SUBMITTED BY: Joan Davenport, Acting Director of Community and Economic Development CONTACT PERSON/TELEPHONE: Joseph Calhoun, Assistant Planner, 575 -6162 SUMMARY EXPLANATION: Mountain View Estates is a 20 -lot Preliminary Plat in the vicinity of West Chestnut and 67 Avenues. The Hearing Examiner issued his written recommendation for approval of this application, subject to conditions, on August 26, 2010. City Council approved the Preliminary Plat of Mountain View Estates on October 19, 2010 (Resolution R- 2010 -119). All required improvements have been completed and /or bonded for. BOARD RECOMMENDATION: City Council. granted Preliminary Plat approval on October 19, 2010. COUNCIL ACTION: • • RESOLUTION NO. R -2011- A RESOLUTION approving the final plat of Mountain View Estates and authorizing the Mayor to sign the final plat. WHEREAS, the preliminary plat of Mountain View Estates, a 20 -lot subdivision, was submitted by DMF Investments (PLP #003 -10, SEPA #019 -10); and, WHEREAS, on August 12, 2010, the Hearing Examiner held a public hearing to consider the preliminary plat; and, WHEREAS, on August 26, 2010, the Hearing Examiner issued his Recommendation for approval of the proposed plat subject to several conditions; and WHEREAS, at a closed record public hearing on October 5, 2010, the City Council determined by motion that the Recommendation of the Hearing Examiner should be affirmed and adopted; and WHEARAS, at its meeting on October 19, 2010, the City Council adopted a Resolution (R- 2010 -119) to that effect; and, WHEREAS, the City Engineer has approved and accepted all plans and designs for the improvements required in the conditions of approval of the preliminary plat, and the applicant has constructed or financially secured (bonded) all such improvements; and • WHEREAS, as this final plat comes before City Council for review, each member declares that he has had no contact with either the applicant or opponents of the final plat, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The proposed final plat of Mountain View Estates, consisting of two sheets depicting a subdivision located in the vicinity of Chestnut and 67 Avenues, is hereby approved and the mayor is hereby authorized to sign the final plat. The applicant shall file the final plat of Mountain View Estates for record in the Yakima County Auditor's Office immediately, or as soon thereafter as possible, and the applicant shall be responsible for all filing fees. Staff Contact: . Known as Mountain View Estates ) Joseph Calhoun, ) Assistant Planner ) (509) 575 -6162 BACKGROUND AND SUMMARY OF REQUEST • Mountain View Estates is a 20 -lot subdivision which was recommended for approval by the Hearing . Examiner on August 26, 2010. The Yakima City Council held a public hearing on October 5, 2010 to review the preliminary plat and the hearing examiner's recommendation. It was motioned to approve the plat. The plat was approved by Resolution No: R- 2010 -119 on October 19, 2010. (Yakima City Planning file numbers: PLP #003 -10, SEPA #019 -10). The City Engineer's office' has reviewed and approved all necessary designs and engineering and indicates that the required improvements are installed and inspected or that the required financial security . is in place to secure their installation. The City Engineer has signed the plat in affirmation of this fact. The Planning Division has similarly reviewed the final plat and found it to be in substantial conformance • with the terns and conditions of the preliminary plat approval. The Planning Manager has signed the • final plat. . CONDITIONS OF APPROVAL The approved preliminary plat required the applicant to complete all site improvements listed as conditions in the Hearing Examiner's Recommendation of August 26, 2010. The conditions that must be met before the final plat can be approved consist of the following matters: • • 1. A current title certificate shall be submitted to the City Department of Community and Econoinic • . Development, consisting of a report listing all parties having an interest in the "land" to be divided • and a legal description of the "land ". Status: Achieved 2. The developer shall dedicate and develop the street right -of -way necessary for the development of the preliminary plat of Mountain View Estates pursuant to Chapter 12.06 of the Yakima Municipal Code. Status: Achieved (pending Final Plat recording) 3. Civil Engineered design plan for sanitary sewer shall be submitted and approved by the City of Yakima Engineer and installed, or bonded for, pursuant to Chapter 12.03 of the Yakiina Municipal Code prior to final plat approval. • II Status: Achieved . .. . . 1 . . • • 4. Sanitary sewer extension shall be required to the east and west in Chestnut Avenue. Extension to the • north, if required, will be determined by Wastewater and Engineering. Status: Achieved 5. Complete stormwater design plans, specifications and runoff /storage calculations supporting the stormwater design are required pursuant to the Eastern Washington Stormwater Manual and City of Yakima standards. These plans and control measures must be reviewed and approved by the City of Yakima Surface Water Engineer prior to construction. UIC wells, if used, shall be registered with DOE. Status: Achieved 6. All domestic water for this development shall be installed to City of Yakima and Nob Hill Water standards. Waterlines are required to be extended and looped throughout the proposed subdivision. Waterlines shall be installed, or bonded for, pursuant to Chapter 12.04 of the Yakima Municipal Code prior to final plat approval. Status: Achieved 7. The existing 8 -inch waterline in Chestnut Avenue shall be extended from approximately 68th Avenue to 66 Avenue. In addition, the existing lines in 66 Avenue and 67 Avenue shall be tied into the new line. Status: Achieved - • 8. Relocation of the existing County DID line on the property (DID #38) will require a new easement. The applicant shall work with Yakima County to relocate the line. Evidence of the relocation, by way of a signed agreement between the applicant and Yakima County, shall be submitted prior to approval. Status: Achieved 9. The hammerhead turn- arounds shall be marked with permanent "NO PARKING -FIRE LANE" signs complying with Section D103.6 and D 103.6.1 and 2 of the 2006 IFC. Status: Achieved 10. Erosion control measures shall be installed and in place prior to clearing, grading, or construction in accordance with the Washington State Department of Ecology's Erosion Sediment Control Plan regulations. Status: Achieved 11. A construction dust control plan shall be filed with, and approved by, the Yakima Regional Clean Air Agency. Status: Achieved 12. Minimum eight- foot -wide utility easements must be dedicated along the frontage of each lot in the subdivision pursuant to Section 12.02.020 of the Yakima Municipal Code. Easements for new and /or 2 • • future utility lines shall be a minimum of eight feet in width, or twice the buried depth, whichever is greater. Status: Achieved 13. Frontage improvements shall be installed according to Title 12 standards on the interior streets and along the Chestnut Avenue frontage. The improvements shall be installed, or bonded for, prior to final plat approval. Status: Achieved 14. Status: Achieved 15. The final plat shall contain all requirements of Section 14.20.020 of the Yakima Municipal Code along with all applicable conditions. Status: Achieved FINDINGS 1. The final plat is in general conformance with the preliminary plat and conditions of approval. 2. The applicant has built or financially secured the construction of the required improvements necessary for final plat approval. RECOMMENDATION The City of Yakima, Department of Community and Economic Development, Planning Division, • recommends that City Council accept the final plat of Mountain View Estates and pass the resolution which authorizes the Mayor to sign the final plat. • • 3
