R-2008-75 A RESOLUTION authorizing the sole source purchase of a new patented HYDROPAD TM vehicle wash fluid containment system provided by Hydro Engineering Inc. without calling for bids. WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally requires that purchases over $25,000 be done by competitive bidding, subject to certain exceptions; and; WHEREAS, the law recognized a "sole source" exception from these competitive bid requirements when, due to unique service requirements, it would be futile to utilize competitive bidding; and WHEREAS, RCW 70.95A.090 provides an exception from these competitive bidding requirements for the sale and purchase of pollution control facilities; and WHEREAS, Yakima desires to purchase one Hydro Engineering, Inc. HYDROPAD TM vehicle wash fluid containment system during 2008; and WHEREAS, the Hydro Engineering, Inc. HYDROPAD TM vehicle wash fluid containment system is protected by U.S. Methods Patent 7,258,749 manufactured exclusively by Hydro Engineering, Inc.; and therefore it would be futile to utilize a competitive bidding process for this product; and WHEREAS, Hydro Engineering, Inc. is willing to provide one HYRDOPAD TM vehicle wash fluid containment for $80,000 (plus sales tax); and WHEREAS, the quoted pricing is comparable to federal G.S.A. (General Services Administration) discounted contract pricing that is lower than retail pricing; and WHEREAS, the City Council finds that it is in the best interest of the City to authorize the purchase of one HYDROPAD TM vehicle wash fluid containment system from Hydro Engineering, Inc. as a sole source purchase without calling for bids; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to purchase one Hydro Engineering, Inc. HYDROPAD TM vehicle wash fluid containment system as a sole source purchase without calling for bids. The City Manager is further authorized to execute all necessary documents to effect said sales transaction with Hydro Engineering, Inc. ADOPTED BY THE CITY COUNCIL this 6th day of i _ 2008. The volume of solids and debris collected has grown to such a significant level that the existing collection system becomes overloaded very frequently and removal by the Wastewater Division becomes problematic due to scheduling and workload conflicts. 0 Staff respectfully requests Council approval of the attached resolution authorizing procurement of a new, patented HYDROPAD TM vehicle wash fluid containment system provided by Hydro Engineering, Inc. Funds for this project have been budgeted in the 2008 Environmental Fund. The purpose of this fund is to provide a funding source for complying with rules and regulations imposed by Federal and State mandates regarding underground storage tank operations, hazardous waste disposal, site cleanup, and other environmental compliance issues. The cost of the equipment portion of this sole source request is $93,000. Installation is estimated to be another $12,000, for a total project cost of $105,000. (Continued on next page.) Only one qualified bidder would be able to supply this patented equipment. Further, this device, see attached, is allowed to be procured without normal bidding processes because of provisions of State Pollution Prevention Exemption laws (RCW 70.95A.090) allowing for the purchase of equipment for the purpose of abating, controlling, or preventing pollution without utilizing the formal bid process. •
