R-2007- 55 A RESOLUTION authorizing and directing the City Manager to execute a License Agreement with Felicia M. Holtzinger and William and Judy Bailey for private irrigation lines to be constructed, operated and maintained within the City street right-of-way of Scenic Drive. WHEREAS, Felicia M. Holtzinger and William and Judy Bailey desire to locate two individual irrigation lines within a portion of the City's right-of-way along an unimproved section of Scenic Drive between the 7000 block and the 7600 block; and WHEREAS, the pipes will extend approximately 500 feet west from an existing Yakima Tieton weir box; and WHEREAS, The City engineer will review and approve the design, location and construction of this private construction within the City's right-of-way before it is constructed; and WHEREAS, time is of the essence to construct these private irrigation lines to water existing mature landscaping that is no longer accessible for irrigation lines from the south as a result of the new Englewood West subdivision; and now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Yakima City Council authorizes and directs the City Manager to execute a License Agreement with Felicia M. Holtzinger and William and Judy Bailey, subject to legal and engineering review. ADOPTED BY THE CITY COUNCIL this 17th day of.ril, 2007. ' (5' For meeting of: April 17, 2007 ITEM TITLE: Consideration of a Resolution authorizing and directing the City Manager to execute a License Agreement with Felicia Holzinger and William and Judy Bailey for private irrigation lines to be constructed o rated and maintained within the City right-of-way. Cook, Director of Community and Economic Development CONTACT PERSON/TELEPHONE: William Cook, 575-6113 SUMMARY EXPLANATION: Earlier this spring Council approved the final plat for the Englewood West subdivision. As a result of this new development, the Holzinger residence on Scenic Drive will be required to relocate the source of their irrigation service that formerly came up the hill from the south from Englewood Drive. At the recommendation of the Yakima Tieton Irrigation Company, an improved access to the Holtzinger's property and to their neighbor to the east, Bill and Judy Bailey, would be service from an existing irrigation weir box on Scenic Drive where the road turns north in the 7000 block. The City engineer will review and approve the design of this private construction within an unused City right-of-way running west from the existing weir box (see attached map and aerial photo) to a point where it rejoins Scenic Drive at another 90 -degree turn in the 7600 block. The City engineer will also inspect the construction to assure we know the location of these two individual two-inch pipes within the City's right-of-way Since existing mature landscaping on the Holtzinger property is currently without access to irrigation,. and warmer weather is upon us, we are requesting Council authorize the City Manager to execute a license agreement with the two named parties and authorize construction subject to the City engineer's review.
