ITEM TITLE: Ordinance relating to traffic; amending the City of Yakima Municipal
Code, Chapter 9.47, Vehicle Impounds

SUMMARY EXPLANATION:
The City of Yakima Municipal Code Chapter 9.47, "Vehicle Impounds" covers different types of
vehicles and when they may be impounded. The proposed ordinance would amend Chapter
9.47.072, "Unlicensed Vehicles", and provide 48 hours notice to vehicle owners that their
unlicensed vehicle may be towed. This provides code enforcement officers the ability to use
their discretion when considering impoundment and reasonable alternatives to impound. The
amendment would alleviate citizen complaints that they had no notice of the impoundment. The
ordinance would also include the procedure for contesting a tow impound. Allowing the City to
impound vehicles that are parked on the roadway and are unlicensed will enhance overall quality
of life and preserve the public peace, health, safety and economic welfare of the City of Yakima.

ORDINANCE NO. 2020-
AN ORDINANCE amending the City of Yakima Municipal Code Section 9.47.072 entitled
Towing and impound of unlicensed vehicle.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 9.47.072 of the Yakima Municipal Code is hereby amended to read as
follows:
9.47.072 Towing and impound of unlicensed vehicle.
Any unlicensed vehicle parked on a public street or parking lot within the City of Yakima chall
may be towed and impounded at owner's risk and expense by a registered tow truck operator,
after the owner is provided forty-eight hours notice of impoundment, at the direction of a law
enforcement officer or an authorized designee. The procedure for contesting or redeeming an
impounded vehicle shall be the same as stated in 9.47.040.
Section 2. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

follows:
9.47.072 Towing and impound of IJunlicensed Vvehicle.
Any unlicensed vehicle parked on a public street or parking lot within the City of Yakima chall
may be towed and impounded at owner's risk and expense by a registered tow truck operator,
