Executive Session -- Prospective and Pending Litigation; Collective Bargaining McCLURE MOVED AND WHITMAN SECONDED TO MOVE INTO EXECUTIVE SESSION. The motion carried by unanimous voice vote. Executive Session adjourned at 6:02 p.m. 6:00 P.M. — PUBLIC SESSION 1. Invocation /Pledge of Allegiance Council Member McClure gave an invocation and led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamation 1. Council Member McClure read a proclamation declaring August 9 as John "Dick" Schactler Day in honor of Mr. Schactler's retirement from the Community Band after many years of volunteer service. B. Special Presentations /Retirement Recognitions 1. National Police Athletic League Volunteer of the Year to Jeff Curtsinger Capt. Jeff Schneider introduced Jeff Curtsinger who was recently voted National Police Athletic League (PAL) Volunteer of the Year. Mayor Edler read a proclamation expressing appreciation for his service to the citizens and children of Yakima. 2 AUGUST 7, 2007 2. Introduction of Deputy Fire Chief Bob Stewart Fire Chief Hines introduced Bob Stewart as the new Deputy Fire Chief. 3. Department of Ecology presentation to the City for 2006 NPDES Permit Record Rick Frye with the Department of Ecology presented the Wastewater Department with an Outstanding Treatment Plant Award. He stressed how difficult it is, especially with a city as large as Yakima, to accomplish a perfect year with no violations of any kind. C. Status report on prior meeting's citizen service request 1. Request from Candie Turner regarding 16 Avenue (River Road project) closure information. City Manager Zais advised that the information was supplied in the Council packet. 2. Request to change speed limit on 38 Avenue and 2 -way conversion of Chestnut Avenue and "A" Street Shelley Willson, Streets and Traffic Operations Manager, said they have received both a request to raise the speed limit and to leave it the same. City staff is working on a report for classified streets speed limits as part of the comprehensive plan but had not included the residential streets that were bike routes. CAWLEY MOVED AND McCLURE SECONDED TO INCLUDE THIS AND ALL RESIDENTIAL STREETS IN THE COMPREHENSIVE PLAN. Council Member Bonlender countered that this request was only for one street and he thought it inappropriate to take staff time to look at all the other streets. The motion failed by a 5 -2 roll call vote; Edler, Johnson, Lover, Whitman and Bonlender voting nay. With regard to converting "A" Street and Chestnut Avenue to 2 -way streets, Traffic Engineering did a cursory review that indicated a 2 -way operation might be feasible. They asked for Council direction and suggested it be reviewed by Engineering to determine costs. Mayor Edler suggested we contact the downtown associations and ask what their intentions are with regard to the same request from several yeas ago. Council Member Bonlender remembered this was recommended in a study from Washington D.C. The major issue is changing the signal lights. BONLENDER MOVED AND JOHNSON SECONDED TO HAVE STAFF SUPPLY COST ESTIMATE. Council Member Lover would like input from affected businesses. Other Council members did not want staff time spent on this. The motion failed by a 5 -2 roll call vote; Edler, Johnson, Lover, McClure and Whitman voting nay. JOHNSON MOVED AND McCLURE SECONDED TO HAVE THE COMMITTEE FOR DOWNTOWN YAKIMA (CDY) DO THE WORK TO SEE IF DOWNTOWN WANTS TO MOVE TOWARD THIS CHANGE AND WHAT THE COSTS WOULD BE. Chris Waarvick, Public Works Director, said there had previously been a policy issue that would have provided a turn -key report for Council but we were directed not to pursue it, although the question keeps surfacing. He said he would be glad to take the issue to Sean Hawkins, CDY, and have it as an item for the Transportation Committee. The motion carried by unanimous roll call vote. 2 :3 AUGUST 7, 2007 • D. Appointments to Council Boards and Commissions 1. Parks and Recreation Commission Mayor Edler advised that this decision is being deferred in order to interview an additional candidate. 