RESOLUTION NO. R-2008-95
authorizing and directing the City Manager of the City of Yakima
to execute an Addendum to an Agreement with Central
Washington Occupational Medicine for the provision of drug and
alcohol testing and physical examination services through July 31,
2009.
WHEREAS, the City of Yakima and Central Washington Occupational Medicine
signed an Agreement for Drug and Alcohol Testing, City Contract No. 2004-89, on July
27, 2004; and,
WHEREAS, pursuant to the Agreement, Central Washington Occupational
Medicine has been providing drug and alcohol testing services to the City of Yakima for
Transit and other City employees; and
WHEREAS, the Agreement provided for an expiration date of July 31, 2007 with
the option to renew for two additional years; and
WHEREAS, the parties have acted in reliance on the Agreement from August 1,
2007 to the present and desire to exercise the option to renew through July 31, 2009
and to expand the services provided by Central Washington Occupational Medicine
pursuant to the Agreement; and
WHEREAS, the City Council finds that it is in the best interest of the City to
execute the attached Addendum to City Contract No. 2004-89; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to
execute the attached "Addendum to City Contract No. 2004-89" with Central
Washington Occupational Medicine for the provision of drug and alcohol testing and
physical examination services through July 31, 2009.

ADDENDUM TO CITY CONTRACT NO. 2004-89
WHEREAS the City of Yakima and Central Washington Occupational Medicine signed an
Agreement for Drug and Alcohol Testing (hereinafter "Agreement"), City Contract No. 2004-89, on
July 27, 2004; and
WHEREAS the Agreement provided for an effective period of August 1, 2004 through July
31, 2007, with the option to renew for two additional one-year periods; and
WHEREAS the City of Yakima and Central Washington Occupational Medicine have acted
in reliance on the terms and conditions of the Agreement since July 31, 2007 to the present and desire
to continue the Agreement and any prior amendments thereto through July 31, 2009; and
WHEREAS the parties also desire to expand the scope of services Central Washington
Occupational Medicine is providing pursuant to the Agreement;
NOW THEREFORE, FOR VALUABLE CONSIDERATION AND BY MUTUAL
CONSENT OF THE PARTIES, IT IS AGREED AS FOLLOWS:
1. The parties' Agreement and any prior amendments thereto are hereby made formally
effective from August 1, 2007 through July 31, 2009.
2. Central Washington Occupational Medicine agrees to provide drug and alcohol testing
services for additional City positions as directed in writing by the Purchasing Manager
and in accordance with all applicable federal and state law and City policies.
3. Central Washington Occupational Medicine also agrees to provide pre-employment
physical examinations of candidates for City employment as well as Department of
Transportation -required physical examinations for City employees upon request. Such
services shall be provided pursuant to industry standards and in accordance with all
applicable federal and state laws and City policies. Compensation for pre-employment
and DOT physical examinations requested by the City shall be Fifty -Nine Dollars
($59.00) per examination. Should the following additional services be required for the
physical examination, based on the specialized nature of the position, the following
additional fees will be charged:
A. Respiratory Protection Questionnaire $20
B. PPD $15
C. EKG $45
D. Spirometry $30
E. Hep B Vaccination $55 each
F. Hep B Titer $28
4. Central Washington Occupational Medicine accepts all requirements of this Addendum
by signing below and by its signature waives any protest or claim it may have regarding
this Addendum.
5. All acts consistent with the authority of the Agreement and any previous amendments
prior to the effective date of 'this Addendum are hereby ratified and affirmed and the
terms of the Agreement, any previous amendments, and this Addendum shall be deemed
to have applied.
6. All other provisions of the Agreement and any prior amendments thereto not inconsistent
with this Addendum shall remain in full force and effect.
IN WITNESS, the parties below have executed this Addendum, which will become effective
upon execution by both parties.

SUMMARY EXPLANATION:
On July 20, 2004, Council authorized the execution of a contract with Central Washington
Occupational Medicine (CWOM) for random drug and alcohol screening services to meet the
requirements set forth by the Federal Transit Administration. This contract had an expiration
date of July 31, 2007, with provisions for two one-year extensions, which were inadvertently
overlooked. Central Washington Occupational Medicine and the City of Yakima have acted in
reliance on the agreement from August 1, 2007 to present and desire the exercise the option to
renew through July 31, 2009 and on a limited basis, expand the services provided by CWOM.
The attached legislation authorizes an extension of the contract through August 2009 for
random drug and alcohol screening services. In addition, this addendum also authorizes
CWOM to perform: (1) pre-employment physical examinations of candidates for City
employment; (2) Department of Transportation required physical examinations for City
employees required to possess and maintain commercial driver's licenses (CDL) for their
positions; and (3) specialized examinations required for the physical examination, based on the
specialized nature of the position as set forth in the addendum.
Federal Transit Administration regulations require that these services be put out for bid in 2009
for services after August 1, 2009.
