A RESOLUTION approving the final plat of Phase 3 of Valleybrook, a 58 -lot subdivision in
three phases, and authorizing the Mayor to sign the final plat.
WHEREAS, on May 2, 2005 the Hearing Examiner held an open record public hearing
to consider an application submitted by Zier Orchards, LLC, for a proposed 58 -lot subdivision
known as Valleybrook (City of Yakima Preliminary Plat #1-05); and
WHEREAS, on May 5, 2005 the Hearing Examiner issued his Recommendation for
approval of the proposed plat subject to several conditions; and
WHEREAS, at its public meeting on July 7, 2005 the City Council determined by motion
that the Recommendation of the Hearing Examiner should be affirmed and adopted; and
WHEREAS, the City Engineer has approved and accepted all plans and designs for the
improvements required in the conditions of approval of the preliminary plat for Phase 3, and the
applicant has constructed or financially secured all such improvements; and
WHEREAS, as this final plat comes before Council for review each member declares
that he has had no contact with either the applicant or opponents of the final plat, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The proposed final plat for Phase 3 of Valleybrook, consisting of two sheets depicting
one phase of a three-phase subdivision located on the west side of South 72nd between
Spokane Street and Washington Avenue, is hereby approved and the mayor is hereby
authorized to sign the final plat. The applicant shall file the final plat for Phase 3 of Valleybrook
for record in the Yakima County Auditor's Office immediately, or as soon thereafter as possible,
and the applicant shall be responsible for all filing fees.

SUMMARY OF RECOMMENDATION
All requirements conditional to the final approval of this plat have been satisfied. The Division
of Environmental Planning recommends Council's acceptance of the final plat of Valleybrook
Phase III.
FINDINGS
BACKGROUND
Valleybrook is a new 58 -lot subdivision located in the vicinity of South 72nd and W. Washington
Avenues. In open Council session on June 28, 2005, the Hearing Examiner's recommendation,
granting preliminary approval of this long plat, was accepted. Phase III, the final phase of the
project containing Tots 29-58, is the subject of this meeting. Phases I and II have previously
been recorded.
ZONING
The intent of the SR - Suburban Residential Zoning District is to provide a variety of residential
lifestyles with densities generally ranging up to seven units per net residential acre. Residential
development of seven dwelling units per acre are permitted when both public/community water
and sewer services are available. The proposed single family subdivision is a permitted Class
(1) use in the SR zoning district.
COMPREHENSIVE PLAN
The future land use designation for this area is Low Density Residential which is primarily
composed of single family, detached residences. Net residential density before considering
roads and right of ways is less than 7 dwelling units per acre.
The Final Plat of Valleybrook Phase III is compatible with the following goals, policies and
regulations of the Yakima Urban Area Comprehensive Plan:
Objective G4: Manage the location and design of new development to minimize initial and
future public and private costs.
Policy G4.1: New urban development should be encouragedto locate first, within the City

limits and second, within those portions of the Urban Growth Area where municipal and public
facilities are already present.
Policy G4.5: Subdivisions shall be integrated into the collector and arterial street systems.
Policy G4.6: All utilities for new development shall be mapped and approved prior to
installation.
Objective L2: Establish a pattern of development that supports a sense of community.
SUBDIVISION ORDINANCE STANDARDS
Criteria for subdivisions are included in YMC Ch. 14.25, which specifies the requirements for
subdivision design. The Final Plat of Valleybrook Phase 111 has been found to comply with all
applicable standards and the Final Plat is in general conformance with the approved preliminary
plat.
ENVIRONMENTAL REVIEW -
A Determination of Nonsignificance was issued for this subdivision on March 23, 2005. The
mitigation measure required that all stormwater be maintained on site. This determination was
issued following a 20 -day comment period. No significant comments were received and no
appeal was filed. No additional SEPA review is required for the Final Plat.
CONDITIONS OF APPROVAL
The approved preliminary plat required the applicant to complete all site improvements listed as
conditions in the Hearing Examiner's Recommendation of May 2, 2005 (see attached).
The conditions that must be met before the final plat can be approved consist of the following:
1. The front yard setback on the south tier of lots on Manor Way (Washington Avenue) will
be increased by 20 -feet to promote future expansion of the street to meet arterial
standards.
Status: The final plat includes the required increase to the front yard setback on the
south tier of lots on Washington Avenue.
2. Prior to final plat approval, the developer shall file with the Planning Department
evidence of title to the right of way across Parcel No. 181332-24006.
Status: The required evidence of title to the right of way across Parcel No. 181332-
24006 had been provided.
3. The portion of the interior street in the right of way acquired across the southern portion
of Parcel No. 181332-24006 shall be 30 feet 6 inches in width measured from the
extended centerline of West Washington Avenue, including 25 feet 6 inches of street
paving complying with applicable cross section standards and a concrete sidewalk 5 feet
in width.
Status: The City Engineer has evidenced his approval of all work scheduled for
completion during Phase 111 of this development by signing the final plat.

