Proclamations Mayor Cawley read a proclamation declaring December 21, 2010 as Homeless Persons Memorial Day Rhonda Hoff, Chief Operating Officer of Yakima Neighborhood Health Services, accepted the proclamation B Presentations /recognitions /introductions — None C Status reports on prior meeting's citizen service requests — None D Appointments to Boards, Commissions and Council Committees — None 4 Consent Agenda ACTION Item 21 was removed from the Consent Agenda. Motion carried to adopt the consent agenda as read VOTE Unanimous *A. Consideration of approval of City Council Meeting Minutes 1 Business Meeting — November 16, 2010 ACTION: Approved *B Consideration of approval of Council Committee Meeting Minutes 1 Public Safety Committee — November 17, 2010 2. Transit- Transportation Committee — November 18, 2010 3 Economic Development Committee — December 1, 2010 4 Neighborhood Development Committee — December 1, 2010 5 Gang -Free Initiative Steering Committee — December 2, 2010 ACTION Approved 5 Audience Participation Robert Owen had various complaints about the Police Department, the length of time for Audience Participation and lack of communication with staff and the Council Mary Beechler, representing Central Washington Progress, submitted a formal request to have the petition for City Council positions to be elected by district added to the ballot for the special election on February 8, 2011 City Attorney Cutter and Council Member EttI attempted to explain the process to be followed. 1 E J Juarez, Ricardo Garcia, Sister Mary Ellen Robinson, Ron Bonlender and Dr Robert Plumb spoke in favor of allowing the petition to be added to the ballot for the February special election Bill Duerr encouraged Council to allow Ms Baechler to speak again when Council discussed the redistricting issue under Other Business and distributed a gag gift to each Council Member CITY MANAGER'S REPORTS 6 Consideration of a Resolution authorizing 2010 Community Revitalization Deduction CED Director Michael Morales explained the provisions of the resolution ACTION Motion to adopt the Resolution carried. VOTE Unanimous RESOLUTION NO R -2010 -149 *7 Consideration of 2010 third quarter finance reports A. Accounts Receivable report B Treasury report ACTION. Reports were accepted. *8 Consideration of a Resolution authorizing execution of an agreement with Yakima County District Court for probation services ACTION Resolution adopted. RESOLUTION NO R- 2010 -150 *9 Consideration of a Resolution declaring an emergency and ratifying approval of all applicable documents to allow for the repair of a section of the existing plumbing located at the City of Yakima Public Works Complex ACTION Resolution adopted RESOLUTION NO R- 2010 -151 *10 Consideration of a Resolution authorizing an amendment to an agreement with OIC of Washington for new home construction in the Marvin Gardens subdivision ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -152 *11 Consideration of a Resolution authorizing execution of a Memorandum of Understanding between the United States Marshals Service and the City of Yakima Police Department regarding the Violent Offender Task Force ACTION Resolution adopted RESOLUTION NO R- 2010 -153 *12. Consideration of a Resolution approving the preliminary plat of Washington Heights Phases 2 through 11 ACTION Resolution adopted RESOLUTION NO R -2010 -154 *13 Consideration of a Resolution adopting a revision to the City of Yakima's Drug and Alcohol Policy —Part II ACTION. Resolution adopted. RESOLUTION NO R- 2010 -155 *14 Consideration of a Resolution amending Yakima Transit's Disadvantaged Business Enterprise (DBE) program ACTION: Resolution adopted RESOLUTION NO. R- 2010 -156 *15 Consideration of a Resolution canceling the annual Management Group employee pay and compensation adjustment provided by YMC 2.20 116 for management employee compensation effective for the calendar year 2011, as provided in YMC 2.20 116(C) ACTION Resolution adopted. RESOLUTION NO R -2010 -157 *16 Consideration of a final contract payment for Tri- Valley Construction for Richardson Airways site cleanup project (approve Standard Motion V- B— accept the project and approve the final payment) ACTION: Standard Motion V -B was approved *17 Set date of public hearing for January 18, 2011 regarding the Barge- Chestnut traffic calming plan ACTION: January 18, 2011 was set as the date of public hearing ORDINANCES 18 Consideration of an Ordinance adopting a budget for the City of Yakima for 2011 City Manager Zais introduced the budget ordinance for 2011 and thanked staff for their hard work. ACTION Motion carried to pass the ordinance VOTE. Unanimous ORDINANCE NO 2010 -50 19 Consideration of an Ordinance adjusting Tahoma Cemetery rates and fees ACTION Motion carried to pass the ordinance VOTE 5 -2, Lover and Ensey voting no ORDINANCE NO. 2010 -51 20 Consideration of an Ordinance approving a 2011 to 2014 Irrigation operations and maintenance rate adjustment ACTION. Motion carried to pass the ordinance. VOTE 6 -1, Ensey voting no ORDINANCE NO 2010 -52 21 Consideration of legislation relating to Transit Services. A. Ordinance amending Chapter 7 90 of the City of Yakima Municipal Code to add new sections 7 90 030 entitled Transit Code of Conduct, 7 90 050 entitle Enforcement and Appeal procedures and 7 90 060 entitled Severability Public Works Director Chris Waarvick explained the background on the ordinance Council Member Lover stated there were complaints from business owners that transit riders sat on the sidewalks in front of businesses on the opposite side of the street from the Transit Center He suggested installing "no loitering" signs to move people along Mr Waarvick committed to meet with the business owners to find a solution. ACTION Motion to pass the ordinance carried VOTE 6 -1, Lover voting no ORDINANCE NO 2010 -53 B Resolution authorizing execution of a professional services contract for Transit Hearing Examiner services Mr Waarvick explained that this ordinance would provide for a Hearing Examiner to review appeals from citizens who no longer can use transit services due to code violations ACTION. Motion to adopt the resolution carried. VOTE Unanimous RESOLUTION NO R- 2010 -158 *22 Consideration of an Ordinance amending Chapter 7 65 Sewer Use and Pretreatment regulations to incorporate mandated local Limit revisions ACTION Ordinance passed ORDINANCE NO 2010 -54 *23 Consideration of an Ordinance amending the Classification and Compensation Plan for certain City employees and amending Subsection 2 20 110G all of the City of Yakima Municipal Code ACTION Ordinance passed. ORDINANCE NO 2010 -55 24 Other Business Council Member Ensey said he had received complaints from a couple members of the Planning Commission regarding staff interaction with the commission They want to discuss this with City management. Discussion continued on the petition for City Council positions to be elected by district. City Attorney Cutter explained the next steps of the process and timing for putting it on the ballot if the required number of signatures were obtained. Mary Baechler explained her reasons again for requesting the issue to be put on the ballot for the special election in February 2011 Ron Bonlender and Bill Duerr also spoke again on the issue ACTION Motion carried to direct staff to develop a resolution for Council consideration at the January 4, 2011 Council business meeting VOTE Unanimous 25 Adjournment — 4 04 p m ACTION Motion carried to adjoum.