4. Consent agenda Mayor Edler referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Item No. 15 was taken off the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. McCLURE MOVED AND LOVER SECONDED TO ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *A. Council Minutes • Adjourned Meeting -- February 27, 2007; Business Meetings — March 6, March 20, April 3 and April 17, 2007 The minutes of the February 27, 2007 Adjourned meetings and March 6, March 20, April 3 and April 17, 2007 Business meetings were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. *B. Council Committee Meeting Reports: • Transit Committee — June 20, 2007 • Council Public Safety Committee — July 12, 2007 • Neighborhood Development Committee — July 12, 2007 • Budget Committee — July 19, 2007 • Downtown Yakima Futures Initiative Committee — July 25, 2007 Reports were approved. 5. Audience Participation Emma Fischbeck, responding to previous comments about the Community Band's desire for a band shell, advised that there is such a thing as a portable one. She then spoke about a letter citizens received from Pacific Power regarding the user credit by the Bonneville Power Administration that will no longer be discounted on power bills. Therefore, the bill will be increased by 16.8 %. As a result of this change, the City of Yakima will receive an increase from the taxes applied to that 16.8% increase. She suggested the increased revenue to the City could be put toward the Safe Community Action Plan. Tony Corsey again asked for a cross walk on 16 at Hathaway. He said he has spent seventeen years asking for this and keeps receiving excuses. Council Member McClure responded that the request does not meet the warrants from the state in order to obtain state funding. He then referred to the tight budget and other areas that are even more dangerous and are waiting for action. 3 '4 AUGUST 7, 2007 PUBLIC HEARINGS — 7:00 P.M. 6. Public Meeting to consider final Plat Approval for Phase 3 of the Apple Blossom Development Bill Cook, Community and Economic Development Director, described the subdivision at the intersection of 64 Avenue and Occidental. It had received preliminary plat approval through the County prior to annexation by the City. Phase 1 received final plat approval by the County, Phase 2 was approved by the City in June, and this hearing is for plat approval of Phase 3. Because the preliminary plat was approved by the County, the City Council is required to adopt it as long as the conditions are met. After reviews by the County Engineer, the City Engineer and staff, it has been determined it does comply with all conditions imposed by the County at the time of the preliminary plat. Mayor Edler opened the public meeting; as no one came forward, he closed the public meeting. The City Clerk read the resolution by title; McCLURE MOVED AND CAWLEY SECONDED TO APPROVE. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2007 -108, A RESOLUTION approving the final plat of Apple Blossom Phase 3, a 23 -lot subdivision and authorizing the Mayor to sign the final plat. 7. Public Hearing and consideration of a Resolution executing a development agreement with Wide Hollow Development, LLC Bill Cook, Community and Economic Development Director, showed a map of a binding site plan which will, when fully built out, involve 29 acres of land, 22 buildings and approximately 236,000 square feet of retail /business /office space development. It is an exciting and complex project by the same developer as Creekside located across the street. The land is owned by both the City and the County and is managed by the airport. The development has gone through Planning who did a complex environmental review. Comments from outside agencies have been resolved. The project is ready to go. . Mayor Edler opened the public hearing Jim Leonard, questioned the traffic impact on 48 Avenue. Mr. Cook responded that the environmental review supported the projected traffic increase on 48 Avenue. . Mayor Edler closed the public hearing The City Clerk read the resolution by title; McCLURE MOVED AND JOHNSON SECONDED TO APPROVE. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2007 -109, A RESOLUTION authorizing and directing the City Manager to execute a Development Agreement with Wide Hollow Development, LLC, a Washington limited liability company (hereafter "Developer "), to provide for the terms and conditions of construction of a mixed use office building park complex for offices, commercial, and /or light industrial purposes to be located on Washington Avenue, between 40 and 48 Avenues, in the City of Yakima. 