SUBMITTED BY: Joan Davenport, Acting Director of Community & Economic Development CONTACT PERSON / TELEPHONE: Jeff Peters, Associate Planner, 575 -6163 SUMMARY EXPLANATION: On January 18, 2011, the Yakima City Council approved Phase 1 of the Barge- Chestnut Traffic Calming Plan. Passage of the attached resolution will allow the City of Yakima Director of Public Works to implement Phase 1 of the identified plan in conjunction with Phase 1 of the YVMH's Development Agreement at a cost not to exceed $50,000 from the project funds allocated within the Arterial Street Fund, without prior authorization of the Director of di Community and Economic Development Resolution X Ordinance Contract _ Other (Specify) Funding Source / �� APPROVAL FOR SUBMITTAL: ,�,v ---- Acting City Manager STAFF RECOMMENDATION: Adopt resolution approving the Barge- Chestnut Neighborhood Traffic Calming Plan Phase 1. BOARD /COMMISSION /COMMITTEE RECOMMENDATION: COUNCIL ACTION: Ili 0 . RESOLUTION NO. R -2011- A RESOLUTION approving the Barge- Chestnut Neighborhood Traffic Calming Plan Phase I and authorizing the City of Yakima Public Works Department to implement the identified traffic calming measures in conjunction with Phase 1 of the YVMH development agreement. WHEREAS, the City of Yakima adopted a Neighborhood Traffic Calming Program in 1995 and updated the policy in 2008 to include a two - tiered approach; and WHEREAS, residents of the Barge Chestnut Neighborhood Association submitted a petition for traffic calming in May of 2007 which has been evaluated by a professional engineering firm, Kittelson & Associates in a final report dated October 2009; and WHEREAS, in 2009 the City of Yakima Public Works Department in accordance with the City's adopted Traffic Calming program mailed a ballot to the citizens of the Barge Chestnut Neighborhood, and the returned ballots indicated a clear majority in favor of installing traffic calming devices; and WHEREAS, pursuant to proper notice the City Council on January 18, 2011, held an open record public hearing to consider Phase 1 of the Barge Chestnut Traffic Calming Plan as shown on the revised "Barge- Chestnut Neighborhood Traffic Calming Phase I and II" map, and gave direction to examine the possibility of directing funds from the vacation of certain streets di within the YVMH campus expansion plan to transportation projects which may include Phase II of the Traffic Calming plan as appropriate; and WHEREAS, the City Council of the City of Yakima, having received and considered the record herein, and having considered all testimony and evidence presented at the open record public hearings on January 18, 2011, now makes the following findings of fact and conclusions of law: Findings of Fact 1. The applicant has properly invoked the jurisdiction of the City of Yakima to hear and decide all issues herein; 2. Pursuant to the City of Yakima's adopted Neighborhood Traffic Calming Program, the Barge Chestnut Neighborhood Association presented a petition for traffic calming in their identified neighborhood in May of 2007; 3. The City circulated ballot to approve traffic calming measures in the Barge Chestnut Neighborhood returned a 69% majority in favor of installing traffic devices; 4. The January 18, 2011, open record public hearing for Phase 1 of the Barge - Chestnut Traffic Calming Plan herein, was properly noticed and held in compliance with state law and local ordinances, and no council member was disqualified from hearing and participating in such hearing and decisions regarding such matter; Conclusions of Law 5. The City Council of the City. of Yakima has jurisdiction to hear and decide all issues herein. dl 6. There being no objection to any council member hearing and deciding all issues herein, any objection to the ability of any council member to hear and decide these issues is hereby deemed waived; 7. All proceedings herein have complied with applicable state law and city ordinance; 8. The Barge- Chestnut Traffic Calming Plan Phase 1, being consistent with and meeting the requirements of the Yakima Neighborhood Traffic Calming Program, should be approved, and implementation of phase one shall be implemented in conjunction with Phase 1 of the YVMH Development Agreement; and WHEREAS, the City Council finds and determines that approval of the Barge- Chestnut Neighborhood Traffic Calming Plan Phase 1 is in the best interests of residents of the City of Yakima and will promote the general health, safety and welfare; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. The Barge- Chestnut Traffic Calming Plan Phase 1 will be implemented by the City of Yakima in conjunction with Phase 1 of the YVMH Development Agreement at a cost not to exceed $50,000 from the project funds allocated within the Arterial Street Fund, without prior authorization of the Director of Community and Economic Development; and 2.
