Roll Call All Council members were present. 2. Executive Session: Council adjourned to Executive Session for one hour to discuss Collective Bargaining and Prospective Litigation. * * * * * * * * ** ACTION ON YAKIMA CITY COUNCIL BUSINESS MEETING JANUARY 20, 2009 – 6:00 P.M. COUNCIL CHAMBERS – YAKIMA CITY HALL 1. Roll Call All Council members were present. Staff included City Manager Zais, Acting City Attorney Cutter and City Clerk Moore. 2. Invocation /Pledge of Allegiance Assistant Mayor Cawley gave an invocation and led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamations -None B. Special presentations / recognitions • Special recognition of Officer Sam Masters for receiving the Washington Council of Police and Sheriffs Officer of the Year award Council recognized Police Officer Sam Masters for his award, which he received for intervening in the attempted murder of another officer. • Council recognized Sean Hawkins for his service to the community with the Committee for Downtown Yakima. C. Status report on prior meeting's citizen service requests —None D. Appointments to Boards and Commissions —None 4. Consent agenda Items 6, 7 and 12 were removed from the agenda. ACTION: Motion carried to approve the Consent Agenda as amended. VOTE: Unanimous 5. Audience Participation —None 7:00 PM — PUBLIC HEARINGS 6- Joint City County Open Record Public Hearing to consider the Regional Planning Commission's recommendation on the proposed Adult Business Ordinance Joint Public Hearing with Yakima County to consider requests to amend the Comprehensive Plan (pl ase bring material previously furnished): • Amend zoning at 1023 South 32" Avenue to Local Business (B 2), requested by Heidi Anderson • Amend zoning at 22 Ranchrite Road to Central Business District Support (CBDS), requested by Larry D an Hull • Amend zoning at 1019 & 1021 S. 10 Avenue to Local Business (B 2), requested by Maria E. Chavez 8. Closed Record Public Hearing to consider the preliminary plat/planned development of Hidden Lakes subdivision located in the vicinity of West Washington and 72nd Avenues, submitted by Teammates, LLC The public hearing was held. ACTION: Resolution adopted. RESOLUTION NO. R- 2009-06. VOTE: Unanimous 9. Open Record Public Hearing on the execution of a development agreement with Teammates, LLC to construct a single - family residential subdivision /master planned development located in the vicinity of West Washington and 72nd Avenues (See Resolution) The public hearing was held. ACTION: Resolution adopted. RESOLUTION NO. R- 2009-07. VOTE: Unanimous 10. Closed Record Public Hearing on the appeal by Envizage Development Group of the Hearing Examiner's decision on the Toscana Project in the vicinity of Castlevale Road and Seattle Slew Run Council Member Rodriguez recused herself from the public hearing since she lives in the area and believed she could not vote objectively. The public hearing was held. The majority of citizens who spoke were against the project. ACTION: Motion carried to adopt the Hearing Examiner's decision to deny the project. VOTE: 4 -2, Edler and McClure voting no. (Rodriguez absent). CITY MANAGER'S REPORTS 11. Consideration of staff report regarding cemetery operations and monument sale proposal ACTION: Motion carried to not consider the sale of monuments. VOTE: 6 -1, McClure voting no. *12. Consideration of a-Resolution naming Yakima's new skate park Apple Valley Kiwanis Skate Park in Memory of Lee Paggett *13. Consideration of a Resolution adopting a City Identity Theft Prevention Program for the Utilities Division 2 ACTION: Resolution adopted. RESOLUTION NO. R- 2009 -08 *14. Consideration of a Resolution authorizing execution of an agreement with Yakima Basin Storage Alliance concerning services to advance the Black Rock Reservoir Project ACTION: Resolution adopted. RESOLUTION NO. R- 2009 -09 *15. Consideration of a Resolution authorizing execution of an agreement with the Greater Yakima Chamber of Commerce for the purpose of developing strong leadership resources and to gain citizen pride and visitor appreciation for having a clean city and improvement in the quality of like in Yakima ACTION: Resolution adopted. Consideration of a Resolution authorizing execution of an agreement with the Hispanic Chamber of Commerce of Yakima County for the purpose of fostering community economic development in Yakima ACTION: Resolution adopted. Consideration of a Resolution authorizing execution of an agreement with the Yakima Sunfair Festival Association for tourist promotion services for the 2009 Sunfair Parade ACTION: Resolution adopted. Set date of public meeting for February 3, 2009 to consider the final plat approval for Scenic Plateau Subdivision located in the vicinity of 72n Avenue and Englewood Avenue ACTION: February 3, 2009 was set as the date of public meeting to consider the final plat of Scenic Plateau Subdivison — Phase II. *29. Set date of open record public hearing for February 3, 2009 to consider the Hearing Examiner's approval of the vacation of public rights -of -way submitted by Noel Properties, LLC in the alley located west of Naches Avenue between LaSalle Street and south of Rainier Street, and an undeveloped portion of LaSalle Street west of Naches Avenue ACTION: February 3, 2009 was set as the date of open record public hearing to consider the Hearing Examiner's approval of the vacation of public rights -of -way. *30. Set date of open record public hearing for February 3, 2009 to consider the Hearing Examiner's approval of a vacation of two portions of public right -of -way in the vicinity of 207 East "S" Street submitted by Dean Owens ACTION: February 3, 2009 was set as the date of open record public hearing to consider the Hearing Examiner's approval of a vacation of two portions of public right -of -way. 4 ORDINANCES *31. Consideration of an Ordinance repealing the Volunteer Firefighters Relief and Pension Fund and Volunteer Firefighters Pension Board amending sections of Chapter 1.91 of the Yakima Municipal Code and repealing Section 1.91.050 ACTION: Ordinance passed. ORDINANCE NO. 2009 -03 32. Other Business • Discussion regarding moving the February 17, 2009 City Council meeting to another date ACTION: Motion carried to move the February 17, 2009 Council meeting to February 24, 2009. VOTE: Unanimous • Mayor Edler asked to expand the future study session on the aquatics center to include discussion on possible closure of Franklin and Lions pools. ACTION: Motion carried to expand the aquatics center study session to include the possible closure of Franklin and Lions Pools. VOTE: Unanimous 33.
