There will be no opportunity for oral communications at this meeting; however if you wish to provide written comment to the City Council, please email ccouncil2@yakimawa.gov. Written comments received by 3 pm on June 2 -will be provided to the City Council prior to the meeting. MINUTES EXECUTIVE SESSION 1. Executive Session to review the performance of a public employee Council: Mayor Patricia Byers, presiding, Assistant Mayor Holly Cousens, Councilmembers, Kay Funk, Brad Hill, Soneya Lund, Eliana Macias and Jason White (all members attending via speakerphone with the exception of White and Funk) MOTION: Cousens moved and Funk seconded to adjourn to Executive Session for up to one hour to review the performance of a public employee and to discuss pending litigation. The motion carried by unanimous vote. At 5:35 p.m. Mayor Buyers extended the Executive Session for another 15 minutes. Executive Session was held and adjourned at 5:44 p.m. 1. Roll Call Council: Mayor Patricia Byers, presiding, Assistant Mayor Holly Cousens, Councilmembers, Kay Funk, Brad Hill, Soneya Lund, Eliana Macias and Jason White (all members attending via speakerphone with the exception of White and Funk) Staff: Interim City Manager Alex Meyerhoff, City Attorney Jeff Cutter and City Clerk Sonya Clear Tee 2. Open Discussion for the Good of the Order A. Coronavirus (COVID-19) update Interim City Manager Meyerhoff provided an update on COVID-19's effect on City services and finances, as well as information related to eligibility for CARES Act Coronavirus Relief Funding. Steve Groom, Director of Finance and Budget, discussed the severity of COVID-19 impacts on City revenues. B. Proclamations Missing Persons Awareness Month proclamation Page 1 of 5 183 184 Councilmember Macias proclaimed May 2020 as Missing Persons Awareness Month. 3. Council Reports A. Tentative Resolution approving extension of Mayoral Proclamation declaring emergency and order, if the Mayor issues a Proclamation extending the civil emergency proclamation and order due to COVID-19 Interim City Manager Meyerhoff briefed Council on the item and explained a revised proclamation and resolution was sent to Council today, which is now under consideration. Mayor Byers explained the declaration is an administrative tool for the City to apply for emergency funding and get supplies needed due to the pandemic. Councilmember White stated the proclamation is not relevant and that the City would still qualify for funding. The City Clerk read the resolution by title only. MOTION: Funk moved and Hill seconded to adopt the resolution. The motion carried by a 6-1 vote, White voting no. RESOLUTION NO. R-2020-058, A RESOLUTION extending the Mayor's Proclamation of Civil Emergency and Order regarding a state of emergency in the City of Yakima due to the coronavirus disease 2019 ("COVID-19"). B. Tentative Resolution ratifying Mayoral Proclamation and Order of a temporary moratorium due to COVID-19 on the enforcement of certain provisions in YMC 9.47 relating to parking violations for unlicensed vehicles and for 24-hour parking Interim City Manager Meyerhoff briefed Council on the item and explained a revised proclamation and resolution was sent to Council today, which is now under consideration. The City Clerk read the resolution by title only. MOTION: Funk moved and Hill seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. RESOLUTION NO. R-2020-060, A RESOLUTION ratifying Mayoral Proclamation of Emergency and Recommendation on Wearing Masks 4. Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Item #5 was added to the Page 2 of 5 185 consent agenda becoming item 4H. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Hill moved and Cousens seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the May 19, 2020 City Council regular meeting B. TENTATIVE - Set date of July 7, 2020 to consider the Planning Commission's recommendation regarding the preliminary plat of Rainier Court Phases 2, 3, and 4, located in the vicinity of N 92nd Ave and Summitview Ave C. Resolution setting the time and place for a hearing on June 16, 2020 to review and adopt the Six-year Transportation Improvement Program and amend the Capital Facilities Element of the Yakima Urban Area Comprehensive Plan for the period of 2021 to 2026 RESOLUTION NO. R-2020-061, A RESOLUTION setting the time and place for a hearing on June 16th, 2020 in the city of Yakima Council Chambers to review and adopt the Six-year Transportation Improvement Program and amend the Capital Facilities Element of the Yakima Urban Area Comprehensive Plan for the period of 2021-2026. D. Resolution authorizing a contract with Belsaas & Smith Construction, Inc. for Project No. 2487B Fair Avenue Sanitary Sewer Improvements Phase B RESOLUTION NO. R-2020-062, A RESOLUTION authorizing a contract with Belsaas & Smith Construction, Inc. for City of Yakima Project No. 2487B Fair Avenue Sanitary Sewer Main Improvements Phase B. E. Resolution approving BJA FY 20 Coronavirus Emergency Supplemental Program RESOLUTION NO. R-2020-063, A RESOLUTION authorizing