4 5 AUGUST 7, 2007 • CITY MANAGER'S REPORTS *8. Consideration of a Resolution" authorizing execution of an agreement with the Yakima Sunfair Festival Association for the arrangement of tourist promotion services for the Sunfair Parade RESOLUTION NO. R- 2007 -110, A RESOLUTION authorizing the City Manager of the City of Yakima to execute an agreement between the City of Yakima and the Yakima Sunfair Festival Association for the arrangement of tourist promotion services. *9. Consideration of a Resolution authorizing execution of a technical services agreement with the National Development Council (NDC) for community and economic development activities and projects RESOLUTION NO. R- 2007 -111, A RESOLUTION authorizing the City Manager to execute a Technical Assistance Agreement with the National Development Council (NDC) for the purpose of obtaining technical assistance services related to local, state and federally funded community and economic development projects and activities. *10. Consideration of a Joint Resolution ratifying an application and authorizing and accepting a grant agreement for runway safety area improvements at the Airport RESOLUTION NO. R- 2007 -112, A JOINT RESOLUTION OF THE CITY OF YAKIMA AND YAKIMA COUNTY ratifying an Application for Federal Assistance and Standard DOT Title VI Assurances, and authorizing the execution and acceptance of a Grant Agreement for Federal Assistance and Certificate of Sponsor's Attorney between the Federal Aviation Administration and the City of Yakima, Washington, and the County of Yakima, Washington. *11. Consideration of a Resolution granting a permit to Eagle Fireworks for a public display of fireworks at Yakima County Stadium RESOLUTION NO. R- 2007 -113, A RESOLUTION granting a public fireworks display permit to Eagle Fireworks on behalf of the Yakima County Stadium, Yakima Bears Baseball. *12. Consideration of a Resolution authorizing execution of a 2007 geriatric footcare services agreement with Melanie Marvel for footcare clinics at the Harman Center RESOLUTION NO. R- 2007 -114, A RESOLUTION authorizing the City Manager of the City of Yakima to execute a "Geriatric Footcare Services Agreement" with Melanie Marvel, R.N., to provide footcare services at the Harman Center. 5 AUGUST 7, 2007 *13. Approval of final contract payments for: A. Kiwanis Park Improvement — Phase 2 (Adopt Standard Motion V -B — accept project and approve final payment) The report from Huibregtse, Louman Associates, Inc., dated June 5, 2007, with respect to the completion of the work on the Kiwanis Park Improvement Project Phase 2, City project No. 1924, performed by Stephens and Sons Construction, Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. B. Fire Station #92 Facility Addition (Adopt Standard Motion V -B — accept project and approve final payment) Final inspection for Fire Station #92 Facility Addition was made with respect to the completion of the work performed by Concord Construction, Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. C. Southeast Community Center roofing improvement project (Adopt Standard Motion V - B - accept project and approve final payment) Final inspection for the Southeast Community Center roofing improvement project was made with respect to the completion of the work performed by Stephens and Sons Construction, Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. *14. Consideration of Resolutions setting date of public hearings before the Hearing Examiner for September 13, 2007: A. Right -of -way alley vacation behind the federal courthouse RESOLUTION NO. R- 2007 -115, A RESOLUTION fixing September 13th, 2007 as the date for a public hearing before the Hearing Examiner. This hearing concerns a petition to vacate all that portion of the dedicated alley lying between Lots 17 through 22 and Lots 23 through 28 all located in Block 71 of the Plat of The Town of North Yakima, now Yakima, as recorded in Volume "E" of Plats, Page 1 records of Yakima County, Washington. B. Right -of -way alley vacation for the proposed Holiday Inn RESOLUTION NO. R- 2007 -116, A RESOLUTION fixing September 13, 2007 as the date for a public hearing before the Hearing Examiner. This hearing concerns a petition to vacate all that portion of the dedicated alley lying between Lots 1 through 8 and Lots 9 through 16 all located in Block 171 of the Plat of Huson's Addition to North Yakima, now Yakima, as recorded in Volume "A" of Plats, Page 11, records of Yakima County, Washington. 