4. All interiorstreets shall be engineered, constructed and approved according to the
standards and requirements of YMC Title 12.
Status: All interior streets have been engineered, constructed, reviewed and
approved. The City Engineer has evidenced his approval by signing the final plat.
Note: Streetlights are not yet in place but their installation has been financially
secured by way of a bond.
5. All lots shall be served with public water from the Nob Hill Water Company. No
individual domestic or irrigation wells shall be permitted for any of the lots. Prior to final
plat approval, written verification from Nob Hill Water must be submitted to the Planning
Department indicating that all construction required providing each lot with domestic
water has been completed and fees paid.
Status: All necessary water lines are installed and stubbed out to the to the property
lines with water meters installed. Verification has been received from Nob Hill Water
Co. verifying that all lots have domestic water and all fees have been paid.
6. All lots shall be provided with public sewer service according to YMC Title 12 standards.
No individual septic systems of other sewage disposal methods will be allowed. Prior to
final plat approval written verification from the City of Yakima Engineering Department
must be provided to the Planning Department indicating that all sewer extensions have
been completed or financially secured.
Status: All necessary sewer lines are installed and stubbed out to the to the
property lines. Verification has been received from the City of Yakima Engineering
Department verifying that all lots have access to public sewer.
7. A minimum 10 -foot wide public utility easement must be provided adjacent to all public
road rights-of-way.
Status: Necessary easements are shown on the plat.
8. Easements for new and/or future utilities shall be a minimum of 16 feet in width,
provided that the width of easements for buried utilities will be twice the depth of the
planned excavation.
Status: Necessary easements areshown on the plat.
9.. All public and private utilities shalt . be located underground, with the exception of
telephone boxes and such similar structures.
Status: Achieved
10. All public and private utilities to be located within public road rights-of-way must be
constructed prior to the start of road construction.
Status: Achieved

11. Fire hydrants shall be placed at the locations specified by the Building Codes Division
and Yakima Fire Department. All lots must be provided with adequate fire flow.
Status: The required fire hydrants are installed in accordance with the approved
engineered utility plan.
12. Irrigation easements, if required, shall be provided as specified by the Yakima Valley
Canal Company.
Status: Achieved
13. The final plat shall substantially conform to the preliminary plat, except as modified by
the City Council.
Status: Achieved
14. All permits required by the Yakima Regional Clean Air Authority shall be obtained,
including a Master Construction Dust Control Plan that addresses demolition, site
preparation, construction, and landscaping phases of the proposed development, per
Section 3.08 of Yakima Regional Clean Air Authority regulations. The developer shall
designate a responsible party to serve as the contact during working hours for
suspected air quality violations.
Status:- Achieved
15. The developer shall contact the State Department of Ecology to determine if residual
concentrations of pesticides above the MTCA clean up levels are present and undertake
the appropriate clean up actions as recommended by the Department of Ecology.
Status: Achieved
16. Erosion control methods such as temporary ponding, silt fencing, etc. must be in place
prior to clearing, grading or construction.
Status: Achieved
17. Each development phase shall be recorded individually at such time as the development
phases are completed.
Status: Achieved
18. The developer shall obtain street name and address assignments from the City of
Yakima Building Codes Division based on preliminary plat approval; including the
information in April 13, 2005 draft revision, Hearing Exhibit C-2, Page 2.
Status: Achieved

a. The addresses shown on this plat are accurate as of the date of recording, but may be
subject to change. The City of Yakima Building Codes Division is responsible for the
confirmation or reassignment of addresses at the time of building permit issuance.
b. The owners shown hereon; their grantees and assignees in interest hereby covenant
and agree to retain all surface water generated within the plat on-site.
Status: Notes (a) and (b) as shown above are on the face of the final plat for
Valleybrook Phase III.
CONCLUSION
1. The final plat is consistent with the goals, objectives and intent of the Urban Area
Comprehensive Plan and the standards of the Urban Area Zoning Ordinance.
2. The final plat meets the standards of the City of Yakima Subdivision Ordinance.
3. The final plat is in general conformance with the preliminary plat and the relevant
conditions of approval.
4. With the exception of streetlights, which have been financially secured through a bond,
the applicant has completed the construction of the required improvements necessary
for final plat approval.
RECOMMENDATION
The City Engineer's office has inspected and accepted all required physical improvements and
the City Engineer has signed the plat in affirmation of this fact. The Planning Division has
reviewed the final plat and found it to be in substantial conformance with the terms and
conditions of preliminary plat approval. Staff, therefore, recommends City Council acceptance
of the final plat of Valleybrook Phase III and asks that the resolution authorizing the Mayor to
sign the final plat be adopted.

ITEM TITLE: Public Meeting to consider the final plat of Valleybrook Phase ID submitted by Zier
Orchards, LLC.

SUMMARY EXPLANATION:
Valleybrook is a 58 -Lot subdivision, in three phases, located on the west side of S 72nd Avenue
between Spokane Street and Washington Avenue. In open Council session on June 28, 2005,
the Hearing Examiner's recommendation, granting preliminary approval of this long plat, was
accepted.
The City Engineer's office has inspected the plat and all completed improvements, and has
accepted a financial security for the remaining streetlights. The City Engineer has also signed
the plat in affirmation of this fact. The Planning Division has likewise reviewed the final plat and
finds it also to be in substantial conformance with the terms and conditions of the preliminary
plat decision.
`MC § 14.20.210 sets forth the following process for final plat approval:
A. Upon receipt of a proposed final plat, the City Council shall, at its next public meeting, set a
date for consideration of the final plat. Notice of the date, time, and location of the public
meeting shall be given to, the subdivision applicant, Surveyor, City Engineer, Office of
Environmental Planning, and the Yakima County Health Officer at least four days prior to the
date of the public meeting.
B. The City Council shall review the final plat during the public meeting and shall approve the
final plat if the Council determines that the final plat conforms to the conditions of preliminary
plat approval and applicable state laws and meets the requirements of this title as they
existed when the preliminary plat was approved.
C. Upon approving any final plat, the City Council shall authorize the Mayor to sign the final plat
as evidence of City Council approval. (Ord. 98-65 § 2 (part), 1998).
