R-2007 171 authorizing the City Manager to execute an amendment extending the Interlocal Jail Agreement with the City of Toppenish through December 31, 2008. WHEREAS, on February 7, 2002, the City of Yakima executed an Interlocal Jail Agreement with the City of Toppenish for jail services; and WHEREAS, the City of Yakima and the City of Toppenish have extended the Agreement four times, through December 31, 2004, through December 31, 2005, through December 31, 2006, and again through December 31, 2007; and WHEREAS, the City of Yakima desires to continue utilizing the jail facilities maintained by Toppenish for the detention of Yakima prisoners; and WHEREAS, the City of Toppenish is willing to continue making its jail facilities available to Yakima for the detention of some Yakima prisoners at the rate of $40 per day; and WHEREAS, the City Council has determined that it is in the best interest of the City to authorize an amendment extending the Interlocal Jail Agreement to December 31, 2008, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized to execute the attached and incorporated "City of Yakima Interlocal Jail Agreement Amendment" for jail services through December 31, 2008. ATTEST: City Clerk dler, Mayor CITY OF YAKIMA INTERLOCAL JAIL AGREEMENT AMENDMENT WHEREAS the City of Yakima and the City of Toppenish have a contract dated the 7th day of February, 2002, for the incarceration of prisoners; and WHEREAS in December 2006, the City of Yakima and the City of Toppenish signed an amendment extending the Agreement through December 31, 2007; and WHEREAS the City of Yakima and the City of Toppenish wish to continue this Agreement, NOW THEREFORE IT IS AGREED TO AMEND THE INTERLOCAL JAIL AGREEMENT AS FOLLOWS: 1. The City of Toppenish, through its police department, will continue to provide space for City of Yakima prisoners at the daily rate of forty dollars ($40.00) per day, per prisoner, until December 31, 2008. 2. Beginning January 1, 2009 and on each January 1 of each subsequent year, the fees in this table shall be adjusted automatically to account for any increase in the Consumer Price Index (CPI -W), all U.S. Cities, through the month of September of the previous year. Attached is a resolution authorizing the execution of an Interlocal Jail Agreement between the City of Yakima and the City of Toppenish. The proposed agreement will extend the provisions of the 2007 contract, which expires at the end of December 31, 2007, through to the end of 2008 The proposal will allow the City of Yakima to continue to house misdemeanant offenders in the Toppenish City Jail in exchange for a daily rate of $40.00 per bed. In the extension agreement Toppenish has notified Yakima of the intent to make annual. rate adjustments based upon .CPI beginning in 2009 Resolution X Ordinance Other (Specify) Contract _ X Mail to (name and address) Funding Source APPROVED FOR SUBMITTAL.
