R-2006-177 A RESOLUTION authorizing the City Manager to execute an amendment extending the Interlocal Jail Agreement with the City of Toppenish through December 31, 2007. WHEREAS, on February 7, 2002, the City of Yakima executed an Interlocal Jail Agreement with the City of Toppenish for jail services; and WHEREAS, the City of Yakima and the City of Toppenish have extended the Agreement three times, through December 31, 2004, through December 31, 2005 and again through December 31, 2006; and WHEREAS, the City of Yakima desires to continue utilizing the jail facilities maintained by Toppenish for the detention of Yakima prisoners; and WHEREAS, the City of Toppenish is willing to continue making its jail facilities available to Yakima for the detention of some Yakima prisoners at the rate of $40 per day; and WHEREAS, the City Council has determined that it is in the best interest of the City to authorize an amendment extending the Interlocal Jail Agreement to December 31, 2007, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to execute the attached and incorporated "City of Yakima Interlocal Jail Agreement Amendment" for jail services through December 31, 2007. I 101; Davi• Edler, Mayor R-2606 -177 CITY OF YAKIMA INTERLOCAL TAIL AGREEMENT AMENDMENT WHEREAS the City of Yakima and the City of Toppenish have a contract dated the 7th day of February, 2002, for the incarceration of prisoners; and WHEREAS in December 2005, the City of Yakima and the City of Toppenish signed an amendment extending the Agreement through December 31, 2006; and WHEREAS the City of Yakima and the City of Toppenish wish to continue this Agreement, NOW THEREFORE IT IS AGREED TO AMEND THE INTERLOCAL JAIL AGREEMENT AS FOLLOWS: 1. The City of Toppenish, through its police department, will continue to provide space for City of Yakima prisoners at the daily rate of forty dollars ($40.00) per day, per prisoner, until December 31, 2007. 2. The City of Toppenish, through its police department may collect a ten dollar ($10.00) booking fee from the inmate to be retained by the City. CITY OF YAKIMA By: R.A. Murphy, City Manager Date: 114 t(' � � RESOLUTION 2006-46 RESOLUTION AMENDING INTERLOCAL JAIL AGREEMENT WITH THE CITY OF YAKIMA WI-IEREAS,.the City of Yakima and its Police Department utilizes the Toppenish jail facilities for the custody of prisoners arrested by the Yakima Police Department in accordance with the terms and provisions of the interlocal agreement, a copy of which is attached hereto, and WHEREAS the City of Yakima and its Police Department wish to extend that agreement for a one-year period from January 1, 2007 through December 31, 2007, and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TOPPENISH, WASHINGTON AS FOLLOWS: Section 1. The Amendment to the INTERLOCAL JAIL AGREEMENT between the City of Toppenish and the City of Yakima is approved and the City Manager is authorized to execute said agreement on behalf of the City of Toppenish. Gary Belles -576-6547 Cynthia Martinez -575-6033 SUMMARY EXPLANATION: Attached is a resolution authorizing the execution of an Interlocal Jail Agreement between the City of Yakima and the City of Toppenish. The proposed agreement will extend the provisions of the 2006 contract, which expires at the end of December 31, 2006, through to the end of 2007. The proposal will allow the City of Yakima to continue to house misdemeanant offenders in the Toppenish City Jail in exchange for a daily rate of $40.00 per bed. Under the terms of the agreement, the City of Toppenish retains the right to bill a booking fee of $10.00 to City of Yakima inmates housed in the Toppenish facility.
