A RESOLUTION
RESOLUTION NO R-97- 45
authorizing the City Manager and City Clerk of the City of Yakima to
execute an Amendment to the 1996-1998 Collective Bargaining
Agreement for Local 469, International Association of Firefighters,
AFL-CIO
WHEREAS, the City of Yakima, hereinafter the "City," and Local 469, International
Association of Firefighters, AFL-CIO, hereinafter the "Union," negotiated, bargained for,
and entered into a Collective Bargaining Agreement for the period of January 1, 1996
through December 31, 1998, hereinafter the "CBA"; and
WHEREAS, Article 25 of the CBA provides for sick leave accrual/exchange for
LEOFF employees;
WHEREAS, the City and the Union believe that in the event of a duty related death,
the employee's sick leave accrual balance should be.cashed out at 100% of cash value of the
accrual at the time of death;
WHEREAS, the City and the Union desire to amend the CBA to provide for, in the
vent of a duty related death, a 100% cash out of an employee's sick leave accrual balance at
the time of death.
WHEREAS, the City Council deems it to be in the best interest of the City of Yakima
to enter into the proposed Amendment to the 1996-1998 Collective Bargaining Agreement
for Local 469, International Association of Firefighters, AFL-CIO, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk are hereby authorized and directed to execute the
attached and incorporated Amendment to the 1996-1998 Collective Bargaining Agreement
for Local 469, International Association of Firefighters, AFL-CIO.

AMENDMENT TO
1996-1998 COLLECTIVE BARGAINING AGREEMENT
FOR
LOCAL 469, INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, AFL-CIO
THIS AMENDMENT to the existing Collective Bargaining Agreement is entered
into by and between the CITY OF YAKIMA, Washington, a municipal corporation,
hereinafter the "City," and Local 469, International Association of Firefighters, hereinafter
the "Union."
WHEREAS, the City and the Union negotiated, bargained for, and entered into a
Collective Bargaining Agreement for the period of January 1, 1996 through December 31,
1998, hereinafter the "CBA";
WHEREAS, Article 25 of the CBA provides for sick leave accrual/exchange for
LEOFF employees;
WHEREAS, the City and the Union believe that in the event of a duty related death,
the employee's sick leave accrual balance should be cashed out at 100% of cash value of the
accrual at the time of death;
WHEREAS, the City and the Union desire to amend the CBA to provide for, in the
event of a duty related death, a 100% cash out of an employee's sick leave accrual balance at
the time of death.
NOW, THEREFORE, the City and the Union agree to amend Article 25, Sections
25.1(e) and 25.2(e) of the CBA to read as follows:
25.1 (e) In no event shall the cash out exceed the sum of Six Thousand
Two Hundred Fifty Dollars ($6,250); provided, however, this cash out limit
shall not apply with regard to a death in the line of duty.
25.1 (e) In no event shall the cash out exceed the sime of Twelve
Thousand Five Hundred Dollars ($12,500); provided, however, this cash out
limit shall not apply with regard to a death in the line of duty.
THIS AMENDMENT is executed by the parties this 18th day of march
1997.

SUMMARY EXPLANATION:
The attached resolution authorizes an amendment to Article 25 of the 1996-1998 Fire LEOFF
Collective Bargaining Agreement with Local 469, International Association of Firefighters, AFL -
Article 25 governs the accrual and cash out provisions for sick leave and specifically, this
endment provides for 100% cash out of an employee's accrued sick leave balance in the event
a duty related death.
