ITEM TITLE: Consideration of a petition from the operators of lodging businesses that
represent greater than forty percent (40 %) of the tourism promotion charges
imposed within the Yakima County Tourism Promotion Area during the preceding
calendar year requesting a revision of the Tourism Promotion Area Ordinance,
YMC 5.99, to reflect the withdrawal of the Cities of Selah and Union Gap from
the Yakima County Tourism Promotion Area effective August 6, 2011 and
August 26, 2011 respectively; modifying the Tourism Promotion Area ordinance
to remove references to the assessment zones; and revising the voting
membership of the Yakima County Tourism Promotion Area to reflect the
withdrawal of Selah and Union Gap.

SUMMARY EXPLANATION: The City of Yakima has received a petition from the Yakima
County Tourism Promotion Area (TPA) membership representing more than forty percent of the
® payments of tourism promotion assessments imposed by the TPA, requesting that the City
modify the TPA ordinance, YMC 5.99, to reflect the withdrawal of the cities of Selah and Union
Gap from the TPA, effective in August of this year. The modification is requested to remove
reference to the withdrawing cities from the TPA ordinance, as well as to . modify the
assessment provision to remove reference to the assessment zones presently included in the
ordinance that pertained to the Selah and Union Gap areas, and to modify the voting
membership of the TPA in recognition of the loss of Selah and Union Gap from the voting
representation. Having received this petition and upon finding the petition sufficient the TPA is
requesting that the City Council approve the modifications to the ordinance in sufficient time to
allow the changes to become effective by October 1, 2011, following review and approval of the
Washington Department of Revenue as required by State law.

RE: Petition to update the Yakima County Tourism Promotion Area (TPA)
(Ordinance 2010 -37)
Mayor Cawley and Council:
We are pleased to present the attached petition requesting the City of Yakima make
various changes to Ordinance 2010 -37 enacted last year. In brief, these changes
include cleaning up the ordinance as the communities of Union Gap and Selah leave
the commission this summer, remove zone references, change the rate to $2.00 and
add a fifth hotel member to the commission.
This petition has been signed by thirteen authorized representatives at hotels /motels in
the Yakima County Promotion Area. These properties represent 64% of the sleeping
rooms in the TPA and easily generate the majority of the revenues.
These changes are needed to make the commission more effective and generate
revenues to compete in the marketplace, especially in light of the fact that as of June
30 2011 there will no longer be a State Tourism Office.
It is our desire that revisions be done in sufficient time so that the changes can begin
October 1, 2011 and that the Department of Revenue (DOR) receives at least 75 days
advance written notice of the changes so that the DOR can notify the motels /hotels and
implement new collections by that date.

• WHEREAS, RCW Chapter 35.101, authorizes the establishment of a Tourism Promotion Area by a city to
• permit the charge of Tourism promotion charges to fund the promotion of tourism and convention
business within the Tourism Promotion Area boundaries; and
WHEREAS, the Operators of Lodging Businesses within the City of Yakima and the City of Union Gap
presented in 2004 an initiation petition to establish a Tourism Promotion Area ( "initiation Petition ") to the
City Council of the City of Yakima seeking to have the City Council of the City of Yakima establish a
Yakima County Tourism promotion area, specifically including the areas within the jurisdictions of the City
of Yakima, the City of Selah, the City of Union Gap, and the unincorporated areas of Yakima County
pursuant to the terms of RCW Chapter 35.101; and
WHEREAS, The City of Yakima passed ordinance No. 2004 -17 on the 13 day of April 2004 and modified
it September 24, 2010, Ordinance 2010 -37 and
WHEREAS, Chapter 5.99.070 of the Yakima Municipal code titled "Modification or Disestablishment of
the Tourism Promotion Area" states:
B: If the Operators of Lodging businesses which paid over forty percent (40 %) of the tourism
promotion charges imposed within the Yakima County Tourism Promotion Area during the preceding
calendar year file a petition with the City Council of the City of Yakima or the Yakima Hotel and Motel
Commission requesting that the City Council of the City of Yakima adopt a resolution of intention to
modify or disestablish the Yakima County Tourism Promotion Area, the City Council of the City of Yakima
shall adopt such resolution and act upon it as required by law. Signatures on such petition shall be those
of a duly authorized representative of the operators of Lodging Businesses in the Yakima County Tourism
Promotion Area.
NOW THEREFORE, The lodging businesses who are classified as hotels or motels with 40 rooms or
more and are located with the Tourism Promotion Area do hereby petition the Council of the City of
Yakima as follows:
1) Remove references to City of Union Gap and City of Selah from the Ordinance 2010 -37, including
their representation on the TPA Commission, as they are leaving the Yakima Tourism Promotion
area effective August 6, 2011 for Selah and August 26, 2011 for Union Gap.
2) Remove. references to Zones and change the TPA collection fee to $2.00 for all lodging 410
properties with 40 rooms or more in the City of Yakima as well as the unincorporated areas of
Yakima County.
3) Add a fifth voting member to the Hotel Motel Commission from an eligible lodging property
located in the city limits of Yakima or the unincorporated areas of Yakima County.
It is our desire that these changes be done in sufficient time so that the changes can begin October 1,
2011 and that the Department of Revenue (DOR) receives at least 75 days advance written notice of the
changes so that the DOR can notify the motels /hotels and implement new collections by that date.
