Roll Call All Council Members were present. Staff included City Manager Zais, City Attorney Cutter and City Clerk Kloster. 2. Invocation /Pledge of Allegiance Assistant Mayor Cawley gave an invocation and led the Pledge of Allegiance 3. Open Discussion for the Good of the Order A. Proclamations -- None B. Presentations /recognitions /introductions • Yakima Fire Department presentation to Chuck Doan Yakima fire fighters recognized Chuck Doan and presented him with a plaque acknowledging his efforts in administering CPR to Mr. James Milliron who had suffered a heart attack. Mr. Milliron was present to thank Mr. Doan. • Yakima Fire Department Chief Hines recognized Council Member Sonia Rodriguez for her service to the community and her participation as a member of the Council Public Safety Committee. He presented her with a personalized fire helmet. C. Status reports on prior meeting's citizen service requests — None D. Appointments to Boards, Commissions and Council Committees — None 4. Consent Agenda ACTION: Motion carried to approve the consent agenda as read. VOTE: Unanimous *A. Consideration of approval of Council Minutes • Special Meeting /Study Session — November 3, 2009 • Business Meeting — November 3, 2009 ACTION: Council minutes were approved. *B. Consideration of approval of Council Committee Meeting Minutes • Office of Neighborhood Development — October 7, 2009 • Downtown Yakima Futures Initiative — October 28, 2009 • Economic Development Committee — November 4, 2009 ACTION: Council committee meeting minutes were approved. 2 5. Audience Participation John Puccinelli spoke on behalf of Wilma and Andy Mervos concerning flooding to their property as a result of a stormwater drainage problem. Mayor Edler advised staff would research the problem and respond at the next Council business meeting. Maryann Lockhart and Deanna Pemberton asked for answers to their previous questions regarding code issues. Mayor Edler advised them staff had prepared a report that addressed their concerns, which was discussed at the last business meeting. They said they had reviewed the report but were not satisfied with the answers. Code Administration staff will schedule a meeting with them to further discuss the issues. 7:00 P.M. — PUBLIC HEARINGS 6. Continuation of Public Hearing on the 2010 -2014 Community Development Block Grant and HOME Consolidated Plan and 2010 Annual Action Plan and Consideration of a Resolution adopting the final plan for submittal to HUD Archie Matthews, Operations Supervisor for Office of Neighborhood Development Services, briefed Council on the process taken prior to submitting the plan to HUD. The public hearing was held. The following individuals spoke: Dan Kelleher, Hector Franco, Lowell Kruger, Eva Valdinia, Sandra Aguirre, Elizabeth Torres, and Carole Folsom -Hill. ACTION: Resolution was adopted. RESOLUTION NO. R- 2009 -149. VOTE: Unanimous 7. Public Hearing and Consideration of an Ordinance to approve annexing the Kegley annexation area to the City of Yakima Bruce Bension, Supervising Planner, described the annexation area. The public hearing was held. No one came forward to speak. ACTION: Ordinance was passed. ORDINANCE NO. 2009 -52. VOTE: Unanimous 8. Public Hearing regarding the 2010 Preliminary Budget City Manager Zais summarized the 2010 Preliminary Budget and explained the need for potential reductions due to the state of Yakima's economy. The public hearing was held. The following individuals representing outside agencies spoke: Carl Dry, Lois Cruikshank, Elizabeth Patterson, Jim Hall, Dave Caprile, Page Scott, Dave McFadden, Dan Kelleher, Nestor Hernandez, Mike Morisette, Michael Shepard, Ester Huey, Linda lasella, Bill Dolsen, Noel Moxley, Deborah Wilson, Jessika Muskwa and Amy McKinney. 3 A. Consideration of an Ordinance enacting utility rates for 2010 and 2011 for the Storm Drainage and Surface Water Management Utility Assistant City Manager Dave Zabel! and Shelley Willson, Utility Engineer, showed a Power Point regarding the proposed 2010 and 2011 stormwater utility rates. ACTION: Ordinance passed. ORDINANCE NO. 2009 -53. VOTE: 6 -0 (Rodriguez excused) 9. Public Hearing regarding the 2010 Ad Valorem Property Tax Levy A. Consideration of an Ordinance declaring intent to increase the City's 2010 regular property tax levy up to 100% of the amount levied in the previous year, plus new construction and annexation Cindy Epperson, Deputy Director of Accounting and Budgeting, presented information on the property tax levy. The public hearing was held. No one came forward to speak. ACTION: Ordinance passed. ORDINANCE NO. 2009 -54. VOTE: 5 -1, Lover voting no; Rodriguez excused. B. Consideration of an Ordinance fixing and levying the 2010 ad valorem property taxes and excess levy taxes for the City of Yakima ACTION: Ordinance passed. ORDINANCE NO. 2009 -55. VOTE: 5 -1, Lover voting no; Rodriguez excused CITY MANAGER'S REPORTS 10. Consideration of a recommendation from the Council Public Safety Committee to initiate a gang -free zone City Manager Zais summarized the proposed gang -free initiative. Council discussed the issue at length. Luz Gutierrez requested to be part of future meetings concerning the development of the program. ACTION: Motion carried to go forward with the gang -free initiative recommended by the Council Public Safety Committee; requested staff to research various programs; asked to be kept informed of the progress, and when available for Council review, to schedule a Study Session to discuss the proposal. VOTE: Unanimous *11. Consideration of third quarter finance reports: A. Treasury report B. Accounts receivable report ACTION: Reports were accepted. 4 *12. Consideration of final contract payments: A. Jeld -Wen frontage improvement ACTION: Final contract payment was approved. B. McAlister Business Park Phase 2 improvements ACTION: Final contract payment was approved. *13. Set date of "Closed Record" public hearing for December 1, 2009, to consider the final plat of Hannon Heights, Phase 1 located in the vicinity of South 76 Avenue and Coolidge Road ACTION: Closed Record public hearing was set for December 1, 2009. *14. Consideration of a Resolution authorizing execution of an intergovernmental cooperative purchasing agreement with Seattle Community College for certain goods and services ACTION: Resolution was adopted. RESOLUTION NO. R- 2009 -150 *15. Consideration of a Resolution authorizing execution of an agreement with Habitat for Humanity for a $75,000 grant for the acquisition and clearance of three building lots ACTION: Resolution was adopted. RESOLUTION NO. R- 2009 -151 *16. Consideration of a Resolution authorizing execution of the Yakima Tourism Promotion Area Administration Agreement with the Yakima Valley Visitors and Convention Bureau ACTION: Resolution was adopted. RESOLUTION NO. R- 2009 -152 *17. Consideration of a Resolution authorizing execution of an agreement modification to the Dial -A -Ride contract and vehicle lease with A -1 Tri -City Taxi, Inc. ACTION: Resolution was adopted. RESOLUTION NO. R- 2009 -153 *18. Consideration of a Resolution authorizing purchase of property at 3rd and Walnut Street ACTION: Resolution was adopted. RESOLUTION NO. Consideration of a Resolution authorizing execution of the 2009 -2012 Collective Bargaining Agreement between the City of Yakima and the Yakima Police Management Unit ACTION: Resolution was adopted. First reading of an Ordinance amending the 2009 Budget in the 152 - Police Grants Fund for criminal justice expenditures supported by the 2009 Byrne Justice Assistance Grant for a local law enforcement program ACTION: Ordinance read by title only; second reading scheduled for December 1, 2009 5
