SECTION II, SCOPE OF WORK
These Scope of Work Modifications add to and revise Exhibit B, Scope of Work, Phase 2 and/or the
Supplement No. 2, No.3, and No.4 Scope of Work Modifications. Where conflicts occur between these
Scope of Work modifications and the original Scope of Work and/or the Supplement No. 2, No. 3, and
No. 4 Scope of Work Modifications, these modifications will take precedence.
Item A - Out of Scope Work Already Done to Try to Reach Agreement with BNSF
• Five months of added coordination, management, and administration related to acquiring the
BNSF property west of the tracks and relocating their facilities
• Added design work to determine the feasibility of alternate access to BNSF's facilities and of
moving the pond to the east side of the tracks
Item B - Out of Scope Work Still Needed to be Done to Construct Lincoln Ave.
• Provide a memo to WSDOT/FHWA describing changes made to the project definition since the
Environmental Assessment was completed
• Design and detail the connection of the glass art wall to the strut and walls
• Prepare Supplement No. 5
Item C - Proposed Changes to the Scope of Work to Accommodate BNSF Leaving Their Facilities As Is
• Purchase most of the BNSF property east of the tracks and leave BNSF's facilities where they are
west of the tracks
• Revise the ROW plans and true cost estimate
• Prepare appraisals, appraisal reviews, and offers for the property east of the tracks
• Design and detail a new storm water pond on the property east of the tracks
• Design and detail a new access bridge across Lincoln Ave. west of the tracks
• Design and detail a new ramp on the west side of Hollingbery's Lincoln Ave. loading dock so it
can be accessed from 1t Ave. and eliminate the need to cross what would now still be BNSF's
property
Item D - Possible Future Work that would need a Management Reserve
• Modifying the demolition contract for the ARCO site to keep some of the tanks and pumps
operational (this will require a specialized engineering subconsultant)
• Completion of the MLK, Jr. Blvd. contract documents from 95% to 100% (this is anticipated to
mostly be including any lessons learned from construction of Lincoln Ave.)

ITEM TITLE:
BUSINESS OF THE CITY COUNCIL
YAKIMA, WASHINGTON
AGENDA STATEMENT 12_
Item No.
For Meeting of December 2, 2008
Consideration of Resolution authorizing the City Manager to execute
Supplement No. 5 for the Professional Services Contract with
BERGER/ABAM Engineers, Inc. for Railroad Grade Separation Project
SUBMITTED BY: William Cook, Director CED
CONTACT PERSON/TELEPHONE: Michael Morales, Deputy Director — 575-3533
SUMMARY EXPLANATION:
The city has engaged Berger/ABAM to provide design and administrative services for the
development of the Lincoln Avenue/MLK Boulevard Grade Separation Project. In June 2008,
the city council approved Supplement No. 4, which expires on December 31, 2008. Staff
requests authorization to execute Supplement No. 5 of this agreement, which would extend the
agreement to June 30, 2010, and cost $217,912.
The need for Supplement No. 5 is directly related to the additional design changes,
management/administrative costs related to delays by, and negotiations with, BNSF over right-
of-way acquisition and relocation. After a year long stalemate, BNSF has agreed to consider an
alternative design and property acquisition scenario that appears feasible. However, this
solution will require design changes and updated appraisals.
Supplement No. 5 will cover project design changes due to BNSF negotiations, administration
up to the start of Lincoln Avenue construction in spring 2009 and Martin Luther King Jr. Blvd. up
to the start of construction in the spring of 2010, or earlier if funds become available for MLK.
Continuing active project design is recommended due to the potential for this project to receive
additional funding via a federal or state stimulus package.
