 4. Consent Agenda Mayor Cawley referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Items number 9A, 9B and 9C were removed from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. ENSEY MOVED AND COFFEY SECONDED TO ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *A. Consideration of approval of City Council Meeting Minutes • Budget Review -- November 30, 2010 • Budget Wrap Up — December 7, 2010 • Business Meeting — December 7, 2010 • • Special Meeting — December 10, 2010 City Council meeting minutes were approved. *B. Consideration of approval of Council Committee Meeting Minutes 1. Public Safety Committee — November 17, 2010 Council committee meeting minutes were approved. 5. Audience Participation Nestor Hernandez spoke in appreciation of Chief Granato's service to Yakima. He distributed a "Save the Date" announcement for the 10 Anniversary of the Cinco de Mayo fiesta in May. Luz Gutierrez also encouraged the Council and public to attend the celebration. David Hawkins and Dennis Hawkins spoke about the history of prayer in government and encouraged Council to continue their practice of giving an invocation at the beginning of the Council business meetings. Kevin Sheer, 1201 Folsom Avenue, spoke about his experiences with gang violence and graffiti and requested a street light be installed in the vicinity of his house to deter tagging. Deanna Pemberton, 3601 Fairbanks Avenue, spoke in favor of continuing prayer at Council meetings. She also raised the issue of employee benefits giving her opinion of how they should be handled. She requested responses to questions previously asked be put in writing; the national average of police officers and who the members of the negotiating team were for bargaining benefits with the unions. Prior to the end of the meeting, Assistant City Manager Zabell supplied her with a written response. 2 409 JANUARY 4, 2011 0 Mike Hunnel, 1502 S. 18 Avenue, demanded changes in City management; spoke about alleged code violations and accused City officials of possibly taking bribes from businesses in order for them to avoid having to comply with regulations. CITY MANAGER'S REPORTS 6. Consideration of a date for a ballot proposition to amend the City Charter to elect Council members from districts City Attorney Cutter advised Council of research he has done on this issue and explained the differing opinions between state law and the City Charter. He outlined options the City Council has regarding the timing of an election. He referred to an Attorney General's Opinion from 1992 which states that an issue of this type would go on the next general election and does not have to be set by City Council resolution. The need for a City Council resolution is only triggered if a special election is to be held. The City Attorney is responsible for preparing the proposition statement. Mary Baechler, representing Central Washington Progress, said they are hoping for a special election in April to allow the change, if passed, to be implemented prior to the • November general election. Ron Bonlender stressed the Council should be consistent in their decisions regarding special elections. During Council discussion, it was determined the options are: 1) take no action and it will move ahead on its own, or 2) put it on an April 26 ballot. If there is to be an April special election, the deadline for submission to the County Elections Office is March 11 EDLER MOVED AND ENSEY SECONDED TO TABLE THE DISCUSSION AND ALLOW THE PROCESS TO CONTINUE FROM THE PETITION. The motion carried by a 4 -3 roll call vote; Cawley, Coffey and Adkison voting no. *7. Consideration of Resolutions authorizing bad debt write -off: A. Central Accounts Receivables RESOLUTION NO. R- 2011 -01, A RESOLUTION authorizing the write -off of certain uncollectable central accounts receivables for the City of Yakima. B. Utilities RESOLUTION NO. R- 2011 -02, A RESOLUTION authorizing the write -off of certain uncollectable accounts receivable by the utility funds of the City of Yakima. C. Parking RESOLUTION NO. R- 2011 -03, A RESOLUTION authorizing the write -off of certain uncollectable parking citations and penalties for the City of Yakima. *8. Consideration of Resolutions authorizing execution of Interlocal Jail Agreement with the City of Union Gap RESOLUTION NO. R- 2011 -04, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute an Interlocal Jail Agreement with the City of Union Gap to allow the City of Yakima to house prisoners of the City of Union Gap at the Yakima City Jail. 3 410 JANUARY 4, 2011 9. Consideration of a Resolution authorizing execution of 2010 Collective Bargaining Agreements with: Council Member Edler asked for information regarding the deferred compensation benefit and the employee retirement fund. Assistant City Manager Zabell clarified the benefits. A. Yakima Police Patrolman's Association The City Clerk read the resolution by title; EDLER MOVED AND ADKISON SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2011 -05, A RESOLUTION authorizing and directing the City Manager to execute a collective bargaining agreement for 2011 with the Yakima Police Patrolman's Association (YPPA) representing the Yakima Police Officers and Sergeants bargaining unit. B. Teamsters Fire Management The City Clerk read the resolution by title; EDLER MOVED AND COFFEY SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2011 -06, A RESOLUTION authorizing and directing the City Manager to execute a collective bargaining agreement for 2011 with the Teamsters Local #760 representing the Yakima Fire Department Management Unit. C. AFSCME Municipal The City Clerk read the resolution by title; EDLER MOVED AND COFFEY SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote RESOLUTION NO. R- 2011 -07, A RESOLUTION authorizing and directing the City Manager to execute a collective bargaining agreement for 2010 -2011 with the American Federation of State, County and Municipal Employees (AFSCME) Local 1122 representing the Municipal Employees bargaining unit. *10. Consideration of a Resolution authorizing execution of an agreement with Conley Engineering, Inc., for electrical engineering design at upper Kiwanis Park RESOLUTION NO. R- 2011 -08, A RESOLUTION authorizing the City Manager to execute a Professional Services Agreement with Conley Engineering, Inc., in an amount not to exceed $30,000, for performing the electrical engineering design and calculations for three athletic ball fields, a concession stand, and parking lot in upper Kiwanis Park. *11. Consideration of a Resolution authorizing execution of an agreement with Conley Engineering, Inc., for engineering services at the Wastewater Treatment Plant, not to exceed $100,000 RESOLUTION NO. R- 2011 -09, A RESOLUTION authorizing the City Manager to execute an agreement between Conley Engineering Inc. and City of Yakima for engineering services. 4 411 JANUARY 4, 2011 ORDINANCES *12. Consideration of an Ordinance authorizing an amendment to the pay, classification and compensation plan Police Captains and Lieutenants ORDINANCE NO. 2011 -01, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective February 6, 2011; amending Subsections 2.20.100A, 2.20.100C, 2.20.110A, and 2.20.110B all of the City of Yakima Municipal Code *13. Consideration of Ordinance amending the fee schedule for land use applications: • Zoning Ordinance • Subdivision Ordinance • Environmental Policy • Comprehensive Plan Amendments ORDINANCE NO. 2011 -02, AN ORDINANCE amending the fee schedule for and use applications of the City of Yakima Zoning Ordinance (YMC 15.11.100), the Subdivision Ordinance (YMC 14.15.010 and 14.15.030), Environmental Policy (YMC 6.88.200), and Comprehensive Plan Amendments (YMC 16.10.050) 14.
