R-2007-83 authorizing and directing the City Manager of the City of Yakima to execute an Agreement for Professional Services with Wardell Architects, P.S., to provide professional assistance to the City of Yakima Police Department for project design and oversight of the remodel of the Yakima Police Department Crime Lab. WHEREAS, public safety is a primary function and responsibility of the City; and WHEREAS, public safety is largely dependent upon the effective investigation and prosecution of criminal activity; and WHEREAS, such investigation can only be fully effective when evidence can be properly processed and tested through up-to-date forensic techniques by technicians using adequate laboratory facilities; and WHEREAS, the existing Yakima Police Department crime lab is of insufficient size and capacity to efficiently accommodate the volume of evidence currently being handled, is too small to allow more than one evidence technician workspace at one time and it Tacks the space to accommodate the addition of desirable forensic investigative equipment; and WHEREAS, one hundred thousand dollars ($100,000.00) has previously been budgeted to accomplish a remodel of space within the police department to provide the facilities necessary to effectively carry out the forensic work required by the Yakima Police Department; and WHEREAS, Wardell Architects, P.S. have the professional and technical skills necessary to design, implement and oversee the work required to remodel the police department for the new Crime Lab and are willing to provide those services to the City in accord with the terms and conditions of the professional services contract attached hereto and incorporated herein by this reference; and WHEREAS, Wardell Architects, P.S. has been granted the professional services contract attached hereto and incorporated herin by this reference; and WHEREAS, Stephens and Son Construction Inc. has submitted the low bid for the project; and WHEREAS, the low bid was for one hundred forty thousand dollars ($140,000); and WHEREAS, sufficient funds to complete the project have been identified; and WHEREAS, the City Council deems it to be in the best interest of the City to complete the execution of the Professional Services Contract with Wardell Architects, P.S., to provide the professional services specified therein; Now, Therefore (jc)res/Wardell-Police Crime Lab 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to expend the sum of $140,000 to execute the attached and incorporated "AIA Document B151-Abreviated Standard Form of Agreement Between Owner and Architect" as amended, with Wardell Architects, P.S. to provide professional technical assistance to the Yakima Police Department during the design, implementation and completion of the Yakima Police Department Crime Lab.' The Police Dept intended for this to be the construction contract with Stephens and Sons, (the Whereas' speak to that, and I know they recently had the bid opening), but they did the agenda and the resolution for a contract with Wardell's, although their contract was approved by council last October I pulled the Wardell contract (Res 2006-146). It does not have any "broad" language to authorize CM to do other contracts related to the project. It looks to me like the recent council action should nullified in some way, and the contract with Stephens and Sons executed, but how that happens is definitely your call. This information has been coming to me piecemeal, and between questions Linda Watkins has raised, as well as yours Unfortunately, there was apparently no contract or amendment attached to the newest resolution, so I am uncertain of what has taken place previously or what is going on right now with this new resolution. It is likely that the total project cost will exceed the $140,000 listed in the resolution, and the $140,000 is not tied to the contract with Wardell, it is the construction contract—the Wardell contract is for $24,000 Do you think this needs a clarification action? Eppenoon 7/2/2007 Page 1 of 2 Watkins, Linda From: Cutter, Jeff Sent: Friday, June 29, 2007 12 17 PM To: Watkins, Linda Subject: RE I need help It sounds like what was described to you and I when this started, and then was questioned for lack of the proper documentation attached to the resolution, is not at all what has actually taken place As I recall, the most recent resolution stated that an amendment was being approved to provide the necessary additional funding resulting from increased costs due to the time delay from the original approval of the original contract. That is not what has apparently happened Do I correctly understand that the document he now brought you is another contract for a different scope of work? (ie -construction oversight vs architectural design?) This doesn't sound right, as the contract should have included both. I do wonder what the heck is going on here, and why the additional money is needed. I am going to call Lois and see if she can explain what the gist of this is, whether it was properly described (and explained to you and I) and why a new contract was necessitated I will try to accomplish that today or Monday, and will let you know what I learn Thanks for your efforts I should have taken the time to get this sorted out at the time the resolution was submitted. same old story, and same old ending! Remember after last Council meeting, he had the agenda statement and the resolution written improperly stating that the City Manager was authorized to sign an agreement with Wardell, for an additional $40,000. In the agenda statement he referenced Resolution R-2006-146 for the original $100K. I called him on it because there was 1) no contract attached, and 2) that it sounded like it should be an amendment to the original contract adding the $40K. He went away to get the amendment. Today he comes in with a new contract from Wardell. He said he had asked them for the amendment and she (Lois?) sent him this new contract because they have now gone out to bid and awarded the construction. I asked him if this new contract then replaces the existing contract, rather than adding an amendment to the original one He said no. That was for the architectural phase, this one is for the construction phase. It sounded like two separate issues to me and I was confused about the funding for each. I kept trying to find out what dollars the first contract was for versus the dollars for the second one to make sure Council had approved both. He kept telling me both contracts were for the same money, $100,000 with an increase of $40,000 for a total of $140K. My logical brain could not fathom how you could have two contracts for the same actual dollars without one replacing the other, or being an addendum to. He kept throwing words at me that I couldn't get to relate to my questions, but finally I suggested he was saying that this was a project for $140K and both these documents support the project. He was excited that I finally got it and went away happy. But — now my question to you. Should this second contract from Wardell have been reviewed by you? Should it have gone through council, not