A RESOLUTION authorizing the City Manager to execute a Contract with the Yakima
Clean Air Authority to inspect and replace wood stoves that do not meet clean air
requirements.
WHEREAS, the City of Yakima and the Yakima Clean Air Authority are charged with the
responsibility of ensuring a healthy environment for area residents; and
WHEREAS, clean air is one of the most basic needs of all people; and
WHEREAS, there have been instances during winter months when it has been
necessary to impose restrictions due to air pollution levels; and
WHEREAS, older wood burning stoves and fireplaces have been shown to contribute to
these problems; and
WHEREAS, the Yakima Clean Air Authority was successful in obtaining grant funds to
assist in replacing these pollution causing devices; and
WHEREAS. the Clean Air Authority desires to form a partnership with the City of Yakima
through the Office of Neighborhood Development Services to use these funds to assist
low/moderate income individuals in replacing these units, now therefore;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. A contract between the Clean Air Authority and the City of Yakima is hereby
authorized; and
2. Staff is directed to develop and implement programs that will assist qualifying area
residents in installing new, non-polluting heating devices; and
3. The City Manager is hereby authorized to sign all necessary documents and
contracts relating to this agreement.

2007- 2008 YRCAA WOOD STOVE CHANGE -OUT PROGRAM
PARTNERSHIP AGREEMENT
The Yakima Regional Clean Air Authority (YRCAA) and the City of Yakima Office of Neighborhood
Development Services (ONDS) agree to partner in a program designed to remove high -polluting wood
stoves and fireplace inserts from use within the city limits of Yakima.
A. OILS agrees to:
1. Contact pre -determined potential program participants (uncertified woodstove owners),
schedule and perform an on-site assessment of heating device location and accessories.
2. Photograph existing uncertified woodstove/insert at time of initial assessment.
3. Provide an on-site evaluation to include:
i. Completion of the Qualification Form, provided by YRCAA.
ii. if home owner program qualification is confirmed, completion of the Home Heating
Assessment Report, provided by YRCAA.
4. Advise YRCAA of the recommendations for change -out of heating device.
5. With YRCAA authorization, arrange for heating device purchase and installation.
6. Whenever possible, combine ONDS weatherization program options with this woodstove
change -out program.
7. Maintain records of qualifications and home heating assessments on appropriate forms
provided by Yakima Regional Clean Air Authority and turn over original forms to the
Yakima Regional Clean Air Authority as they are completed.
8. Prepare and submit reports to Yakima Regional Clean Air Authority that contain the
following information:

• Provide Yakima Regional Clean Air Authority with total number of qualifications
and assessments performed, with names and addresses of participants.
B. Yakima Regional Clean Air Authority agrees to:.
1. Reimburse ONDS for services rendered in the following amounts, under the following
conditions:
a. For a preliminary visit, during which it is determined that the potential participant does
not qualify for the 2007 YRCAA Woodstove Change -Out Program: $ 50.00.
b. For a preliminary visit which includes a successfully completed Qualification Form and
Home Heating Assessment Form, but which DOES NOT qualify for ONDS assistance
programs: $ 150.00 for such service.
c. For a preliminary visit which includes a successfully completed Qualification Form and
Home Heating Assessment Form, and which DOES qualify for ONDS assistance
programs: $0.00 for such service.
2. Provide Certificate of Destruction forms and other forms as needed.
3. Provide ONDS with woodstove replacement referrals, when appropriate .
4. Reimburse ONDS for each primary heating unit/system sold and installed for qualified
participants to replace a high -polluting wood stove / fireplace insert, as funds are made
available under the terms of this grant and according to the following price schedule:
➢ up to $3,000.00 for the purchase and installation of any gas, electric or oil
appliance.
➢ up to $3,000.00 for the purchase and installation of a pellet -fueled stove
➢ up to $3,000.00 for the purchase andinstallation of a Washington State certified
wood stove.
➢ All costs beyond the above amounts are the responsibility of the participant.
5. Expeditiously process invoices and reimbursements for qualified units sold according to
the price schedule above.
C. The City of Yakima Office of Neighborhood Development Services (ONDS) and Yakima
Regional Clean Air Authority agree to:
1. Address and resolve unanticipated issues expeditiously.
D. Term of this Agreement:
1. This Agreement will commence on the date last executed below.
2. This Agreement will terminate February 29, 2008, or when Yakima Regional Clean Air
Authority has determined that funds for reimbursement vouchers are depleted,
whichever occurs first.
3. This Agreement may be canceled by either party with no less than ten (1 0) working days
advance written notice. Any notices shall be effective if personally served upon the
other party or if mailed by registered or certified mail, return receipt requested, to the
addresses set out in Section E. Notice may also be given by facsimile with the original to
follow by regular mail. Notice shall be deemed to have been given three days following
the date of mailing or immediately if personally served. For service by facsimile, service
shall be effective upon receipt during working hours. If a facsimile is sent after working
hours, it shall be effective at the beginning of the next working day. Any reimbursable
financial obligations that may have accrued against ONDS as a result of participation in
this Agreement prior to receipt of effective notice of cancellation shall be reimbursed in
accord with the terms set forth in paragraph B, above.
4. This Agreement may be modified only by written mutual agreement of ONDS and
Yakima Regional Clean Air Authority. The parties agree that this Contract is the
complete expression of its terms and conditions. Any oral or written representations or
understandings not incorporated in this Contract are specifically excluded.

ITEM TITLE: A Resolution authorizing the City Manager to execute a Contract with the
Yakima Clean Air Authority to inspect and replace wood stoves that do not
meet clean air requirements.

SUMMARY EXPLANATION: Older wood stoves that do not have EPA Certification as clean
burning are a major contributor to winter air pollution in the City. In an effort to reduce this
problem, the Clean Air Authority applied for and received a grant to replace these older wood
burning stoves or fireplace inserts with either modern, EPA certified wood stoves, or
alternative heat sources, including gas or electric heaters.
At the recommendation of Councilmember Bill Lover, ONDS staff met with Clean Air staff to
discuss a possible partnership to utilize these grant funds. It was determined that this service
was an excellent partnership for our Senior/Disabled home repair program. An agreement
was reached that specifies that ONDS will inspect homes with the. non -certified units, and
make an evaluation to determine how to replace them. Funds for the inspections and
eventual replacements will be drawn from both the Clean Air grant funds and ONDS HUD
funds. This proposed program was approved by the ONDS Council Committee, and the
attached contract reviewed and approved by City Legal.
