F or Meeting of: August 4, 2020 I T E M T IT L E :Resolution authorizing an Asset Forfeiture Memorandum of Understanding with United States Department of J ustice S UB M IT T E D B Y:Matthew Murray, Chief of P olice B ronson F aul, S enior A ssistant City A ttorney S UM M ARY E X P L ANAT I O N: The City of Yakima and the United States Department of J ustice, through their law enforcement agencies, have maintained a cooperative working agreement designed to combat controlled substance traffic within the City of Yakima. The Drug E nforcement A dministration A sset F orfeiture Sharing Memorandum of Understanding sets forth the requirements for participation in the federal Equitable S haring P rogram and restrictions upon the use of federally forfeited cash, property, proceeds, and any interest earned which are equitably shared with the participating law enforcement agency. T his Memorandum of Understanding is a modification to the agreement approved by City Council on February 18, 2020. A copy of the agreement is on file in the City Clerk's office. R-2020- RESOLUTION authorizing the City Manager and the Chief of Police of the City of Yakima to execute an Asset Forfeiture Sharing Memorandum of Understanding with the United States Department of Justice WHEREAS, the City and the United States Department of Justice through their law enforcement agencies have maintained a cooperative working agreement designed to combat controlled substance traffic within the City of Yakima; and WHEREAS, the agreement sets forth the requirements for participation in the federal Equitable Sharing Program; and WHEREAS, the agreement sets forth the restrictions upon the use of federally forfeited cash, property, proceeds, and any interest earned which are equitably shared with the participating law enforcement agency; and, WHEREAS, the City Council deems it to be in the best interest of the City to approve the agreement, now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and the Chief of Police of the City of Yakima are hereby authorized and directed to sign the Asset Forfeiture Sharing Memorandum of Understanding with the United States Department of Justice, which is hereby incorporated by reference.
