Roll CaII Present: Council: Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey, Council Members Maureen Adkison, Dave Edler, Rick Ensey, Dave Ettl and Bill Lover 2. Executive Session • Prospective and Pending Litigation Executive Session was held and adjourned at 5:44 p.m. 6:00 P.M: — BUSINESS MEETING 1. Roll CaII Present: Council: Mayor Micah Cawley, presiding, Assistant Mayor Kathy Coffey, Council Members Maureen Adkison, Dave Edler, Rick Ensey, Dave Ettl and Bill Lover Staff: City Manager Zais, City Attorney Cutter and City Clerk Kloster 2. Pledge of Allegiance Mayor Cawley led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamations 1. Cinco de Mayo Cultural Awareness Week Assistant Mayor Coffey read a proclamation declaring May 1 -8 as Cinco de Mayo Cultural Awareness Week. Maria Garcia and Nestor Hernandez accepted the proclamation and Miss Cinco de Mayo candidates introduced themselves. 2. National Poetry Month ' Cheryl Hahn described events that are taking place on the YVCC campus this month. She gave each Council Member a book of poems. Mayor Cawley read a short poem and a proclamation. Council Member Ettl read a poem dedicated to John Cooper (YVCB). Mr. Cooper noted National Poetry Month is sponsored by the City's. Arts Commission and gave an update on other Arts Commission activities. B. Presentations /recognitions /introductions 1. Recognition of retiring Reserve Police Officer Mel McGuire Acting Police Chief Copeland recognized Mel McGuire for his 23 years of service as a volunteer Police Reserve Officer. City Manager Zais presented him with an official City of Yakima watch thanking him for his service. APRIL 5, 2011 2. Recognition of Airport Board Representative Tom Holbrook Mayor Cawley recognized Tom Holbrook for his service to the community as the City's representative on the Yakima Air Terminal Board for four years. C. Status reports on prior meeting's citizen service requests 1. Update on request from Sandy Massong -Lloyd regarding Arlington Street Deferred until after Mayor Cawley meets with Ms. Massong -Lloyd 2. Response to Tony Courcy regarding zoning Bruce Benson responded there was no impact to Mr. Courcy's property when the zoning was changed. 3. Report regarding Yakima Indoor Soccer Association code issues Michael Morales reviewed the building owner's non - compliance issues. The code issues were resolved and the request to waive the requirement to employ CWI to monitor all functions was granted. D. Appointments to Boards, Commissions and Council Committees ACTION: Motion carried to appoint Mayor Cawley, Assistant Mayor Coffey and Council Member Adkison to a committee to study the Regional Fire Authority. VOTE: Unanimous 4. Consent Agenda ACTION: Item No. 13 was added to the Consent Agenda. A motion carried to adopt the Consent Agenda as read. VOTE: Unanimous *A. Consideration of approval of City Council Meeting Minutes 1. Business Meeting — February 15, 2011 ACTION: Council meeting minutes were approved B. Consideration of approval of Council Committee Meeting Minutes *1. Economic Development Committee — March 2, 2011 *2. Gang Free Initiative Committee — March 3, 2011 *3. Intergovernmental Committee — March 8, 2011 4. Public Safety Committee — March 16, 2011 a. Report on possibilities for additional community service for city properties Chris Waarvick outlined the possibilities to engage volunteers from community groups and City and County court- ordered community service for parks clean up. He introduced Archie Mathews and John Zabell from ONDS who run the program. b. Consideration of a Resolution adopting a policy for "Trespassing" Qualifying covered Level 2 and 3 sex offenders from the legal premises of City public swimming pools Chris Waarvick, Cynthia Martinez and Greg Copeland reviewed provisions of the legislation that allowed cities to deal with this type of situation. It 2 APRIL 5, 2011 was noted that Yakima would be the first city in Washington to implement this legislation. ACTION: Resolution adopted. VOTE: Unanimous. RESOLUTION NO. R- 2011 -44 ACTION: Council Committee meeting minutes were approved. VOTE: Unanimous 5. Audience Participation -- None CITY MANAGER'S REPORTS 6. Consideration of a Resolution authorizing execution of a contract with a company to be determined for City Manager recruitment services Mayor Cawley advised three interviews were held that afternoon. City Manager Zais said a portion of the funding to hire the search firm would come from salary savings and the City's contingency fund. ACTION: Colin Baezinger and Associates was chosen as the search firm. The Resolution was adopted. VOTE: Unanimous. RESOLUTION NO. 2011 -45 *7. Consideration of the 2010 Year -end Budget Report from Finance Department ACTION: The 2010 Year -End Budget Report was approved. *8. Consideration of a Resolution authorizing execution of an amendment to an interlocal jail agreement with Yakima County ACTION: Resolution was adopted. RESOLUTION NO. R- 2011 -46 *9. Consideration of a Resolution authorizing sole source purchase of Stagecraft products for the Yakima Convention Center ACTION: Resolution was adopted. RESOLUTION NO. R -2011 -47 *10. Consideration of a Resolution authorizing execution of an agreement with Sun Yakima, LLC to develop a new concession /restroom facility at Upper Kiwanis Park ACTION: Resolution was adopted. RESOLUTION NO. R- 2011-48 *11. Consideration of a Resolution authorizing execution of an easement in favor of Castle Creek Apartments, LLC ACTION: Resolution was adopted. RESOLUTION NO. R -2011 -49 *12. Consideration of a Resolution setting a public hearing on April 19, 2011 for an appeal by Church on the Move regarding assessment of stormwater user's fees ACTION: Resolution was adopted. RESOLUTION NO. R- 2011 -50 ORDINANCES *13. Consideration of an Ordinance to amend the City Council Election District Map ACTION: Ordinance was passed. ORDINANCE NO. 2011 -14 *14. Consideration of an Ordinance amending the Classification and Compensation Plan for certain City employees and subsections of the City of Yakima Municipal Code to implement 3 APRIL 5, 2011 the 2011 Budget Council policy issue regarding reorganization of Information Systems and housekeeping measures ACTION: Ordinance was passed. ORDINANCE NO. 2011 -15 *15. Second Reading of an Ordinance amending the 2011 Budget for 2010 Year -End Encumbrances ACTION: Ordinance was passed. ORDINANCE NO. 2011 -16 16. Other Business • Petition #11 -03 to modify the Yakima County Tourism Promotion Area (TPA) Ordinance City Attomey Cutter explained the background on the petition. The TPA is reviewing a draft ordinance to incorporate the modifications, which will come back for Council consideration. ACTION: Motion carried to find the petition sufficient and direct legislation be prepared. VOTE: Unanimous Mayor Cawley informed the Council he has been asked to serve on the 4 of July Celebration planning committee. 17. Adjournment — 6:45 p.m. ACTION: Motion carried to adjourn to April 19, 2011 for the regularly scheduled business meeting. VOTE: Unanimous 4