just approval for the additional $40K. He bypassed the process and apparently took it Dick himself and got him to sign it, and I think has already given a signed one to Wardell Bottom line, do I just attach this new one to the original contract I had on file and "assume" all is well and good and drop the whole thing? (That would be my best fantasy so I don't have to deal with him on it again) For some reason I feel uncomfortable that it hasn't had the proper care and feeding Your advice, as always, would be appreciated 6/29/2007 Page 1 of 1 Watkins, Linda From: Cutter, Jeff Sent: Wednesday, June 20, 2007 1203 PM To: Watkins, Linda Subject: RE: CC Mtg 6/19 - Contracts No Linda, you are tracking just fine, as usual All of these documents come from Gary Belles I did review the grant documents and the MOU, and it should have been attached for signature, as best as I can recall I had to track Gary down to get him to let me see it originally, and had advised him that all of the documents had to be attached Apparently that fell on deaf ears The grant application was a document I didn't see, but did review the resolution and agenda I have to admit that I assumed that the grant documents had been signed, thus the reference to ratification It is my opinion that the grant documents should go to the City file in both cases, insofar as they dictate the expenditures that the funds are permitted to go toward I would suggest that you send the questions to Gary and request that he provide the documents you are short, as well as obtain any signatures that should rightfully have been placed thereon before Council reviewed, as it appears from the ratification language that that was the intent. Item No. 10 is authorization for a JAG grant application The MOU was signed by County Commissioner(s) earlier in the day and was supposed to have been forwarded to the Council by last night. Autumn, over County should be forwarding it to Debbie Moore I sent a copy of the MOU with the Agenda Statement and Resolution, however it was apparently routed to County as the Commissioners' meeting preceded City Council. Item No 11. authorizes the Dick (or his designee) to submit an application for the grant, to accept the grant and to "take all steps and execute all documents and contracts necessary to complete this grant transaction, including but not limited to execution of Interlocal Agreement(s) with any jurisdiction(s) electing to participate " The grant is still being written and the jurisdictions participating have not yet been determined The resolution simply empowers Dick to do whatever he needs to in order to pursue and execute the grant. WHEREAS, public safety is a primary function and responsibility of the City; and WHEREAS, public safety is largely dependent upon the effective investigation and prosecution of criminal activity; and WHEREAS, such investigation can only be fully effective when evidence can be properly processed and tested through up-to-date forensic techniques by technicians using adequate laboratory facilities; and WHEREAS, the existing Yakima Police Department crime lab is of insufficient size and capacity to efficiently accommodate the volume of evidence currently being handled, is too small to allow more than one evidence technician workspace at one time and it lacks the space to accommodate the addition of desirable forensic investigative equipment and WHEREAS, one hundred thousand dollars ($100,000.00) has previously been budgeted to accomplish the design, project oversight and remodel of space within the police department to provide the facilities necessary to effectively carry out the forensic work required by the Yakima Police Department; and WHEREAS, Stephens and Sons Construction, Inc. was the low bidder for the construction phase of the remodel project and has the expertise and technical skills necessary to perform the work required to remodel the police department for; the new Crime Lab and is willing to provide those services to the City in accord with the terms and conditions of the AIA construction contract attached hereto and incorporated herein by this reference, and WHEREAS, .the low bid for the project was for one hundred forty thousand dollars ($140,000.00), an amount in excess of the originally budgeted project cost; and WHEREAS, additional funds in the amount of forty thousand dollars ($40,000.00) have been identified to cover most of the shortfall from the originally approved amount; and WHEREAS, the City Council was recently requested to approve a resolution authorizing execution of an architectural contract for the Yakima Police Crime Lab with Wardell Architects, P.S. when the actual contract approval was for the above -referenced (jc)res/Stephens Construction Police Crime Lab 1 contract with Stephens and Sons Construction, Inc., and the City Council wishes to correctly identify the contractor in that regard; and WHEREAS, the City Manager has already executed the attached and incorporated construction contract following the Council's initial approval under Resolution No. 2007-83; and WHEREAS, the City Council deems it to be in the best interest of the City to ratify the execution of the attached AIA Construction Contract with Stephens and Sons Construction, Inc. to provide the construction services specified therein; Now, Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The attached and incorporated "AIA Document A101 -Standard Form of Agreement Between Owner and Contractor" as amended, with Stephens and Sons Construction, Inc. to provide remodel construction work to the Yakima Police Department for the completion of the Yakima Police Department Crime Lab, which was previously executed by the City Manager following approval of Resolution No 2007-83 on June 19`h, 2007, is hereby ratified by the Yakima City Council. Belles As we discussed with you previously, we have been working on the design and construction documents for the Police Lab. In our last meeting with Kristen Drury and Capt. Jeff Schneider, several items were discussed that: have a bearing on the fee for our work. It was decided that to correspond with funds available, the project should be in two phases. The first phase, to be completed this year, would do all or the majority of the demolition activities, such as installing the pass-through between the Lab and Evidence, removal of one wall in the space, and installation of the ventilation system for the Lab. The second phase would complete the work of interior finishes, casework and other items. Because we will be splitting the project in two phases, this will necessitate some additional work on our part to bid and administer the contracts. In addition, since the initial study for the project was completed, we have determined that the mechanical work for the project will be more complex, requiring the services of a mechanical engineer These changes include a more elaborate ventilating system and "make-up air" requirements. Based on the work already performed and the work needing to be performed by our engineering consultants and us, we suggest that our fee be on a time and expense basis not to exceed a total of $24,000.
