RESOLUTION NO. R-2007-134
authorizing the Mayor of the City of Yakima to execute an
amendment to the Automatic Technical Rescue Response
Agreement between the City of Yakima and other fire protection
agencies.
WHEREAS, in 2001, the City of Yakima Fire Department entered into an mutual
aid agreement with the City of Union Gap, Yakima County Fire Protection District #4,
and Yakima County Fire Protection District #11; and
WHEREAS, the fire protection agencies desire to amend the Agreement as
provided in the attached Amendment in order to permit additional agencies to join and to
amend language that is not accurate; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to enter into the attached Amendment to the Automatic Technical Rescue
Response Agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The Mayor is hereby authorized and directed to execute the attached
"Amendment to the Automatic Technical Rescue Response Agreement".

AMENDMENT TO AUTOMATIC
TECHNICAL RESCUE RESPONSE AGREEMENT
THIS AMENDMENT TO THE AUTOMATIC TECHNICAL RESCUE
RESPONSE AGREEMENT is made and entered into by and between the City of Yakima, the
City of Union Gap, Yakima County Fire District #4, and Yakima County Fire District # 1 1.
WHEREAS, on February 15, 2001,,the City of Yakima, the City of Union Gap, Yakima
County Fire District #4, and Yakima County Fire District #11 fully executed the attached
Automatic Technical Rescue Response Agreement (hereinafter "Response Agreement").
WHEREAS, the parties desire to amend the Response Agreement as provided herein to
permit additional members to join and to amend language that is not accurate.
NOW, THEREFORE, in consideration of the mutual aid promised by each agency for
the other as well as all the other covenants, promises, and agreements set forth herein, it is agreed
by and between the City of Yakima, the City of Union Gap, Yakima County Fire District #4, and
Yakima County Fire District #11 as follows:
The attached and incorporated "Automatic Technical Rescue Response Agreement" is amended
as follows:
1. The first paragraph under "Recitals" is hereby amended to read as follows:
"WHEREAS, each of the Parties owns and maintains equipment for providing
Technical Rescue. Also, each of the Parties retains personnel to provide various levels of
service; and"
2. The eighth paragraph under "Recitals" is hereby amended to read as follows:
WHEREAS, . each of the Parties has the necessary
equipment and personnel to enable it to provide service to the
other Parties in the event of an emergency; and
3. The thirteenth paragraph under "Recitals" is hereby amended to read as follows:
WHEREAS, Yakima County Fire Protection District 11
contracts for fire and rescue services; and
4. Section 2 of the Response Agreement is hereby amended to read as follows:
Administration of Agreement: In making decisions required by
this Agreement or implementing the terms of this Agreement, the
Fire Chief of each Party shall be the decision -maker for the Party
(unless the Party designates an alternate decision -maker).
5. The second full sentence of Section 6 of the Response Agreement is hereby amended to
read as follows:
Neither this Section nor Section 5 above shall require
compliance with the direction of the on -scene commanding
officer if, in the opinion of the commanding officer of the
responding Party, such compliance would create an unreasonable
risk to the health or safety of the responding Party's personnel.
6. The heading of Section 20 of the Response Agreement is hereby amended to read as
follows:
Duration, Termination, and New Parties:
7. Section 20 is hereby amended to include a new subsection E as follows:
E. New Parties: Member parties recognize positive benefits
from adding new parties to this agreement. A new party shall
indicate their interest to join in this agreement by submitting a
letter to any member Fire Chief or Decision Maker outlined in
Section 2: Administration of Agreement. The Administrators
shall consider the new party's request and allow or deny their
membership in this agreement. The decision shall be by positive
vote with a simple majority of all member parties. The new
party shall be added to the contact list. A signature page shall be
added to the agreement with appropriate signatures from the new
Party.
Except as expressly modified herein, all other terms and conditions of the attached Automatic
Technical Rescue Response Agreement shall remain in full force and effect.

SUMMARY EXPLANATION: This agreement would affirm the current team concept
that members of the Yakima Fire Department, East Valley Fire District 4, and the
Union Gap Fire Department are using. In order to better serve the citizens of each of
our jurisdictions, we propose to train together, purchase equipment that is uniform,
and respond to these special types of emergencies. This agreement has already been
approved by the East Valley Fire District 4 fire commissioners and the Union Gap City
Council. The actual signature page is with the Union Gap Council at this time.
