A RESOLUTION amending City of Yakima Resolution No. 2005-132 by increasing
the maximum cost for emergency repairs to the trolley tracks at
6th Avenue and Yakima Avenue, Yakima, Washington by
Railworks Track Systems, Inc. from $40,000 to $50,000 without
calling for bids.
WHEREAS, on August 16, 2005, by Resolution No. 2005-132 the Yakima City
Council declared an emergency regarding the current status of the trolley tracks at 6th
Avenue and Yakima Avenue and authorized the City Manager to execute all
necessary documents with Railworks Track Systems, Inc. for the repair and/or
reconstruction of the tracks without calling for bids and in an amount not to exceed
$40,000; and
WHEREAS, the original estimate provided by Railworks Track Systems Inc.
was based upon an expectation that the Trolley System had sufficient materials to
make the necessary repairs; and
WHEREAS, an additional $7,000 in materials are required above the original
estimate; and
WHEREAS, in addition, unanticipated additional repairs costing $4,500 were
required in order for the system to be operational for the September 9, 2005, William
O. Douglas occasion; and
WHEREAS, it is essential to take immediate action to repair said trolley
tracks in order to avoid further damage to the tracks and to passing motorists; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to amend Resolution No. 2005-132 to make the needed emergency repairs,
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City of Yakima hereby amends City of Yakima Resolution No. 2005-132
by increasing the maximum cost for emergency repairs to the trolley tracks at 6th
Avenue and Yakima Avenue, Yakima, Washington by Railworks Track Systems,
Inc. from $40,000 to $50,000 without calling for bids.

SUMMARY EXPLANATION:
Over the last month the trolley system's steel rails at Yakima Avenue and 6th Avenue have
"sprung" up from the rotted wooden ties and created such a hazardous condition that staff
believes an emergency condition exists. The temporary fix will not last long under the
traffic that Yakima Avenue Carries. Staff respectfully requests .City Council approval of the
attached resolution declaring the situation at 6th and Yakima Avenues with regard to the
trolley track crossing an emergency and waive the formal bidding process for the repair
work. The trolley cannot operate north of Yakima Avenue until the repairs have been made.
It is work that needs to be done by contractors experienced with trolley and train tracks.
They believe the under ballast needs to be reconstructed and the trolley ties have rotted to
the point of requiring replacement. The remaining work is defined in the attached bid.
The estimated cost for the repairs is approximately $37,000 and would be funded from the
General City Contingency Fund. This condition was not foreseen in any of the City's
operating budgets, therefore, necessitating use of general contingency funds.

A RESOLUTION declaring an emergency and authorizing the City Manager to execute all
necessary documents with Railworks Track Systems, Inc. for the repair
and/ or reconstruction of trolley tracks at the intersection of 6th Avenue and
Yakima Avenue, Yakima, Washington without calling for bids and at a
cost not to exceed $40,000.00.
WHEREAS, Article VI, Section 6 of the Yakima Charter and Chapter 1.80 of the City of
Yakima Municipal Code require that the purchase of supplies, materials and services costing
more than $25,000.00 to be accomplished by a call for bid; and
WHEREAS, said Charter provision, YMC Section 1.80.040 and RCW 35.22.620(6) allow
the City Council to declare an emergency in certain situations and thereby dispense with the
need to follow a competitive bid process; and
WHEREAS, the trolley tracks located at the intersection of 6th Avenue and Yakima
Avenue, Yakima, Washington, are in a significant state of disrepair, present a potential driving
hazard and require immediate repairs; and
WHEREAS, the normal bid process for said repair work would take approximately 90
days, and the tracks could be damaged even further in that time period and present an even
greater driving hazard to passing motorists; and
WHEREAS, Raulworks Track Systems, Inc. has provided an proposal to perform the
required trolley track repairs for approximately $37,000; and
WHEREAS, it is essential to the health, safety, and welfare of the citizens of Yakima that
immediate action be taken to repair said trolley tracks; and
WHEREAS, the City Council finds it to be in the best interest of the City to declare an
emergency to exist due to the aforementioned conditions and to authorize execution of all
necessary documents with Railworks Track Systems, Inc. for the repair of said trolley tracks
without calling for bids and at a cost not to exceed $40,000.00, now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
An emergency is hereby declared regarding the current status of the trolley tracks
located at the intersection of 6th Avenue and Yakima Avenue, Yakima, Washington, and the
City Manager is hereby authorized and directed to all necessary documents with Railworks
Track Systems, Inc. for the repair and/ or reconstruction of trolley tracks at the intersection of
6th Avenue and Yakima Avenue, Yakima, Washington without calling for bids and at a cost not
to exceed $40,000.00

(Railworks) offers the attached proposal and following additional clarifications for your
consideration.

Clarifications:
o Sales tax, special insurance, bonds and pavement striping or sealing is not
included.
o Permits to be furnished by City.
® State of Washington Prevailing Wages aro considered, overtime hours are not
considered.
• Railworks estimates 5 working days to perform based on a mutually agreed
schedule with a start on chosen Monday.
• Subsurface conditions are not considered.
• Asphalt repaving is based on full rail depth on new ballast at end of each tie and
between tics.
• Should Bull rails be undesired, Railworks will place City finished mud rails
with heeled spikes to maintain alignment, if shims required used plates from City
will be used.
• Railworks will obtain City of Yakima Business License prior to performance of
work.

SUMMARY EXPLANATION:
At the August 16, 2005 City Council meeting, Item No. 13, City Council by resolution declared an
emergency and authorized repair of the Trolley Tracks at 6th and Yakima Avenues without calling for
bids. Please see attached agenda statement.
Staff respectfully requests that the attached resolution amending Resolution No. R-2005-132 be
approved to raise the "not to exceed" cost amount from $40,000 to $50,000. This has been made
necessary because the attached bid was based upon an expectation that the Trolley System had
sufficient rail and other materials for the repair. Upon close inspection by the repair providers, YVT
does not have the necessary supplies, and, therefore requires an additional $7,000 in material costs
above the $37,000 base bid. Additionally, in order for the Trolley System to be operational for the
September 9, 2005 William O. Douglas occasion, $4,500 in interim repairs were made.
