R-2007-160 A RESOLUTION of the City of Yakima, Washington, authorizing and directing the City of Yakima Department of Community and Economic Development to identify and implement a policy regarding temporary emergency cold weather shelters in the City of Yakima, and providing that such policy shall be valid only during November, December 2007, and January, February and March, 2008. WHEREAS, the City of Yakima, in conjunction with the Yakima County Homeless Network, is aware that there is within the City of Yakima a population of homeless persons who may require temporary emergency shelter from cold weather; and WHEREAS, owners of various buildings, including churches, located within the City of Yakima have indicated that they are willing and able to provide temporary emergency shelter; and WHEREAS, the City of Yakima currently has no municipal code provisions, whether under the zoning, buildings, fire, or other codes, expressly allowing, authorizing, or regulating the use of such structures as temporary emergency shelters; and WHEREAS, the City of Yakima Department of Community and Economic Development has endeavored to create interim policy guidelines to address and regulate temporary emergency shelters; and WHEREAS, the Yakima City Council finds and determines that it is in the public interest to adopt the resolution set forth herein; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Yakima, Washington: The City of Yakima Department of Community and Economic Development is hereby authorized and directed to implement the proposed policy statement and application materials attached hereto as Exhibits A and B, which exhibits are hereby incorporated by this reference as if fully set forth herein This resolution shall be effective after its adoption and for a period expiring on the last day of March, 2008. Application Process Location: Name of Location: Owner or owner's representative shall submit and self certify the following: ® Sleeping areas to be located on ground floor, or on other floors with approved exiting. ®At a minimum, smoke detectors shall be located in sleeping areas and on all other floors within the building. ®Proof of approval/acknowledgement of fire insurance underwriter, or national ownership organization if self-insured. CINo cooking. ® On-site adult staff at' a ratio of one staff member per eight overnight guests. On -duty staff shall remain awake/alert. LI Floor plan showing dimensions with exits and door swing. ® Letter from Yakima Homeless Network indicating that the applicant is a certified participant in the Network's emergency shelter program. LiThe location any facility would be restricted to commercial areas. A public meeting is scheduled for January 16, 2007. Two churches have applied for and received temporary cold weather shelter status under the administrative policy: First Baptist Church, located at 515 E. Yakima Avenue and Vineyard Christian Fellowship Church, located at 221 East Martin Luther King Boulevard. Both shelters have been in operation since mid-December. To date, twenty-six individuals have received sheltr on one or more nights at the two locations. Following the public meeting on January 16, Council will adopt, modify or cancel the policy. The committee's discussion included average winter temperature information, the number of days the shelter could be used, the possibility of a "temperature trigger," the definition an emergency, and various facility related issues. The committee recommended adoption of a Cold Weather Shelter Program policy with the following changes/conditions: 1) Change all "Homeless Network" references in City documents to "Homeless Network of Yakima County. 2) Adopt a resolution that authorizes staff to utilize this policy for the months of January and February 2007 only, until review/update is completed as noted below. 3) Schedule a Council Neighborhood Development Committee meeting to review/update this policy prior to the 2007/2008 winter season. 4) Limit approval of temporary shelters to commercial areas within the City until further study and Council review prior to the 2007/2008 winter season. This will include both Vineyard and Stone Churches. I am now cognizant there is a public meeting scheduled for December 4th, to determine formal approval for this season. That said, with anticipation of the current winter weather trends forecast mid to low 20's this week, the need to open right away has become urgent. A floor plan is attached indicating two exits, door swings and where in the building the sleeping area is. Although the sleeping area is down 9 stairs from the ground level, there are two exits well indicated with smoke detectors on each floor including the sleeping area. There will be 12 cots at this facility with two fully trained volunteers thus satisfying the ratio criterion. Last year's city Emergency Cold Weather Temporary Administrative Policy was utilized as the standard listing specific city requirements; this document will serve to validate full compliance with all standard criterions. • The sleeping area at Stone is on the ground level of their out building located on their campus in back of the main building. Vineyard is in the same location as last year. • Smoke detectors are located in