A RESOLUTION ratifying an application for a grant in the total amount of
$83,776 from the United States Department of Justice,
Bureau of Justice Administration, Edward Byrne Memorial
Justice Assistance Grant Program, and designating and
authorizing the City Manager to act as the official
representative of the City of Yakima and to take such
additional steps, including but not limited to execution of all
documents and contracts necessary to complete said grant
transaction.
WHEREAS, the U.S. Department of Justice, Bureau of Justice
Administration, Edward Byrne Memorial Justice Assistance Grant Program, has
grant funds available to local governments to support efforts to reduce crime and
improve public safety; and
WHEREAS, the Yakima Police Department has been notified that $83,776
in grant funds have been allocated to the City of Yakima and Yakima County and
are available upon submission of a completed grant application and satisfaction
of certain conditions; and
WHEREAS, one of the grant approval conditions is that the City and
County execute an Interlocal Agreement whereby the City shall transfer $28,541
of the grant monies to the County to support law enforcement activities of the
Yakima County Sheriffs Department; and
WHEREAS, the City Council of the City of Yakima considered this matter
at an open public meeting in which citizens were provided an opportunity to
comment and deems it to be in the best interest of the City to authorize
submission of an application to the Justice Assistance Grant Program for said
available funds and execution of all necessary documents and contracts to
complete said grant transaction, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. The City Manager or his designee is hereby authorized to submit a
completed grant application to the United States Department of
Justice, Bureau of Justice Administration, Edward Byrne Memorial
Justice Assistance Grant Program, to obtain a grant to fund local
efforts to reduce crime and improve public safety.
2. The City Manager or his designee is further authorized and directed
to accept the grant on behalf of the City of Yakima, and to take all
steps and execute all documents and contracts necessary to
complete this grant transaction, including but not limited to
execution of the attached Interlocal Agreement with Yakima County
whereby Yakima County shall receive a portion of the grant
proceeds for local law enforcement efforts.

BETWEEN CITY OF YAKIMA AND YAKIMA COUNTY
2007 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD

This Agreement is made and entered into this / ( day of 2007, by and
between CITY of YAKIMA, acting by and through its governing ody, the City Council,
hereinafter referred to as the CITY, and, YAKIMA COUNTY a ting by and through its
governing body, the Board of Commissioners, hereinafter referred to as the COUNTY, both of
Yakima County, State of Washington, witnesseth:
WHEREAS, this Agreement is made under the authority of the Interlocal Cooperation Act, as
amended, and codified in Chapter 39.34 of the Revised Code of Washington provided for
interlocal cooperation between governmental agencies; and
WHEREAS, each governing body, in performing governmental functions or in paying for the
performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the best
interests of both parties, that the undertaking will benefit the public, and that the division of costs
fairly compensates the performing party for the services or functions under this agreement; and
WHEREAS, The U.S. Department of Justice, Bureau of Justice Administration, Edward Byrne
Memorial Justice Assistance Grant (JAG) Program, has grant funds available to local
governments to support efforts to reduce crime and improve public safety; and
WHEREAS, Yakima Police Department has been notified that $83,776 in grant funds have been
allocated to the City of Yakima and Yakima County and are available upon submission of a
completed grant application and satisfaction of certain conditions; and
WHEREAS, one of the grant approval conditions is the CITY and COUNTY execute an
Interlocal Agreement whereby the City shall transfer $28,541 of the grant monies to the County
to support law enforcement activities.
NOW THEREFORE, the CITY and the COUNTY agree as follows:

Section 1.
Expressly conditioned upon award to the CITY of the above referenced grant funds in the
amount of $83,776, the CITY aggress to pay the COUNTY a total of $28,541 of JAG funds for
the purchase of a computer kiosk ($21,541) to be used by the Yakima County Sheriffs Office for
sex offender registration and tracking, and for expenses ($7,000) related to Juvenile graffiti
offender incarceration and abatement programs.
Section 2.
The COUNTY agrees to accept and use $28,541 for the purchase of a computer kiosk ($21,541.)
to be used by the Yakima County Sheriffs Office for sex offender registration and tracking, and
for expenses ($7,000) related to Juvenile graffiti offender incarceration and abatement programs.

Section 3.
Each party to this Agreement will be responsible for its own actions in providing services under
this Agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by the other party.
Section 4.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.
Section 5.
By entering into this Agreement, the parties do not intend to create any obligations express or
implied other than those set out herein; further, this Agreement shall not create any rights in any
party not a signatory hereto.
Section 6
A copy of this Agreement shall be filed with the Yakima County Community Services office.