6 AUGUST 7, 2007 ORDINANCES 15. Consideration of an Ordinance relating to traffic: establishing the date of the September "Open Cruising Event" in 2007 on Yakima Avenue for the fourth Saturday in September; and amending Section 9.25.020 of the City of Yakima Municipal Code Council Member Lover expressed concern about overtime costs for cruising events. LOVER MOVED TO DEFER UNTIL WE CAN ESTABLISH A FUNDING SOURCE AND INCORPORATE IT INTO THE ORDINANCE. The motion died for lack of a second. The City Clerk read the ordinance by title; BONLENDER MOVED AND McCLURE SECONDED TO PASS THE ORDINANCE. Council Member Bonlender advised that they had previously talked with the Vintiques about combining functions and they declined. This cruise will use ambassadors, reducing the Policed Department overtime. Capt. Schneider responded they spent about $3,000 on overtime on the first event and would not want to reduce the number of officers for this event. It was also pointed out that, if we deferred the decision, the ordinance could not go into effect in time to cover the event. Council Member Lover stated he thinks the private downtown organization, Committee for Downtown Yakima (CDY), should fund the events. CAWLEY MOVED • AND JOHNSON SECONDED TO AMEND THE ORDINANCE TO CORRECT THE DATE. The motion carried by unanimous voice vote. The question was called for a vote on the amended motion. The motion carried by unanimous roll call vote. ORDINANCE NO. 2007 -38, AN ORDINANCE relating to traffic; establishing the date of the September "Open Cruising Event" in 2007 on Yakima Avenue for the fourth Saturday in September; and amending Section 9.25.020 of the City of Yakima Municipal Code. *16. Consideration of an Ordinance amending the Classification and Compensation Plan for certain City employees and amending subsections 2.20.100A; 2.20.100C; 2.20.100D; 2.20.110A; 2.20.110B; and 2.20.110C of the Yakima Municipal Code ORDINANCE NO. 2007 -39, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective September 9, 2007, amending Subsections 2.20.100A, 2.20.100C, 2.20.100D, 2.20.110A, 2.20.110B, and 2.20.110C, all of the City of Yakima Municipal Code *17. Consideration of Ordinance accepting the Hearing Examiner's recommendation to approve a rezone request by James A. Obert for property located at 4202 Summitview Avenue ORDINANCE NO. 2007 -40, AN ORDINANCE relating to land use regulation and zoning; rezoning, with conditions, one parcel of property located at 4202 Summitview Avenue, Yakima, Washington from Single Family Residential, (R -1) to Local Business, (B -2) as more fully described herein; and approving, with conditions, the recommendation of the Hearing Examiner for the City of Yakima regarding the same; James A. Obert, D.C. and Stephnie Obert, identified as the applicants herein. 7 AUGUST 7, 2007 *18. Consideration of an Ordinance relating to vehicle impounds; amending section 9.47.040 to be consistent with the numbering of the ordinance ORDINANCE NO. 2007 -41, AN ORDINANCE relating to vehicle impounds; amending section 9.47.040 to be consistent with the numbering of the ordinance. *19. Consideration of an Ordinance relating to animal impounds; amending section 6.20.320 to be consistent with the numbering of the ordinance ORDINANCE NO. 2007 -42, AN ORDINANCE relating to animal impounds; amending section 6.20.320 to be consistent with the numbering of the ordinance. *20. First reading of an Ordinance amending the 2007 budget and appropriating funds for Police pension obligations (Read ordinance only at this meeting; second reading scheduled August 28, 2007) An Ordinance amending the 2007 budget and appropriating funds for buy -back of pension credits for reserve police officers, and pension benefits resulting from the negotiated wages and benefits for Yakima Police Patrolman's Association (YPPA), was read by title only, and laid on the table until August 28, 2007 for a second reading. *21. First reading of an Ordinance amending the Transit 2007 operating budget and appropriating funds for expanded transit routes to Union Gap to be funded by an air quality control grant An Ordinance amending the 2007 budget and appropriating funds to extend transit service to the City of Union Gap, was read by title only, and laid on the table until August 28, 2007 for a second reading. *22. Second reading of an Ordinance amending the 2007 budget and appropriating funds for unanticipated contractual jail costs ORDINANCE NO. 2007 -43, AN ORDINANCE amending the 2007 budget for the City of Yakima; and making appropriations of $312,000 within the 000 — Police Department of the General Fund for expenditure during 2007 to provide for unanticipated jail costs 23. Other Business Council Member Cawley requested the Budget Committee look into asphalting our streets rather than chip sealing them. 8 9 AUGUST 7, 2007 24.