sleeping area and on all floors within the building. • Proof of approval/acknowledgement of fire insurance underwriter was furnished on 11/09/07. • There will be no cooking in either facility. • On-site adult staff will be at a ratio of one staff member per eight overnight guests. On -duty staff shall remain awake/alert. • Floor plans were furnished on 11/09/07. • Last year the Homeless Network provided a letter certifying the Extreme Winter Weather Shelter Project. Should another copy be necessary, one will be provided. Vineyard will for the most part be using the same basic plan as last year. Differences include the separation of men and women; there will be no married couples at Vineyard this year. Men will stay at Stone and women will stay at Vineyard. Check out will be at 6:30 AM and check in will be 5:30 to 6:30 PM. Some shelter rules have been altered to prevent conflict with guests; i.e., allowing guests to use cell phones under guarded conditions. The biggest change with the men's facility this year will be bussing from the downtown Yakima transit center to Stone Church. Church busses (15 passengers) from 151 Baptist and Stone Church will be utilized for this purpose. An initial pick-up at the transit center will be at 5:30 PM. A second bus will be used at a later time as needed. Outside those guests with their own cars, the only access to the Stone Church shelter will be by bus. Further, the Stone Church shelter will house up to 25 men. 1 of 2 11/13/07 Extreme Winter Weather Shelter Project, Yakima, WA z;®!homeless Network of Yakima County Irking for the Homeless - .-1 Continuum of Care �1ro Where 1st Baptist will not be a primary shelter this year, they have offered to be a back up should either Vineyard or Stone reach capacity. All said policies and procedures will apply there should that shelter unexpectedly need to be opened. The shelters are for extreme weather conditions where overnight temperatures fall below 32 degrees. This will be measured by temperature trends. The shelters are expected to be open between November 21st, 2007, and February 29th, 2008. Where extreme conditions persist, shelters may extend operations till the end of March, 2008. A 5 to 7 day weather trend of temperatures forecast above 32 degrees will be the deciding point for shelter closures. The Extreme Winter Weather Shelter Coordinator will make that determination. The Extreme Winter Weather Shelter Project will not be extended beyond March. An effort is underway to develop an ongoing year round sheltering system. The Vineyard Christian Fellowship of Yakima intends to spin off a separate public service none profit organization. Its name will be called The Sunrise Outreach Center or SOC of Yakima. This organization will be separate from the church in order to work with the entire community to raise financial support and a sufficient number of volunteers from all parts of our community. A facility will be identified as support funds are raised. The facility at the corner of 4th Ave and Lincoln is one potential option. Where overnight sheltering is the primary and initial concern, additional longer term housing solutions with case managed mentoring support is also being considered. The effort here will be to assist those homeless who are willing to get off the streets permanently. Such help is expected to include mental health counseling, high school completion/GED, job skill development, etc. Every effort will be made to have a permanent overnight shelter at a minimum in place by next winter season. Cook, Director of Community and Economic Development Department CONTACT PERSON/TELEPHONE: Doug Maples, Code Administration and Planning Manager (509) 575-6121 SUMMARY EXPLANATION: At the November 20, 2007 City Council meeting the City Council set December 4, 2007 as the Public Meeting to consider the adoption of Temporary Emergency Cold Weather Shelter Program in the City of Yakima and allowed an administrative policy during the interim. In January of 2007, the City Council passed a resolution authorizing the Yakima County Homeless Network to use two churches, First Baptist Church and the Vineyard Church, in the downtown area for temporary emergency cold weather shelters. This year, the Yakima County Homeless Network has requested Vineyard Church shelter the women and Stone Church shelter the men. The Homeless Network plans to shuttle the homeless men from the downtown area to the Stone Church. In addition, a need for homeless couples has developed and the First Baptist Church will be used as a shelter for approximately six (6) homeless couples. Requirements set out in the policy focus on the temporary volunteer managed characteristic of these shelters. The floor plan configuration of the homeless persons within each of the churches would be reviewed and approved by the Building/Fire Official. Staff continues to recommend a need to hold a public meeting, as to hear comments on the proposed program and locations identified. The First Baptist Church and Vineyard Church are located in the CBD (Central Business District) downtown area. The Stone Church is located in R-3 (Multi -Family Residential) with some R-2 (Two -Family Dwelling) and R-1 (Single -Family Dwelling) districts. (See attached maps.)
