HomeMy WebLinkAboutR-2007-088 DataLux Mobile Computers - Sole Source PurchaseRESOLUTION NO R-2007- 88 A RESOLUTION authorizing the City Manager to purchase twelve Tracer 2000 Mobile Computers and to make all future purchases for a period of three years as a sole source without calling for bids. WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally require that purchases in excess of $25,000 be done by competitive bid, subject to certain exceptions; and WHEREAS, the law recognizes a "sole source purchase" exception from bidding requirements, when due to the uniqueness of the product to be purchased and the fact there is only one source for the product, it would be futile to utilize competitive bidding; and WHEREAS, the City of Yakima acquired the DataLux Mobile Computers in 2001 through a competitive bid process; and WHEREAS, the City of Yakima continues to use the DataLux Mobile computers in its Fire Department Apparatus; and WHEREAS, other regional fire departments also use the DataLux Mobile computers in their Fire Department Apparatus; and WHEREAS, the City of Yakima Fire Department desires to remain standardized for its mobile computers and remain compatible with other fire department's mobile computers; and WHEREAS, the City of Yakima currently requires twelve additional DataLux Tracer Mobile Computers; and WHEREAS, the City of Yakima will be making additional purchases of said mobile computers, each qualifying under the same sole source exemptions as presented above; and WHEREAS, DataLux Corporation owns the rights to and is the manufacturer and sole marketer of the DataLux Tracer Mobile Computers; and WHEREAS, DataLux Corporation is willing to provide the DataLux Tracer Mobile Computers for a purchase price of $4,416 each for twelve additional units for a total sum of $52,992 plus tax; and WHEREAS, the City Council finds it would be futile to call for bids regarding the DataLux Tracer Mobile Computers as the computers are offered solely by DataLux Corporation; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to authorize the purchase of said DataLux Tracer Mobile Computers, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to currently purchase twelve DataLux Tracer Mobile Computers from DataLux Corporation for a total price of $52,992 plus tax as a sole source purchase without calling for bids. Wantland, Communications Manager 575-6048 SUMMARY EXPLANATION: In 2001 the City of Yakima went through the competitive bid process to select a laptop computer system that met that needs of, and was rugged enough to withstand the mobile environment in our fire service vehicles. From that process staff determined that DataLux Mobile Computers best served the needs of the City. Additionally, we have determined that standardization of equipment adds significant value to the long term maintenance and support of said equipment. As part of our regionalization efforts other departments also have determined that these units are the best fit for their system and as we provide services through the entire mobile data system it fits that we should continue with the standardization to these models of computer equipment. Therefore sole source authorization is requested for the current purchase and all purchase for the next three years.
