Council Member Dave Edler gave an invocation and led the Pledge of Allegiance

A. Proclamations
• National American Indian Heritage Month
Mayor Cawley read a proclamation designating November as National American
Indian Heritage month. Cary Campbell, representing the Daughters of the American
Revolution, accepted the proclamation and donated a book to Council titled, The
Powers of Four.
B. Presentations /recognitions /introductions
• Recognition of retiring Fire Department Lt. Ron Johnson
Chief Hines and Deputy Chief Willson introduced Lt. Ron Johnson (RJ) who is
retiring after 32 years with the Department. He was given his Lieutenant's pin as
well as a City watch.
• Recognized Boy Scout Troop 200.
Assistant Scout Master Ken Zontek brought Troop 200 to the City Council meeting
as part of their Community merit badge. Each scout came forward and stated their
name and rank.

LOVER MOVED AND ADKISON SECONDED TO ACCEPT HEARING EXAMINER'S
RECOMMENDATION AND DIRECT LEGAL TO PREPARE APPROPRIATE
LEGISLATION. The motion carried by unanimous roll call vote.
7. Closed- record public hearing to consider the Hearing Examiner's
recommendation on the preliminary plat of Malibu subdivision
Bruce Benson, Supervising Planner, described the preliminary plat as a 14 -lot
subdivision in the vicinity of S. 66 and Chestnut Avenues. On September 23, 2010, the
Hearing Examiner conducted an open record public hearing after which he issued a
recommendation for approval.
• Mayor Cawley opened and closed the closed- record public hearing with no
one coming forward to speak.
LOVER MOVED AND ENSEY SECONDED TO ACCEPT THE HEARING EXAMINER'S
RECOMMENATION AND DIRECT LEGAL TO PREPARE APPROPRIATE
LEGISLATION. The motion carried by unanimous roll call vote.
8. Public hearing on the 2010 Rezone and Comprehensive Plan Map Amendment
Applications
Bruce Benson, Supervising Planner, described the seven change applications submitted
for 2010. There was a unanimous recommendation from the Planning Commission and
the Hearing Examiner that they be approved.
• Mayor Cawley opened and closed the public hearing with no one coming
forward to speak.
The City Clerk read the ordinance by title only; EDLER MOVED AND ENSEY
SECONDED TO PASS THE ORDINANCE. The motion carried by unanimous roll call
vote.
ORDINANCE NO. 2010 -44, AN ORDINANCE concerning land use regulation and
comprehensive planning and amending the Future Land Use Map of the City of Yakima
and zoning as follows: changing the classification of the property located at 53 West
Nob Hill Boulevard, Assessor's tax parcel number 191330 - 24020, from Industrial to
Neighborhood Commercial and zoning to SCC, Small Convenience Center; changing
the classification of property located at 215 South 72 Avenue, Assessor's tax parcel
number 181320 - 43458, from Low Density Residential to Professional Office and zoning
to B -1, Professional Business; changing the classification of property located at 2807
West Washington Avenue, Assessor's tax parcel number 181335 - 23403, from Industrial
to General Commercial and zoning to GC, General Commercial; changing the
classification of property located south of W Nob Hill Boulevard on S 1 Avenue,
Assessor's tax parcel number 191330 - 32480, from Medium Density Residential to
Neighborhood Commercial and zoning to SCC, Small Convenience Center; changing
the classification of property located at 811 W Mead, Assessor's tax parcel number

*13. Consideration of a Resolution authorizing annual renewal of the City Manager's
authority to resolve and settle any claims against or by the City of Yakima in an
amount of $100,000 or less
RESOLUTION NO. R- 2010 -122, A RESOLUTION authorizing annual renewal of the
City Manager's authority to resolve and settle any claims against or by the City of
Yakima in an amount of $100,000 or less, and to execute all documents necessary to
the resolution or settlement of such claims.
*14. Consideration of a Resolution authorizing execution of an Interlocal Jail
Agreement with the City of Sunnyside
RESOLUTION NO. R- 2010 -123, A RESOLUTION authorizing the City Manager of the
City of Yakima to execute an Interlocal Jail Agreement with the City of Sunnyside,
Washington for the provision of jail services.
*15. Consideration of a Resolution authorizing execution of an agreement with
Huibregtse Louman and Associates for North First Street corridor revitalization
project
RESOLUTION NO. R- 2010 -124, A RESOLUTION authorizing the City Manager to
execute a Professional Services Agreement with Huibregtse Louman Associates, Inc. to
determine options for infrastructure and public facilities related to the 'North First Street
Corridor Revitalization
*16. Consideration of a Resolution ratifying a contract amendment (Addendum One) to
the initial agreement with Gillihan Law office for public defender representation of
indigent defendants
RESOLUTION NO. R- 2010 -125, A RESOLUTION ratifying contract amendment
(Addendum One) to initial agreement with Gillihan Law Office for public defender
representation of indigent defendants.
*17. Set date of Closed Record public hearing for December 7, 2010 on the preliminary
plat of Washington Heights Phases 2 through 11
December 7, 2010 was set as the date of a Closed Record public hearing on the
preliminary plat of Washington Heights Phases 2 through 11

*18. Consideration of an Ordinance amending Chapter 7.90 of the City of Yakima
Municipal Code by adding a new section 7.90.040 entitled "Unlawful Transit
Conduct" and adopting the Revised Code of Washington Statute 9.91.025 by
reference.
ORDINANCE NO. 2010 -46, AN ORDINANCE relating to Transit; amending Chapter
7.90 of the City of Yakima Municipal Code by adding a new section 7.90.040 and
adopting the Revised Code of Washington Statute 9.91.025 entitled, "Unlawful Transit

19. Other Business
• Strong Mayor Format - City Manager Zais advised that the City Attorney expects to
have a formal resolution ready for Council action at the December 7 business
meeting. This would be in time for approval and submittal to the County Auditor for
the February 8' 2011 special election. He clarified that the ballot proposition
concerns
only the form of government and does not elect the mayor. If the ballot is successful,
it would initiate the next phase invoking a municipal election in the August primary
from which the two top candidates would advance to the November general election.
Until then, the current form of government remains stable until a new mayor is
elected and certified by the auditor.
• Tom McCormick expressed a concern about people putting motors on bicycles and
then not following the rules for motorcycles. He also expressed a desire for Amtrack
service from Yakima to Seattle.
