HomeMy WebLinkAboutR-2007-089 DataRadio Gemini Mobile Modems - Sole Source PurchaseA RESOLUTION RESOLUTION NO R-2007-89 authorizing the City Manager to purchase thirty-three Dataradio Gemini Mobile Modems and to make all future purchases for a period of three years as a sole source without calling for bids. WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally require that purchases in excess of $25,000 be done by competitive bid, subject to certain exceptions; and WHEREAS, the law recognizes a "sole source purchase" exception from bidding requirements, when due to the uniqueness of the product to be purchased and the fact there is only one source for the product, it would be futile to utilize competitive bidding; and WHEREAS, the City of Yakima acquired the Dataradio Wireless Mobile Data Communication system in 2004 through a competitive bid process; and WHEREAS, the City of Yakima continues to use the Dataradio system for mobile wireless data communications to the City's public safety vehicles; and WHEREAS, the Dataradio Gemini Mobile Modem is the only mobile modem that is compatible with the Dataradio system; and WHEREAS, the City of Yakima currently requires thirty-three additional Dataradio Gemini mobile modems to expand the use of the public safety wireless data communications system; and WHEREAS, the City of Yakima will be making additional purchases of said modems, each qualifying under the same sole source exemptions as presented above; and WHEREAS, Dataradio Corporation owns the rights to and is the manufacturer and sole marketer of the Dataradio Gemini Mobile Modems; and WHEREAS, Dataradio Corporation is willing to provide the Dataradio Gemini mobile modems for a purchase price of $3,074 for thirty-three additional units for a total sum of $101,442 plus tax; and WHEREAS, the City Council finds it would be futile to call for bids regarding the Dataradio Gemini Mobile Modems as the modems are offered solely by Dataradio Corporation; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to authorize the purchase of said Dataradio Gemini Mobile Modems, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to purchase thirty- three Dataradio Gemini Mobile Modems from Dataradio Corporation for a total price of $101,442 plus tax as a sole source purchase without calling for bids. Wantland, Communications Manager 575-6048 SUMMARY EXPLANATION: In 2004 the City of Yakima went through the competitive bid process to select a vendor to provide our wireless data system. The project was awarded to DataRadio Corporation. Periodically, since that time we have added units to the fleet as well as having expanded the system to include other agencies. In order to speed the process and ensure that we are in compliance with bid laws and the municipal code we are requesting a continuation of the sole source status of DataRadio Corporation. DataRadio is the sole producer of this proprietary equipment and we have determined that for now and into the foreseeable future we shall continue to use this system. It is with this in mind that we are now requesting the sole source authorization for this current purchase and future purchases for a period of three years.