EXPLANATORY NARRATIVE
Law and Justice Technology Upgrades -- Many of the most violent crimes involve the
illegal use of firearms, including significant numbers of gang and drug related incidents.
The City of Yakima will use a portion ($8,500) of FY 2007 JAG funds to purchase
testing equipment required to analyze ballistic evidence during the investigation of

firearms related crimes. Projectiles, together with shell and cartridge casings often offer
the only definitive proof that a particular weapon was used in such cases. The City of
Yakima does not currently possess the equipment to perform testing of such evidence
within its existing forensic evidence laboratory. As a result, ballistic evidence must be
sent to a State Crime Lab for analysis. Tests performed in this setting are typically not
available within a timely fashion. This has repeatedly effected investigations and
prosecutions in an adverse manner. The City is in the process of building an enlarged
laboratory that will be capable of accommodating the desired equipment. That
construction is being accomplished through local funding sources; however sufficient
funds to purchase the required equipment do not exist within the current budget.
Another portion ($18,275) of FY 2007 funds will be invested in protective equipment,
including both ballistic helmets and Tazers for officer use. Such equipment has
repeatedly demonstrated the ability to provide a greater level of protection and safety to
officers during high risk encounters than would otherwise be the case.. Conversely, this
same equipment lowers the risk of injuries to suspects, by reducing the need to deploy
deadly force, or other forms of force likely to cause significant injury during the course of
criminal apprehensions.
($8,500) of FY 2007 JAG funds will be expended to purchase burglar alarm systems
designed to assist in the investigation and apprehension of serial burglars. During 2006 a
total of 1,471 burglaries were reported within the City of Yakima. In many instances
single locations were burglarized repeatedly over a short period of time. The equipment

funded will provide timely, in -progress reporting of burglaries to officers in the field via
radio. This 'capability will enable an immediate response, greatly increasing the
opportunity to apprehend suspects before they are able to leave the scene of their crime.
Current systems are approximately twenty-five to thirty years old. They are no longer
reliable and are badly in need of replacement.
An additional sum ($12,396) of FY 2007 funds will be applied toward acquisition of an
automated property management system. This system will provide for a more efficient
management of evidence, as well as seized and recovered property within the
department's evidence management unit. The City currently performs in -processing and
out -processing of property with a hand-written card system that is recorded and tracked
by computer. The current, manual process takes several times the staff -hours required by
an effective, automated system, wasting valuable resources that could more effectively be
used in other areas. Additionally, it is anticipated that a fully automatic system will
provide a greater level of information regarding the location of recovered (stolen)
property to other law enforcement agencies on both a regional and national level through
such information sharing programs as Linx and N-dex.
Yakima Police Athletic League Administration and Equipment -- Expenditures in this
budget will include ($3,000) Y -PAL Center rental fees. The remaining Y -Pal funding
($4,565) included in the FY 2007 JAG will be dedicated to program and equipment
expenses that directly benefit the youth enrolled in the program and to defray
training/travel expenses designed to assure that staff members have an appropriate level
of knowledge and training. Other personnel, equipment and supply costs will be covered
via City of Yakima general budget dollars, National Police Athletic League grants, funds
from Y -PAL fundraisers and private donations.
Yakima County Law and Justice -- Yakima County will use $28,541 of FY 2007 funds
to purchase a computer kiosk($21,541) for sex offender registration and tracking by the
Yakima County Sheriffs Office, and for Juvenile Graffiti offender incarceration and
abatement programs ($7,000).

SUMMARY EXPLANATION:
The City has been invited to apply for a grant from the U.S. Department of Justice, Bureau of
Justice Assistance under the Edward Byrne Memorial Justice Assistance Grant program. The
purpose of the program is to reduce crime and improve public safety. The grant will be
requested in the amount of $83,776. The City of Yakima and Yakima County will share the
funds per a Memorandum of Understanding as required by the Department of Justice. The
attached resolution authorizes the grant application and the City Manager to act as the official
representative to accept the grant.
The grant will be used to support law enforcement efforts by procuring equipment, technology,
training and other material directly related to basic law enforcement functions as well as
providing some program, equipment and training needs of the Yakima Police Athletic League.
The Justice Assistance Grant Program requires that the City execute an interlocal agreement
with Yakima County, whereby the Yakima Sheriffs Department shall receive $28,541 of the
$83,776 grant award.
