A RESOLUTION authorizing the City Manager to execute Supplement No. 2 of the
Professional Services Agreement with Conley Engineering, Inc. for
engineering services required to review the submitted materials and
provide inspections services for the City Facilities Lighting Project.
WHEREAS, in September, 2010, the City contracted with Conley Engineering, Inc. for
professional services required for the design of the City Facilities Lighting Upgrade project; and
WHEREAS, additional engineering and consulting services are required to review the
materials submitted to be used and to provide inspection services; and
WHEREAS, it is requested that the City Manager have the authority to execute a
supplemental agreement for additional engineering and consulting services to ensure that the
specified materials are used and installed correctly; and,
WHEREAS, the City Council deems it to be in the best interests of the City to authorize
the City Manager to execute a supplemental agreement with Conley Engineering, Inc. for
additional engineering and consulting services to review the materials submitted to be used and
to provide inspection services; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute an supplemental agreement number
2 with Conley Engineering, Inc., for additional engineering and consulting services to review the
materials submitted to be used and to provide inspection services, as detailed in the attached
memorandum from Conley labeled "Exhibit A ". The total additional compensation authorized by
said supplement shall not exceed $7,660. The form of said supplemental agreement shall be
reviewed and approved by the City Attorney or his designee.

desires to supplement the agreement entered into with Conley Engineering, Inc.
and executed on 9 -21 -2010 and identified as Agreement No. 2010 -80
All provisions in the basic agreement remain in effect except as expressly.modified by this supplement.
The changes to the agreement are described as follows:

Section 1, SCOPE OF WORK, is hereby changed to read:

Section IV, TIME FOR BEGINNING AND COMPLETION, is amended to change the number of calendar days for
completion of the work to read: The time for nompletion is extended to 17/3 1/701 1

Section V, PAYMENT, shall be amended as follows:
The maximum amount payahle shall he increased hy $7,660 to a maximum amount of VR 660
as set forth in the attached Exhibit A, and by this reference made a part of this supplement.

Thank you for the opportunity to provide our electrical engineering services for the Construction
Phase of the City Facilities Lighting Upgrade Project located in Yakima, Washington. Based on
a conversation with you, we have been tasked to complete construction administration services
for the following areas:
o City Hall, 129 N. 2 St.
o Y- PAC/YCTV, 124 S. 2 St.
o Fire Station 94, 2404 W. Washington Ave.
o Fire Station 95, 807 E. Nob Hill Blvd.
o Public Works Complex, 2301 Fruitvale Blvd.
o SE Community Center, 1211 S. 7 St.
We have based our proposal on the following scope of services:

Scope of Services:
The following tasks are to be performed at each of the six locations as described above:
Task 1 Submittal review of the lighting fixtures being supplied by the Contractor for
each facility. This may include a second submittal review depending on
whether the Contractor will need to resubmit on some of the lighting fixtures.
Task 2 Two site visits to each site to review the intermediate and final progress of
construction. This would include writing field observation reports as well as
preparation of electrical punchlists.
Task 3 Responding to Contractor questions during the course of construction.
Each task will be completed by the Engineer in the timeframe agreed to by the City and Conley
Engineering and shall begin on the date agreed to by the City and Conley Engineering following
written authorization to proceed.

ITEM TITLE: Consideration of a Resolution authorizing the City Manager to execute
Supplement No. 2 of the Professional Services Agreement with Conley
Engineering, Inc. for engineering services to review the submitted materials and
provide inspection services for the contract that will upgrade the existing lighting
features in several city buildings.

SUMMARY EXPLANATION:
The City has engaged Conley Engineering, Inc. to provide the electrical engineering required to
design the plans, specifications and estimate for the American Recovery and Reinvestment Act
(ARRA) Energy Recovery Grant. Since the City doesn't employ an electrical engineer, staff
recommends that a supplement be made to the consultant agreement to allow for Conely
Engineering, Inc. to review the materials submitted by the Contractor and provide inspection
services. This will ensure that the new lighting fixtures meet the specifications listed in the
0 contract and that they are installed properly. The cost to perform the work required in this
supplement is in an amount not to exceed $7,660, bringing the total amount of the professional
service agreement to $28,560.
City Facilities that will receive lighting upgrades and the amounts estimated are:

• YPAC Building - $7,576
• Fire Station 94 - $7,337
