1. Roll Call
All Council members were present. Staff included City Manager Zais, City Attorney
Cutter and City Clerk Moore
2. Invocation /Pledge of Allegiance
Assistant Mayor Cawley gave an invocation and led the Pledge of Allegiance
3. Open Discussion for the Good of the Order
A. Proclamations
• Crime Stoppers Day
Council Member Ensey read a proclamation declaring August 4, 2009 as Crime
Stoppers Day. Mark Peterson & Dave Purcell accepted the proclamation.
• National Health Center Week
Mayor Edler read a proclamation declaring the week of August 19 -25 as
National Health Center Week. Don Hinman accepted the proclamation.
B. Presentations /recognitions /introductions — None
C. Status report on prior meeting's citizen service requests — None
D. Appointments to Boards, Commissions and Council Committees

ACTION: Motion carried to appoint Martin Chacon. VOTE: Unanimous
4. Consent Agenda
ACTION: Motion carried to adopt the consent agenda as read. VOTE:
Unanimous
*A. Consideration of approval of Council Minutes
• Special, Adjourned and Business meetings — July 21, 2009
ACTION: Council minutes were approved.
*B. Consideration of approval of Council Committee Meeting Minutes
• Rules and Procedures Committee — July 16, 2009
• Downtown Futures Committee — July 22, 2009
ACTION: Council committee meeting minutes were approved.
5. Audience Participation
Robert Owen raised the issue of noise in his neighborhood due to the National
Night Out function held at Miller Park.
Cindy Hill spoke in support on the lane diet on Summitview Avenue between 72n
and 96 Avenues.
CITY MANAGER'S REPORTS
6. Consideration of recommendation from the Council Transit - Transportation
Committee regarding traffic revisions on Summitview Avenue
Joe Rosenlund, Street and Traffic Operations Manager, reviewed the three options
that were presented to the Transit and Transportation Committee. ACTION:
Motion carried to adopt Option B — split phase operation allowing a left/thru -left
lane usage westbound. VOTE: Unanimous
7. Consideration of recommendation from the Council Downtown Futures Committee
regarding participation with Yakima County for Second Street park project and
County Courthouse sidewalk improvements
City Manager Zais explained the background and recommendation from the
Council Downtown Futures Committee.
ACTION: Motion carried to support Option 2 — improvements around the park
and the 2n Street side of the Courthouse to Martin Luther King Boulevard.
VOTE: 6 -1, Cawley voting no
*8. Consideration of a Resolution ordering a segregation of the special assessments
in Local Improvement District (LID) No. 1057 pursuant to RCW 35.44.410 against
a parcel of land that was designated as Parcel No. 181319 -14001 and is included
in LID No. 1057
ACTION: Resolution adopted. RESOLUTION NO. R- 2009 -108
*9. Consideration of final contract payment for North Hillcrest, Hillcrest and Buena
Vista irrigation system improvement
ACTION: Final contract payment approved.
*10. Consideration of final contract payment for Tieton Drive pedestrian safety project
ACTION: Final contract payment approved.
*11. Set date of August 18, 2009 for a "Closed Record" public hearing to consider the
preliminary plat of Toscanna, Phase 1 and an "Open Record" public hearing on a
proposed development agreement for a master planned development
ACTION: August 18, 2009, was set as the date of public hearings.
*12. Set date of public hearing for September 1, 2009 to receive public testimony
regarding Initiative 1033
ACTION: September 1, 2009, was set as the date of public hearing.
*13. Set date of public hearing for August 18, 2009 to receive public testimony on
0.3% sales tax ballot issue
ACTION: August 18, 2009, was set as the date of public hearing.

ORDINANCES
*14. Consideration of an Ordinance relating to Police Chief — Limited Commissions;
adding a limited commission to enforce 6.27 of the Yakima Municipal Code by
amending Section 1.48.026 of the Yakima Municipal Code
ACTION: Ordinance was passed. ORDINANCE NO. 2009 -38
*15. Consideration of an Ordinance related to Stormwater Illicit Discharge — revising
two provisions in Chapter 7.85 and specifically amending Yakima Municipal Code
Sections 7.85.060(B) and 7.85.170(A)
ACTION: Ordinance was passed. ORDINANCE NO. 2009 -39
16. Other Business
Connie Little asked about the plans and funds submitted toward an aquatics
center. Chris Waarvick, Public Works Director, said the $1,000 has been
deposited into an account earmarked for the aquatics project. He said the Parks
Commission is working to put together a smaller vision to address the lack of
neighborhood pools
City Manager Zais reminded Council and the public that it is National Night Out.
Council Member Rodriguez expressed her concern about the growing gang
violence in the city and questioned how the Council could intervene in the
problem. After much discussion Council Member Coffey asked Council if they
would be willing to hold a special meeting, if they were able to free up some
funding.

ACTION: Motion carried to adjourn to August 18, 2009 at 6:00 p.m. VOTE:
Unanimous
