R-2007- 11.5 A RESOLUTION fixing September 13th, 2007 as the date for a public hearing before the Hearing Examiner. This hearing concerns a petition to vacate all that portion of the dedicated alley Tying between Lots 17 through 22 and Lots 23 through 28 all located in Block 71 of the Plat of The Town of North Yakima, now Yakima, as recorded in Volume "E" of Plats, Page 1 records of Yakima County, Washington. WHEREAS, pursuant to RCW § 58.17.212, a petition has been filed with the City Clerk, requesting the partial vacation of a public right-of-way located within the City of Yakima, a true copy of which petition is attached and incorporated into this resolution; and WHEREAS, such a petition has been signed by the owners of more than two-thirds (2/3) of the property abutting upon the public right-of-way (or portion thereof), which is requested to be vacated, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The above -referenced petition for vacation is hereby referred to the Hearing Examiner for public hearing pursuant to the Yakima Municipal Code § 1.43.080(H). The Hearing Examiner is directed to make written recommendation to the City Council regarding said petition. The Hearing Examiner Public Hearing shall be held on September 13th, 2007, at 9:OOAM in the City Council Chambers of City Hall, which date and time are not more than sixty (60) days, nor less than twenty (20) days after the passage of this resolution. It is further resolved that the City Clerk give notice of the Hearing Examiner in the form and manner prescribed by RCW § 58.17.080, RCW § 58.17.090, and the Yakima Municipal Code § 1.43.080(H). David E • er, Mayor City Clerk PETITION NO. 07 —0/ CITY OF YAKIMA, WASHINGTON PETITION TO VACATE STREET OR ALLEY To the City Council of the City of Yakima, Washington Comes now the undersigned petitioners and, pursuant to RCW Chapter 35.79, now respectfully show: The undersigned petitioners request that the following described street, alley or portion thereof, located in the City of Yakima, be vacated pursuant to RCW 35.79. All that portion of the dedicated alley Lying between -Lots 17 through 22 and Lots 23 through 28 all located in Block 71 of the Plat of The Town of North Yakima, now Yakima, as recorded in Volume "E" of Plats, Page 1 records of Yakima J County, Washington. This Alley, which is described as a 20 foot wide right-of-way property of 3,000 square feet, is lying adjacent to and between the following two U.S. Government owned properties; a) Assessor's Parcel # 121319-24436 — the William 0. Douglas U.S. Courthouse b) Assessor's Parcel # 191319-24498 — the recently acquired U.S. Government Parking Lot. The Alley is comprised of narrow (10' x 25') strips of land adjacent and west of lots 17 through 22, to the center of the alley, and narrow (10' x 25') strips of land adjacent and east of lots 23 through 28, to the center of the alley. (12 lots @ 10' x 25' = 3,000 square feet requested vacation of alley property) Additional factors for consideration of vacation: a) The Public Benefit of the project and the reasoning of the proposed vacation and the limits of the vacation. The purpose of the vacation request is to provide greater security to the building from potential vehicular attacks to the federal property holdings of Block 71, (R:19,T:13,S:19) Since the terrorist acts of September 11, 2001, federal buildings around the nation, including the William 0. Douglas Federal Courthouse, have been subject to comprehensive facility security reviews. Based on the security review, the U.S. General Services Administration has concluded that the William 0. Douglas Federal Courthouse should be protected from potential vehicle attacks and the vacation and acquisition of the twenty -foot wide alleyway adjacent and directly east of the Federal Building will secure the building from this potential occurrence. Douglas Federal Courthouse north of Chestnut Avenue between S. 3rd St. and S. 4th Street and to the south of the Capital Theatre Building. This vacation is being requested to further secure the William O. Douglas Federal Courthouse as a matter of national security. You are being asked to set the date for this open record public hearing before the Hearing Examiner by resolution for September 13th, 2007.