acceptance of grant funding of up to $167,075.00 in COVID-19 response cost reimbursement to benefit the Yakima Police Department from the Department of Justice (DOJ), Office of Justice Programs (al P) for BJA FY 20 Coronavirus Emergency Supplemental Program. F. Resolution ratifying the Interim City Manager's execution of a grant application to the Washington State Department of Commerce for funding to support Group Violence Intervention Strategies RESOLUTION NO. R-2020-064, A RESOLUTION ratifying the Interim City Manager's execution of a grant application to the Washington State Department of Commerce for funding to support Group Violence Intervention Strategies. G. Ordinance relating to traffic; amending the City of Yakima Municipal Code, Chapter 9.47, Vehicle Impounds ORDINANCE NO. 2020-013, AN ORDINANCE amending the City of Yakima Municipal Code Section 9.47.072 entitled Towing and impound of unlicensed vehicle. H. Ordinance amending the 2020 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2020 for various purposes (First Reading) Page 3of5 186 First reading of an ordinance amending the 2020 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2020 for various purposes described in the attached Schedule. DEPARTMENT ITEMS 5. This item was added to the consent agenda becoming item 4H 6. Reconvening City of Yakima committees and commissions Assistant City Attorney Sara Watkins briefed Council on the issue. After Council discussion, Ms. Watkins stated staff is happy to facilitate a telephonic or online type of meeting should it be needed for the Planning Commission or other committees. Mayor Byers encouraged the new Planning Commission members to take online training. 7. Resolution facilitating use of public spaces to accommodate restaurants and bars during COVID-19 emergency Sara Watkins, Senior Assistant City Attorney, briefed Council on the resolution. The City Clerk read the resolution by title only. After Council discussion, MOTION: Hill moved and Lund seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2020-065, A RESOLUTION waiving permit fees for sidewalk cafes and modifications converting private parking spaces into outdoor dining areas, pursuant to the declaration of emergency, as extended. Summary of Home Occupation Permitting Process and Background Joseph Calhoun, Planning Manager, briefed Council on the summary. Councilmember White reviewed 13 issues he has with the Occupational Permitting Process. After Council discussion, MOTION: Funk moved and White seconded to direct staff to work with the Planning Commission to review home occupation conditions as driven by requests and accumulate any correspondence coming in through the City Council or permit process. The motion carried by unanimous vote. Ordinance repealing City of Yakima Municipal Code Chapter 9.25 Cruising Control Chief Murray briefed Council on the Police Departments public safety and staffing concerns. Community Development Director Joan Davenport informed Council that there are other events approved on Saturdays through the application process, and allowing cruising every Saturday will interfere with other scheduled events. After Council discussion, MOTION: Cousens moved and Byers seconded to delay the discussion on cruising until after the city meetings reopen to the public. The motion failed by a 4-3 vote with Funk, White, Hill and Macias voting no. MOTION: White moved to repeal Municipal Code Chapter 9.25 Cruising Control. The motion died for lack of a second. MOTION: Hill moved and White seconded to change the existing ordinance to allow Page 4 of 5 cruising every Saturday during the 4 months that are currently allowed. MOTION: Lund moved to amend the motion to limit cruising to every Saturday in the month of June. After discussion, the motion to amend died for lack of a second.The motion carried by a 4-3 vote with Funk, Lund, and Macias voting no. City Clerk Claar Tee clarified that an ordinance amendment would be brought back at the next Council meeting; however, if approved, it would not take effect until July 19. 10. Other Business Councilmembers voiced their support of the Mayor joining the Yakima Valley Mayor's Coalition. Assistant Mayor Cousens stated she would like to see the City of Yakima have a communication pop-up tent at the Farmers Market to distribute information on COVID and other things such as boards and commissions in both English and Spanish. Interim City Manager Meyerhoff will discuss this possibility with the Downtown Association of Yakima. MOTION: Funk moved and Macias seconded that we put on the agenda of the next City Council meeting, discussion of a Truth and Reconciliation process for policing. The motion carried by unanimous vote. MOTION: Macias moved and Hill seconded to raise a Pride flag on City Hall during the month of June. After discussion, the motion carried by a 4-3 vote with White, Hill and Byers voting no. 11. Adjournment MOTION: Cousens moved and Macias seconded to adjourn to the next Council regular meeting on June 16, 2020, at 5:30 p.m. in the Council Chambers at City Hall.
