Written comments received by 3 pm for this meeting will be provided to the City Council prior to the meeting -- MINUTES EXECUTIVE SESSION Executive Session regarding pending litigation Council: Mayor Patricia Byers, presiding, Assistant Mayor Holly Cousens, Councilmembers, Kay Funk, Brad Hill, Soneya Lund and Eliana Macias (Councilmembers attending via speakerphone) Absent: Councilmember Jason White MOTION: Cousens moved and Hill seconded to adjourn to an Executive Session for up to 30 minutes to review pending litigation. The motion carried by unanimous vote, White absent. Executive Session was held and adjourned at 5:30 p.m. 1. Open Discussion for the Good of the Order A. Coronavirus (COVID-19) update Interim City Manager Meyerhoff provided an update on COVID-19's effect on City services and finances. Page 1 of 4 208 3. Council Reports A. Resolution approving extension of Mayoral Proclamation declaring emergency and order, if the Mayor issues a Proclamation extending the civil emergency proclamation and order due to COVID-19 The City Clerk read the resolution by title only. MOTION: Hill moved and Cousens seconded to adopt the resolution. The motion carried by unanimous vote, White absent. RESOLUTION NO. R-2020-086, A RESOLUTION extending the Mayor's Proclamation of Civil Emergency and Order regarding a state of emergency in the City of Yakima due to the coronavirus disease 2019 ("COVID-19"). 4. Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Items 6 and 8 were added to the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion see motion directly below.) MOTION: Cousens moved and Lund seconded to approve the consent agenda. Resolution accepting and approving 2nd Quarter 2020 Claim Report RESOLUTION NO. R-2020-087, A RESOLUTION accepting and approving the 2nd Quarter 2020 Claim Report for the City of Yakima. C. Resolution authorizing the Interim City Manager to sign a Quit Claim Deed of the City's reverter interest in favor of Comprehensive Healthcare for the property located at 301 South 6th Street RESOLUTION NO. R-2020-088, A RESOLUTION authorizing the Interim City Manager to sign a Quit Claim Deed of the City's reverter interest in favor of Comprehensive Healthcare for the property located at 301 South 6th Street. D. Resolution authorizing amendment to contract with HLAto provide engineering and project management services for the Cascade Mill Redevelopment Project RESOLUTION NO. R-2020-089, A RESOLUTION authorizing an amendment to contract with HLA Engineering and Land Surveying, Inc. to include engineering support for the Cascade Mill Redevelopment project E. Resolution authorizing Interlocal Agreement with Yakima County for Engineering Design, Land Surveying, Right of Way and Construction Inspection Services RESOLUTION NO. R-2020-090, A RESOLUTION authorizing an Interlocal Agreement with Yakima County, which allows the County to perform Engineering Design, Land Surveying, Right -of -Way, and Construction Inspection services for the City. R-2020-091, A RESOLUTION ratifying an application for a grant in the total amount of $56,019 from the United States Department of Justice, Bureau of Justice Administration, Edward Byrne Memorial Justice Assistance Grant Program G. Resolution authorizing an Asset Forfeiture Memorandum of Understanding with United States Department of Justice RESOLUTION NO. R-2020-092, A RESOLUTION authorizing the City Manager and the Chief of Police of the City of Yakima to execute an Asset Forfeiture Sharing Memorandum of Understanding with the United States Department of Justice H. Ordinance amending the 2020 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2020 for various purposes (Second Reading) ORDINANCE NO. 2020-020, AN ORDINANCE amending the 2020 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2020 for various purposes described in the attached Schedule. R-2020-093, A RESOLUTION ratifying an application for a grant from the United States Department of Justice, Bureau of Justice Administration, Edward Byrne Memorial Justice Assistance Grant Program J. 2020 2nd Quarter Receivables Status Report and Update on Utility Account Balances K. Ordinance adding Chapter 6.92 entitled Temporary Emergency Housing Facilities for the Homeless to the City of Yakima Municipal Code ORDINANCE NO. 2020-021, AN ORDINANCE adding Chapter 6.92 entitled Temporary Emergency Housing Facilities for the Homeless to the City of Yakima Municipal Code DEPARTMENT ITEMS 5. 2nd Quarter 2020 Capital Improvement Projects Report Bob Desgrosellier, Acting Chief Engineer, briefed Council on the report. 6. This item was moved to the consent agenda becoming item 4J 7. Resolution authorizing termination of lease agreement with Sunrise Outreach Center of Yakima, a religious organization, to lease property adjacent to the wastewater treatment plant for a temporary homeless encampment and to enter into a lease agreement with Grace City Outreach, a religious organization, to lease property adjacent to the wastewater treatment plant for a temporary homeless encampment Interim City Manager Meyherhoff suggested this item be removed from the agenda for additional work and brought back to Council at the next meeting. There were no objections. 8. This item was moved to the consent agenda becoming item 4K Page 3 of 4 210 Resolution authorizing the Mayor of the City of Yakima to execute an Employment Agreement for City Manager with Robert Harrison Human Resources Director Connie Mendoza briefed Council on the contract. Council members thanked Interim City Manager Meyerhoff for his commitment and dedication to the City. The City Clerk read the resolution by title only. MOTION: Cousens moved and Lund seconded to adopt the resolution. The motion carried by unanimous vote, White absent. RESOLUTION NO. R-2020-094, A RESOLUTION authorizing the Mayor of the City of Yakima to execute an Employment Agreement for City Manager with Robert Harrison. 10. Other Business Assistant Mayor Cousens discussed communications she has had with John Cooper of the Visitor & Convention Bureau and Greg Lybeck of Sozo Sports Complex and asked for additional information regarding an admissions tax/fee. She also requested information regarding the Heals and Heart Act. MOTION: Funk moved and Hill seconded to direct staff to include Asset Forfeiture (Memorandum of Understanding with United States Department of Justice) within prepared reports on YPD procedures and quantifiable YPD outcomes. The motion carried by unanimous vote, White absent. MOTION: Funk moved and Macias seconded to put on the agenda for the Aug. 18th meeting a motion to direct staff to request the Yakima County Homeless Coalition Executive Committee (under the administration of Yakima County) to provide periodic reports on grant compliance by Homeless Service providers. The motion carried by unanimous vote, White absent. 11. Adjournment MOTION: Cousens moved and Macias seconded to adjourn to the next Council regular meeting on August 18, 2020, at 5:30 p.m. in the Council Chambers at City Hall.
